October 3, 2018 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., October 3, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, McNeal, Bader, Stonecipher, and Tuohy were present. Council Member Stonecipher led the Pledge of Allegiance. The minutes of the September 26, 2018, City Council meeting were approved as printed. MAYOR Mayor Franklin reported on the City' s efforts relating to the Navy' s decision not to return the Nimitz to Naval Station Everett. COUNCIL Council Member Bader reported on his attendance at the Snohomish County Tomorrow 2018 Annual Assembly. He also commented on the 50th anniversary of the Boeing 747. Council Member Tuohy reported on her attendance at the Evergreen Neighborhood meeting. She also reminded the public that the annual Monte Cristo Awards Ceremony will be on October 25 at 7 p. m. Council Member Murphy provided a recap of the Budget and Finance Subcommittee meeting held earlier this evening. He also provided a liaison report on his attendance at the Public Facilities District Board meeting. President Roberts reported on his attendance ant the Westmont- Holly Neighborhood meeting. He also stated that the Supplemental Environmental Impact Statement ( EIS) for commercial air service at Paine Field was issued last week and a comment period is now open. President Roberts spoke about Everett Housing Authority' s reworked plans for Baker Heights. He announced that the regular City Council meeting of November 7 was cancelled and the meeting of November 21 will start at 12: 30 p. m. 309  October 3, 2018 ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 10 minutes, concerning a real estate matter pursuant to RCW 42. 30. 110( 1)( b) with no announcement to follow. CITIZEN COMMENTS Ryan Weber, Everett, spoke about the tabled vote of the Everett Housing Authority ( EHA) Board regarding updated plans for Baker Heights. Victor Harris, Everett, expressed his concern regarding EHA' s plan to sell property. He inquired if the City Council or the Mayor has authority to direct the EHA on the decision. City Attorney Iles clarified that the Everett Housing Authority is a separate entity and acts under its Board leadership. Considerable discussion ensued regarding the EHA' s decision, the impacts on broader community, and the City' s potential actions. COUNCIL BRIEFING AGENDA: COUNCIL BILL 1810- 39 FIRST READING: AN ORDINANCE granting a Telecommunications Franchise to Seattle SMSA Limited Partnership doing business as Verizon Wireless Presented by Katie Rathbun, Legal 310  October 3, 2018 Award Request for Proposals # 2018- 047 Real Estate Broker Services to Lee & Associates for a two- year contract with three one- year extension options Presented by Mike Palacios, Real Property CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Moore, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7291 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 572, 319. 85 for the period of September 15, 2018, through September 21, 2018. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7292 acknowledging the payment of audited and approved payroll claims against the City of Everett in the amount of$ 4, 050, 874. 22 for the period ending September 15, 2018. RESOLUTION — SURPLUS OF JOHN DEERE BACKHOE LOADER To adopt Resolution No. 7293 declaring one John Deere Backhoe Loader ( H0023) surplus and authorizing its sale at public auction. SETTLEMENT AGREEMENT — REAL PROPERTY AT 415 OLYMPIC BOULEVARD To authorize the Mayor to sign the Settlement Agreement between the City of Everett and the Barton' s regarding the Barton' s real property at 415 Olympic Boulevard. ( also referred to as 501 Olympic Boulevard). 311  October 3, 2018 AGREEMENT - BUYBOARD NATIONAL PURCHASING COOPERATIVE To authorize the Mayor or designee to enter into an Interlocal Participation Agreement with BuyBoard National Purchasing Cooperative. Roll was called with all council members voting yes. Motion carried. ACTION ITEMS: COUNCIL BILL 1809- 38 THIRD AND FINAL READING: AN ORDINANCE approving the appropriations of the 2018 revised City of Everett Budget and amending Ordinance No. 3609- 18 Moved by Council Member Bader, seconded by Council Member Stonecipher, that this is declared to be the third and final reading of Council Bill No. 1809- 38. Council Member Stonecipher asked for confirmation that there will be another amendment to the 2018 budget. Susy Haugen, Finance, stated that another amendment will be presented to the Council next week. BID AWARD — NORTH BROADWAY TRANSIT IMPROVEMENT PROJECT Moved by Council Member Moore, seconded by Council Member Bader, to award construction contract for the North Broadway Transit Improvement Project to McCann Construction Enterprises, Inc. in the amount of$ 2, 249, 764. 10, including Washington State sales tax. Council Member Bader complimented staff on their work on this project. Roll was called with all council members voting yes. Motion carried.
