February 20, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., February 20, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Council Members Roberts, Moore, Vogeli, Bader, and Tuohy were present. Mayor Franklin and Council Members Murphy and Stonecipher were excused. Council Member Moore led the Pledge of Allegiance. The minutes of the February 13, 2019, City Council meeting were approved as printed. Council Member Roberts abstained from the vote. MAYOR Mayor Franklin was excused. COUNCIL President Bader announced that the Federal Aviation Administration has approved the start of commercial flights at Paine Field in Everett. Council Member Vogeli reported on her attendance at the Harborview- Seahurst-Glenhaven Neighborhood meeting. Council Member Roberts provided a liaison report from the Delta Neighborhood meeting. He also announced that the General Government Subcommittee is scheduled to meet on March 20. Vice President Tuohy reported on her attendance at a meeting with the Everett Public Library Director, and spoke about new programs offered by the library. President Bader reported on his attendance at the Lowell Neighborhood meeting. 55 February 20, 2019 ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, provided an update on the Voluntary Separation Incentive Program. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS There were no citizens who wished to speak. COUNCIL BRIEFING AGENDA: Water Supply Forum Resiliency Project Presented by Souheil Nasr, Public Works CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Moore, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7340 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 2, 911, 720. 20 for the period of February 2, 2019, through February 8, 2019. PURCHASE — JOHN DEERE BACK LOADER To authorize the purchase of a John Deere Back Loader from Pape Machinery using Sourcewell/ NJPA contract, in the amount of 56 February 20, 2019 131, 317. 56, including Washington State sales tax. PURCHASE — BOX SANDER AND DEICER DUMP BODY To authorize the purchase of one box sander and deicer dump body from Northend Truck Equipment Inc. using Washington State Department of Enterprise Services in the amount of $ 228, 436. 68, including Washington State sales tax. PURCHASE — 2020 INTERNATIONAL CHASSIS To authorize the purchase of two 2020 International Chassis from RWC Group using Washington State Department of Enterprise Services in the amount of $ 216, 073. 12, including Washington State sales tax. AGREEMENT AMENDED — RIVERFRONT DEVELOPMENT To authorize the Mayor to sign Amendment No. 8 to the Professional Services Agreement with Floyd and Snider, Inc. for the Riverfront development for an additional $ 244, 000. Council Member Vogeli noted that the dollar amount in Section 1 ( D) should be four hundred forty- nine thousand dollars and not four hundred fifty-four thousand dollars. She also stated that in Exhibit B, the mark up should be 5% and not 10%. AGREEMENT — GROUND EMERGENCY MEDICAL PROGRAM To authorize the Mayor to sign the agreement with Central Pierce Fire Rescue for costs associated with establishing the Ground Emergency Medical Program in the amount of$ 10, 747. 35. SETTLEMENT — GRAYSON V. CITY OF EVERETT To approve the Settlement with Grayson v. City of Everett; Cause No. 18- 2- 00695- 31, in the amount of$ 20, 000. 57 February 20, 2019 Roll was called with all council members voting yes, except Council Members Murphy and Stonecipher who were excused. Motion carried. RFP AWARD — FEDERAL LEGISLATIVE & ADVOCACY SERVICES To award Request For Proposal 2018- 104 Federal Legislative & Advocacy Services to Holland & Knight, LLP in the amount of $ 120, 000. Council Member Roberts requested background information for this item. Theresa Bauccio- Teschiog, Purchasing, stated she will provide all requested information to the Council. Item tabled. ACTION ITEMS: COUNCIL BILL 1901- 06 THIRD AND FINAL READING: AN ORDINANCE closing the Special Construction Fund entitled, Everett Performing Arts Building Chiller Replacement and Cooling Tower Rebuild Project," Fund 342, Program 024, as established by Ordinance No. 3599- 18 Moved by Council Member Vogeli, seconded by Council Member Tuohy, that this is declared to be the third and final reading of Council Bill No. 1901- 06. The City Clerk was directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Moore, Vogeli, Bader, Tuohy NAYS: None 58 February 20, 2019 EXCUSED: Murphy, Stonecipher Ordinance No. 3660- 19 adopted. COUNCIL BILL 1901- 07 THIRD AND FINAL READING: AN ORDINANCE creating a Special Construction Fund entitled, Everett Fire Administration Building Tenant Improvements Project," Fund 342, Program 027 Moved by Council Member Tuohy, seconded by Council Member Roberts, that this is declared to be the third and final reading of Council Bill No. 1901- 07. The City Clerk was directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Moore, Vogeli, Bader, Tuohy NAYS: None EXCUSED: Murphy, Stonecipher Ordinance No. 3661- 19 adopted. AGREEMENT — DESIGN SERVICES FOR THE FIRE ADMINISTRATION BUILDING TENANT IMPROVEMENTS PROJECT Moved by Council Member Roberts, seconded by Council Member Tuohy, to authorize the Mayor to sign the Professional Services Agreement with Botesch, Nash & Hall Architects, P. S. to provide design services for the Fire Administration Building Tenant Improvements Project in an amount not to exceed $ 92, 020. Roll was called with all council members voting yes, except Council Members Murphy and Stonecipher who were excused. The City Clerk was directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Moore, Vogeli, Bader, Tuohy NAYS: None EXCUSED: Murphy, Stonecipher Ordinance No. 3662- 19 adopted. AGREEMENT — DESIGN SERVICES FOR THE FIRE ADMINISTRATION BUILDING MASONRY RESTORATION PROJECT Moved by Council Member Tuohy, seconded by Council Member Roberts, to authorize the Mayor to sign the Professional Services Agreement with Botesch, Nash & Hall Architects, P. S. to provide design services for the Fire Administration Building Masonry Restoration Project in an amount not to exceed $ 12, 050.
