October 31, 2018 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., October 31, 2018, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Roberts presiding. Upon roll call, it was found that Council Members Roberts, Murphy, McNeal, Bader, Stonecipher, and Tuohy were present. Mayor Franklin was excused and Council Member Moore was expected to be a few minutes late. Council Member Bader led the Pledge of Allegiance. The minutes of the October 24, 2018, City Council meeting were approved as printed. Council Member Stonecipher abstained from the vote. MAYOR Mayor Franklin was excused. COUNCIL APPOINTMENT Moved by Council Member Tuohy, seconded by Council Member Bader, to concur with the following appointment: Transportation Advisory Board Appointment of Al Furiak to Position 4 for a four- year term expiring December 31, 2022. Roll was called with all council members voting yes, except Council Moore who was excused. Motion carried. Council Member Bader reported on his attendance Monday at the Federal Aviation Administration' s public hearing on the impact of commercial flights at Paine Field. 348  October 31, 2018 Council Member Tuohy reported on her attendance at the Monte Cristo Awards ceremony and reception held last Thursday. Council Member Murphy announced that the Budget Subcommittee is scheduled to meet next Wednesday, November 7, at 5: 30 p. m. in the council chambers. He also reminded the public that the third public budget hearing will be held at next week' s Wednesday Council meeting. Council Member Murphy provided a liaison report on his attendance at last week' s Public Facilities District Board meeting. Council Member Moore entered the council chambers at 6: 33 p. m. President Roberts announced the General Government Subcommittee is scheduled to meet on November 14, at 5: 00 p. m., in the council chambers. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Chief of Staff, had no comments. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Nick Paul, Everett, expressed non- support for the proposed ordinance on a plastic bag ban. Victor Harris, Everett, spoke about child pedestrian safety, and encouraged the Council to look at what can be done to protect schoolchildren. 349  October 31, 2018 COUNCIL BRIEFING AGENDA: Adopt Resolution authorizing the declaration of certain City- owned properties as surplus and authorizing the sale and disposition of those properties. Presented by Mike Palacios, Real Property President Roberts announced the resolution is scheduled for Council action and public hearing on November 14, 2018. Council Member Stonecipher requested that city staff prepare, in advance of the public hearing on November 14, historical data for each of the potential surplus property sites. Mr. Palacios stated he would provide a written summary for each property prior to the public hearing. PROPOSED ACTION ITEMS: COUNCIL BILL 1810- 45 SECOND READING: AN ORDINANCE levying the general taxes for the City of Everett for fiscal year commencing January 1, 2019, on all taxable property, both real and personal, subject to taxation thereon, for the purpose of raising a portion of the revenue to carry on City operations for the ensuring year, as required by the Charter of the City of Everett and the laws of the State of Washington COUNCIL BILL 1810- 47 SECOND READING: AN ORDINANCE establishing special system development fees for connection to the City of Everett water and sewer systems and stormwater system impacts 350  October 31 , 2018 COUNCIL BILL 1810- 48 FIRST READING: AN ORDINANCE amending Ordinance No. 3578- 17 entitled, " Wall Street Building Window Replacement Project," Fund 342, and Program 025, to accumulate the construction costs for the project in the amount of$ 305, 000 COUNCIL BILL 1810- 49 FIRST READING: AN ORDINANCE creating a Special Improvement Project entitled, Deer Park Playground Replacement," Fund 354, Program 057, for the Replacement of Park Playground Equipment CONSENT ITEMS: Moved by Council Member Stonecipher, seconded by Council Member McNeal, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7302 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 4, 295, 983. 83 for the period of October 13, 2018, through October 19, 2018. RESOLUTION — PAYROLL To adopt Resolution No. 7303 acknowledging payment of audited and approved payroll claims against the City of Everett in the amount of 4, 000, 865. 28 for the period ending October 13, 2018. 351  October 31, 2018 AGREEMENT AMENDED — MONITORING OF SMITH ISLAND/ UNION SLOUGH HABITAT RESTORATION SITE To authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with ICF International to extend the contract, at no additional cost to the City. AGREEMENT AMENDED — ACCOMMODATE CITY SURFACE WATER RUNOFF To authorize the Mayor to sign Amendment No. 2 to the Interlocal Agreement for a one- year extension with Marshland Flood Control District and Snohomish County for accommodating the City' s surface water runoff. AGREEMENT AMENDED — THREE LAKES VALVE BYPASS PROJECT To authorize the Mayor to sign Amendment No. 2 to the Professional Services Agreement with Casne Engineering, Inc. to provide additional contract time for the Three Lakes Valve Bypass Project at no additional cost. AGREEMENT — FIRE DEPARTMENT SERVICES AT EVERETT EVENT CENTER To authorize the Mayor to sign the Fire Department Services Agreement with Global Spectrum, LP for Fire Department services at Everett Event Center. AGREEMENT — EQUIPMENT REPLACEMENT AT EVERETT MUNICIPAL COURT To authorize the Mayor to sign the Purchase Reimbursement Agreement between Washington State Administrative Office of the Courts and Everett Municipal Court. 352  October 31, 2018 AGREEMENT — INTERPRETING REIMBURSEMENT PROGRAM To authorize the Mayor to sign the Interagency Agreement IAA19159 between Administrative Office of the Courts and the Everett Municipal Court for State funded interpreting reimbursement program. BID CALL — DUCTILE IRON PIPE To authorize Call for Bids for Intent to Bid # 2018- 096 for Ductile Iron Pipe. Roll was called with all council members voting yes. Motion carried. ACTION ITEMS: BID AWARD —WEST MARINE VIEW DRIVE UTILITIES PROJECT Moved by Council Member Bader, seconded by Council Member Moore, to waive any immaterial irregularities in the bid by KLB Construction, deny the bid protest by Interwest Construction, and award construction contract for the West Marine View Drive Utilities Project to KLB Construction in the amount of$ 1, 379, 227. 25, including Washington State sales tax. Roll was called with all council members voting yes. Motion carried. President Roberts noted for the record that City Council is scheduled to meet next Wednesday, November 7, at 6: 30 p. m.
