December 7, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., December 7, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Murphy, Bader, and Franklin were present. Council Members Stonecipher and Tuohy were excused. Council Member Franklin led the Pledge of Allegiance. The minutes of the November 30, 2016, City Council meeting were approved as printed. MAYOR Mayor Stephanson had no comments. COUNCIL Council Member Roberts reported that the General Government Subcommittee' s report is now available to the public, which includes a change that recommends that the Transportation Advisory Committee be engaged and informed and that it be revisited in six months. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles requested an executive session, not to exceed 20 minutes, concerning two legal matters pursuant to RCW 42. 30. 110( 1)( i)( c) with an anticipated announcement to follow. 393  December 7, 2016 CITIZEN COMMENTS No citizens wished to speak. Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. Motion carried. ACTION ITEMS: RESOLUTION — DECLARING THE CITY TO BE AN INVITING, EQUITABLE AND SAFE COMMUNITY Moved by Council Member Bader, seconded by Council Member Franklin, to adopt Resolution No. 7057 declaring the City of Everett to be an inviting, equitable and safe community for everyone who lives in, works in and visits Everett. Mayor Stephanson stated the Mayor' s office had received calls from concerned citizens and that collectively we all want individuals living in our community to feel they can call police, if appropriate, and to understand what action will be taken when they call. The Mayor invited Police Chief Dan Templeman to explain the police policy that was updated in 2010. Police Chief Templeman spoke about the Everett Police Department' s policy on the enforcement of immigration laws, which is available for viewing on the City' s website. He explained the policy is intended to ensure that individuals who are victims or witnesses to a crime feel safe speaking with police, regardless of their immigration status. President Murphy stated he had received several inquiries from citizens over the past week seeking clarification if the City of Everett is, from a policy position, a " Sanctuary City." President Murphy stated he appreciated the Chief's clarification that, from a policy standpoint, the City is not in a sanctuary city classification in that if there are people victimizing others, the police department will not hesitate to cooperate with federal authorities from an immigration standpoint. 396  December 7, 2016 Considerable discussion ensued. Aaron Powell, Everett, spoke about safety concerns relating to the low- barrier housing project. Dorian Kostelyk, Everett, stated she disagreed with earlier comments about how public safety is currently being enforced, and she urged the Mayor and Council to celebrate political diversity. Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. Motion carried. AGREEMENT — COLLECTIVE BARGAINING WITH EVERETT FIREFIGHTERS LOCAL NUMBER 46 Moved by Council Member Moore, seconded by Council Member Franklin, to authorize the Mayor to sign the collective bargaining agreement with Everett Firefighters Local Number 46 for January 1, 2015, through December 31, 2017. Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. Motion carried. RESOLUTION — SOLE SOURCE PURCHASE OF SUPPORT AND MAINTENANCE FOR CAYENTA FINANCIALS SOFTWARE Moved by Council Member Bader, seconded by Council Member Franklin, to adopt Resolution No. 7058 waiving public bidding requirements and approving a sole source purchase of Support and Maintenance for Cayenta Financials Software from N. Harris Computer Corporation in the amount of $ 113, 263. 24 including Washington State sales tax. 397  December 7, 2016 Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. AGREEMENT —MEDICAL WASTE PICKUP Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign the Waste Management Healthcare Solutions of Washington Customer Service Agreement for medical waste pickup in the approximate annual amount of$ 600. Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. Motion carried. AGREEMENT —TRANSIT EDUCATION AND FIELD TRIP PROGRAM Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign the Agreement for Transit Education and Field Trip Program with the Imagine Children' s Museum in the amount of$ 24, 000 annually, not to exceed $ 120, 000. Tyler Rourke, Everett, stated his children enjoy the bus at the Imagine Children' s Museum. Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. Motion carried. EXECUTIVE SESSION The City Council meeting recessed for an executive session at 7: 08 p. m. and reconvened at 7: 31 p. m. 398  December 7, 2016 President Murphy announced the following action item: Moved by Council Member Bader, seconded by Council Member Moore, to authorize the City to file a declaratory action under the Public Records Act seeking a ruling that certain records are subject to exemptions under the Public Records Act.
