August 22, 2018 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., August 22, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, McNeal, Bader, Stonecipher, and Tuohy were present. Council Member Stonecipher led the Pledge of Allegiance. The minutes of the August 15, 2018, City Council meeting were approved as printed. MAYOR Mayor Franklin had no comments. COUNCIL President Roberts stated that there would be discussion regarding the eight Metro Everett proposed ordinances, which would include citizen comments followed by discussion by Council to provide guidance to staff on ordinances preparation for the public hearings scheduled for next week. ADMINISTRATION UPDATE ON PRIOR BUSINESS Nick Harper, Administration, stated that Planning staff are in attendance to answer any Metro Everett questions. CITY ATTORNEY City Attorney Iles had no comments. 262  August 22, 2018 CITIZEN COMMENTS Mike Wright, Everett, extended his thanks to Officer Purcell and David Green, Parks, for their help with an encampment cleanup in the Silver Lake area. COUNCIL BREIFING AGENDA: Adopt a resolution naming the proposed park adjacent to the YMCA located at 4730 Colby Avenue " Arthur Grossman Memorial Park" Presented by Kembra Landry, Planning Discussion ensued regarding naming conventions in relation to geographical locations, historical significance of naming parks, the public place naming policy, and naming an unbuilt park. Council Member Murphy requested that the policy be reviewed again and the entire list of names be brought back to Council for consideration. Municipal Golf Operations Update Presented by Lori Cummings, Parks Discussion ensued regarding demand versus dynamic pricing, debt of the golf courses and their financial viability, repurposing the land, shorter courses, and phasing out of the golf business. Reid Shockey, Everett, spoke on behalf of two clients who inquired about a boundary adjustment. Mike Wright, Everett, stated he supported the Metro Everett plan. David Stalheim, Planning, presented an overview of potential amendments to the ordinances of the Metro Everett plan. 265  August 22, 2018 The first issue addressed the Norton- Grand and Historic Overlays. The second issue addressed a height change request. The third issue addressed clinics and social services. The fourth issue addressed the Zoning- Land Use changes. The fifth issue addressed Off-Street Parking. Discussion took place regarding maximum building heights, access for public utilities within alleyways, incentives, sunset provisions, boundary adjustments, and the Transportation Demand Management Plan. Council Member Moore left council chambers at 1: 49 p. m. Council Members Stonecipher and Murphy stated they did not want any downzone of existing properties. Council requested that staff bring back language addressing the height change on Colby Avenue at 26th Street. Five options were presented to Council regarding clinics: prohibit entirely; prohibit on the ground floor; prohibit on the ground floor of the Transit- Oriented Development TOD) and pedestrian streets; prohibit in the ground floor of the Transit- Oriented Development TOD) and with an expanded pedestrian classification; or prohibit based on size, proximity and patient volume. Council Member Tuohy requested that the option to prohibit clinics on the ground floor of the Transit- Oriented Development ( TOD) and with the expanded pedestrian classification be brought back to Council. Council Member Bader requested that the option to prohibit clinics entirely be brought back to Council. Council requested that staff bring back language addressing one option to the zoning at Cedar Street and California Avenue. 266  August 22, 2018 Council Member Murphy stated that he would like to see that new residential buildings be required to have one parking stall per unit for studios and one bedrooms. COUNCIL BILL 1808- 35 SECOND READING: AN ORDINANCE regulating special events and repealing Ordinance No. 461- 77 COUNCIL BILL 1808- 36 SECOND READING: AN ORDINANCE closing the Special Construction Fund entitled, Main Library Window Replacement Project," Fund 342, Program 019, as established by Ordinance No. 3568- 17 CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7280 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 991, 950. 15 for the period of August 4, 2018, through August 10, 2018. RESOLUTION — PAYROLL To adopt Resolution No. 7281 acknowledging the payment of payroll claims against the City of Everett in the amount of $ 4, 072, 137. 69 for the period ending August 4, 2018, through August 10, 2018. 267  August 22, 2018 RESOLUTION — ELECTRONIC TRANSFER CLAIMS To adopt Resolution No. 7282 acknowledging the payment of electronic transfer claims against the City of Everett in the amount of 6, 907, 751. 73 for the period of July 1, 2018, through July 31, 2018. JOB COMPLETE — SEWER REGULATORS MODIFICATIONS PROJECT To accept the Sewer Regulators R4 & R39 Modifications Project with Faber Construction as complete and authorize the Mayor to sign the Certificate of Completion, allowing the release of the retainage bond. ACTION ITEMS: RESOLUTION — WASHINGTON CONDOMINIUM ACT Moved by Council Member Bader, seconded by Council Member McNeal, to adopt joint Resolution No. 7283 of the Everett City Council and the Mayor to support changes to the Washington Condominium Act. President Roberts stated that the resolution has been revised to address the need of more owner- occupied condominiums. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. 268  August 22, 2018 RFP AWARD - BIOXIDE SUPPLY SERVICES Moved by Council Member Tuohy, seconded by Council Member Stonecipher, to award Request for Proposals 2018- 046 Bioxide Supply Services to Evoqua Water Technologies LLC for a two- year contract with one- year optional renewal in the amount of $ 232, 564 per year, including Washington State sales tax. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. EASEMENT AGREEMENT— PUGET SOUND OUTFALL NO. 6 Moved by Council Member Bader, seconded by Council Member Stonecipher, to authorize the Mayor to sign an easement agreement 40 with the Port of Everett for Puget Sound Outfall No. 6. AGREEMENT AMENDED — SOUTH PRECINCT BUILDING Moved by Council Member Bader, seconded by Council Member McNeal, to authorize the Mayor to sign Amendment No. 3 to the lease agreement with Snohomish County Police and Auxiliary Services Center for space at the South Precinct Building. Motion carried. 269  August 22, 2018 COUNCIL BILL 1808- 34 THIRD AND FINAL READING: AN ORDINANCE creating a Special Improvement Project entitled 2019 Federal Overlay Project," Fund 303, Program 114, to accumulate all costs for the improvement Moved by Council Member Bader, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1808- 34 and the City Clerk was directed to call the roll for the final disposition of the ordinance. AGREEMENT AMENDED — DOWNTOWN STREETSCAPE PHASE 2 Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign Amendment No. 2 to the 270  August 22, 2018 Professional Services Agreement with Perteet, Inc. for engineering and preparation of bid documents for Downtown Streetscape Phase 2 Hoyt Avenue, Pacific Avenue to Wall Street for an amount not to exceed $ 33, 863. AGREEMENT AMENDED — BEVERLY LAKE SANITARY SEWER REPLACEMENT PROJECT Moved by Council Member Tuohy, seconded by Council Member Bader, to authorize the Mayor to sign Amendment No. 2 to the Professional Services Agreement with HWA GeoSciences, Inc. for the Beverly Lake Sanitary Sewer Replacement Project, extending the agreement completion date to December 31, 2020, and increasing the agreement by $ 7, 015 for a new total amount not to exceed $ 59, 416.
