December 21, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., December 21, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore,Murphy, Franklin, Bader, and Stonecipher were present. Council Member Tuohy was excused. Council Member Bader led the Pledge of Allegiance. The minutes of the December 14, 2016, City Council meeting were approved as printed. Council Member Moore abstained from the vote. MAYOR Mayor Stephanson commented on his participation at Snohomish County's National Homeless Person' s Memorial Day earlier in the evening and recognized the loss of homeless people over the last year and thanked the Council for supporting low barrier housing. APPOINTMENT Moved by Council Member Roberts, seconded by Council Member Franklin, to concur with the following appointment: Interim Municipal Court Judge Appointment of Judge Thomas Wynne as the interim Municipal Court Judge to fill the vacancy left by Judge Odell' s retirement. Judge Laura Van Slyck introduced Judge Wynne and explained his qualifications for the position. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. 409 December 21, 2016 Mayor Stephanson wished all staff and citizens a wonderful holiday with family and friends. COUNCIL Council Member Moore wished everyone happy holidays. Council Member Stonecipher wished everyone a Merry Christmas and a Happy Hanukah. Council Member Bader wished everyone a Happy Hanukah and blessed and peaceful Christmas. Council Member Franklin thanked the Mayor for attending the homeless memorial. She provided an update on the Community Streets Initiative and encouraged citizens to donate to the Streets Initiative Flex Fund. She invited the community to meet members of the Community Outreach and Enforcement Team on Tuesday, January 10, 2017, at 6: 30 p. m. at the Everett Public Library Main Branch. Council Member Roberts wished the best holiday season to staff and citizens and encouraged everyone to shop locally for gifts. President Murphy added his best wishes to all citizens, staff and Mayor Stephanson for a happy holiday season. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. 410 December 21, 2016 CITIZEN COMMENTS There were no citizens who wished to speak. COUNCIL BRIEFING AGENDA: Authorize the Mayor to sign Amendment No. 3 to Agreement for Purchase and Sale of Real Property, in substantially the form provided. Presented by Mike Palacios, Real Property Authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with AECOM for the Design and Construction Support Services for the Water Filtration Plant Operations Building Seismic Retrofit Project in an amount not to exceed$ 204, 400. Presented by Dave Davis, Public Works CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7061 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 865, 812. 46 for the period of December 3, 2016, through December 9, 2016. JOB COMPLETE - SHORE AVENUE STORMWATER OUTFALL IMPROVEMENTS PROJECT To accept the Shore Avenue Stormwater Outfall Improvements Project as complete and authorize the Mayor to sign the Certificate of Completion with Thomco Construction. 411 December 21, 2016 JOB COMPLETE - HAWTHORN ELEMENTARY SAFE ROUTES TO SCHOOL PROJECT To accept the Hawthorn Elementary Safe Routes to School Project as complete and authorize the Mayor to sign the Certificate of Completion with Pellco Construction, Inc. JOB COMPLETE - 2016 BIOSOLIDS REMOVAL PROJECT To accept the 2016 Biosolids Removal Project as complete and authorize the Mayor to sign the Certificate of Completion with American Process Group, Inc. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. ACTION ITEMS: BID AWARD - LANDSCAPE MAINTENANCE SERVICES Moved by Council Member Franklin, seconded by Council Member Bader, to reject apparent low bid from Superior Maintenance Solutions LLC and authorize the award of Bid 2016- 065 to Total Landscape Corporation for landscape maintenance services in the amount of$ 194,298 including Washington State sales tax. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. 412 December 21, 2016 AGREEMENT - ART- LIST MUSIC LICENSING CATALOG Moved by Council Member Moore, seconded by Council Member Franklin, to authorize the Mayor or his designee to accept the Art- List License Agreement for the Everett Channel' s subscription to the Art-List Music Licensing Catalog in the amount of$ 199. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT - SUPERVISION OF DIVERSION PROGRAMS Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the Mayor to sign the Professional Services Agreement with HopeWorks Social Enterprises for supervision of diversion programs in an amount not to exceed $ 110, 000. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT - EMERGENCY MEDICAL TRANSPORT FEE BILLING SERVICES Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign Amendment No. 10 to the Ambulance Transport Billing Services with Systems Agreement Design Northwest, Inc. for emergency medical transport fee billing services in the amount of$ 93, 058. 413 December 21, 2016 Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT —MEDICAL SERVICES FOR 2017- 2019 Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the Mayor to sign the Professional Services Agreement with Dr. Ron Brown of North Sound Emergency Medicine for medical services for 2017- 2019. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT AMENDED —CLINICAL EDUCATION Moved by Council Member Moore, seconded by Council Member Franklin, to authorize the Mayor to sign Addendum No. 1 to the Clinical Education Agreement with Providence Regional Medical Center Everett to provide clinical education to Everett Fire Department Emergency Medical Services providers. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT - EMERGENCY MANAGEMENT OPERATIONS Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign Grant Agreement E17- 148 with the Washington State Military Department to receive funding for Emergency Management Operations in the amount of$ 60, 662. 414 December 21, 2016 Roll was called with all council members voting yes, except Council Member Tuohy who was excused. AGREEMENT AMENDED — SERVICE CENTER REDEVELOPMENT PROJECT Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with the DLR Group for the design of the Service Center Redevelopment Project in the amount of 373, 117. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. COUNCIL BILL 1611- 54: THIRD AND FINAL READING: AN ORDINANCE regarding storm water and storm drainage and amending Ordinance No. 3168- 10 and 2182- 96, as amended ( Chapter 14. 28 EMC) Moved by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and final reading of Council Bill No. 1611- 54, and the city clerk is directed to call the roll for the final disposition of the ordinance. 415 December 21, 2016 AYES: Roberts, Moore, Murphy, Franklin, Bader, Stonecipher NAYS: None EXCUSED: Tuohy Ordinance No. 3528- 16 adopted. AGREEMENT —GRAND AVENUE PARK BRIDGE PROJECT Moved by Council Member Roberts, seconded by Council Member Franklin, to authorize the Mayor to sign an Interlocal Agreement with Public Utility District No. 1 of Snohomish County governing the Grand Avenue Park Bridge Project. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT AMENDED —GRAND AVENUE PARK BRIDGE DESIGN Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign Supplemental Agreement No. 2 of the Local Agency Standard Consultant Agreement with KPFF Consulting Engineers for the Grand Avenue Park Bridge design in an amount not to exceed $ 287, 915. 91. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. 416 December 21, 2016 AGREEMENT AMENDED — GRAND AVENUE PARK BRIDGE CONSTRUCTION MANAGEMENT SERVICES Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign Supplemental Agreement No. 3 of the Local Agency Standard Consultant Agreement with KPFF Consulting Engineers for the Grand Avenue Park Bridge construction management services in an amount not to exceed 1, 390, 791. 35. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. LIST APPROVAL - UTILITY CONSULTANT ROSTER Moved by Council Member Roberts, seconded by Council Member Franklin, to approve the list of consulting engineering firms for 2017- 2019 Utility Consultant Roster. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT - WATER FILTRATION PLANT EAST CLEARWELL ROOF REPLACEMENT Moved by Council Member Bader, seconded by Council Member Franklin, to authorize Public Works to seek approval from the Capital Project Advisory Review Board for the Design- Build project and authorize the Mayor to sign a Professional Services Agreement with Brown and Caldwell for Design Build consultant services for the Water Filtration Plant East Clearwell Roof Replacement in the amount of$ 190, 000. 417 December 21, 2016 Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. RESOLUTION — FEDERAL TRANSPORTATION ASSISTANCE Moved by Council Member Roberts, seconded by Council Member Moore, to adopt Resolution No. 7062, authorizing the filing of applications with the Federal Transit Administration for Federal transportation assistance Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT —REGIONAL TRANSIT ORCA MARKETING AND TDM PROJECT Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign the Regional Transit ORCA Marketing and TDM Project Agreement between King County, Department of Transportation, Metro Transit Division and City of Everett. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. AGREEMENT - EVERETT TRANSIT LONG RANGE PLAN Moved by Council Member Bader, seconded by Council Member Roberts, to authorize the Mayor to sign the Professional Services 418 December 21, 2016 Agreement with Fehr & Peers for the development of the Everett Transit Long Range Plan in the amount of$ 251, 299. J. T. Dray, Everett, spoke about Everett Transit revenue, ridership and lack of late night service from Everett Station to north of downtown. Roll was called with council members voting yes, except Council Member Stonecipher who voted no and Council Member Tuohy who was excused. Motion carried.
