August 8, 2018 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., August 8, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, McNeal, Bader, and Tuohy were present. Council Members Moore and Stonecipher were excused. Council Member McNeal led the Pledge of Allegiance. The minutes of the August 1, 2018, City Council meeting were approved as printed. MAYOR Mayor Franklin thanked neighborhood leaders and City staff for their work in organizing National Night Out events last evening. COUNCIL Council Members echoed the Mayor' s comments about National Night Out events and thanked neighborhood leaders and City staff for great events last night. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no comments. CITY ATTORNEY Deputy City Attorney David Hall had no comments. CITIZEN COMMENTS No citizens wished to speak. 243  August 8, 2018 COUNCIL BRIEFING AGENDA: Evergreen Way Alliance Presented by Hil Kaman, Administration; Jeanine Warner, Evergreen Way Alliance Ms. Warner commented about the need for some assistance with local business networking. Council Member Murphy recommended the Alliance partner with the Downtown Everett Association. Council Member Tuohy requested the City' s economic development team provide assistance to the Alliance. Council Member Bader recommended the economic development staff provide a future presentation to Council regarding Evergreen Way and the future of retail. Mayor Franklin thanked the Alliance for their work and stated the economic development team will reach out to the group. Public Hearing on Clinics and Social Services in Metro Everett Plan Presented by Allan Giffen, Planning President Roberts opened the public hearing regarding clinics and social servicesin the Metro Everett Plan. He stated that he would not be reading all of eight of the ordinances into the record as the ordinances have all been published. He stated all public input is being gathered and organized by the Planning Department. Allan Giffen,Planning, provided a presentation. He also commented on a vesting question received in a letter from Ideal Option, a treatment clinic, requesting to be grandfathered or exempted from application of the moratorium adopted as part of Ordinance 3598- 18. Discussion took place regarding the definition of clinics and social service facililities, the number of existing clinics and social services in Metro Everett, 244  August 8, 2018 and the four clinic prohibition options provided by the Planning Department for Council consideration. The following individuals spoke against zoning restrictions on new clinics and social services in downtown Everett: Amber Starkweather, Everett Michael Foster, Snohomish Leila Hill, Everett Bridgeways Morgan Dotson, Everett Sky Carver, Everett Jasmine Biggs, Lynnwood Jeffrey Allgaier, Ideal Options, Everett Geoffrey Godfrey, Ideal Options, Everett Nicole Biggs, Lynnwood The following individuals expressed support for maintaining zoning restrictions on new drug treatment clinics and social services in downtown Everett: Howie Bargreen, Everett Patrick Hall, Everett Dana Oliver, Downtown Everett Association Darcy Kirschner, Everett Elks Club Craig Skotdal, Everett Trent Mummery, Trent Development ( Seattle) Danielle Lothrop, Toggle' s Bottle Shop, Everett Council Member Bader requested City staff provide official ordinance language for all four prohibition options presented. Council Member Tuohy requested City staff prepare another ( fifth) option for regulating clinics and social services that would encompass an area smaller than the entire Metro Everett area, more like the current B- 3 zone. AGREEMENT AMENDED — HOMELAND SECURITY GRANT To authorize the Mayor to sign Amendment A to the Homeland Security Grant Agreement ( E17- 059) with Snohomish County to receive grant funds to purchase Search and Rescue equipment in the amount of $7, 700. PUBLIC HEARING — COUNCIL BILL 1807- 33: President Roberts opened the public hearing regarding the adoption of a proposed ordinance rezoning property located on the East Side of Airport Road, South of 112th Street with a Development Agreement, amending Ordinance No. 1671- 89. David Stalheim, Planning, provided a brief presentation. President Roberts invited public comment. There were no citizens who wished to speak. COUNCIL BILL 1807- 33 THIRD AND FINAL READING: AN ORDINANCE amending Ordinance No. 3204- 10, an ordinance rezoning property located on the East Side of Airport Road, South of 112th Street with a Development Agreement, amending Ordinance No. 1671- 89 Moved by Council Member Bader, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill 1807- 33. The City Clerk was directed to call the roll for the final disposition of the ordinance. ACTION ITEMS: AGREEMENT AMENDED — EVENTS CENTER GROUND LEASE Moved by Council Member Bader, seconded by Council Member McNeal, to authorize the Mayor to to sign the Interlocal Agreement between the City of Everett and the Everett Public Facilities District amending the Events Center ground lease. Council Member Murphy stated that he is a Public Facilities District ( PFD) Board member and that per advice from the City Attorney, he will be 4 250  August 8, 2018 participating in action taken on Items 19 and 20 this evening; however, he will not be participating in the PFD Board meetings when action is taken on these two matters. AGREEMENT AMENDED — CONTINGENT LOAN RELATING TO THE PFD' S 2018 BOND REFINANCE Moved by Council Member Bader, seconded by Council Member McNeal, to authorize the Mayor to sign the amended and restated Interlocal Agreement between the City of Everett and the Everett Public Facilities District for a contingent loan agreement relating to the Everett Public Facilities District' s 2018 Bond refinance.
