S. September 18, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., September 18, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Moore, Murphy, Bader, and Tuohy were present. Council Members Vogeli, Roberts, and Stonecipher were excused. Council Member Moore led the Pledge of Allegiance. The minutes of the September 11, 2019, City Council meeting were approved as printed. MAYOR At the invitation of the Mayor, Principal Engineer Heather Griffen presented a video showing the upcoming movement of the Grand Avenue Park Bridge that will provide an above- ground utility crossing and a pedestrian crossing. COUNCIL Council Member Tuohy reported on her attendance at the Library Board meeting last night. She also spoke about the Downtown Everett Association Board meeting that she attended this week. President Bader reported on his attendance at the Puget Sound Regional Council Policy Board meeting. ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan had no report. 276  September 18, 2019 CITY ATTORNEY City Attorney David Hall requested authorization to initiate a lawsuit against Golden Eagle Farms. He explained that potential litigation against the blueberry farm for damage to Larimer Road was discussed in executive session several weeks ago, and authorization to proceed was now needed from Council in a public meeting. Moved by Council Member Moore, seconded by Council Member Murphy, to authorize the City to initiate a lawsuit against U. S. Golden Eagle Farms LP and Golden Eagle Farms LTD to recover damages incurred by the City due to the defendant' s activities undermining Larimer road. Roll was called with all council members voting yes, except Council Members Vogeli, Roberts, and Stonecipher who were excused. Motion carried. CITIZEN COMMENTS Anne Morgan, on behalf the Everett Bike/ Walk Committee, presented information relating to pedestrian and bicycle safety in Everett. President Bader requested information from Administration that provides additional data about pedestrian/ bicycle accidents. He also encouraged Ms. Morgan, or anyone else who is interested, to attend a meeting of the Transportation Advisory Committee ( TAC). Kristin Kinnamon, representing Sharing Wheels Community Bike Shop in Everett, also spoke about the need for changes relating to crosswalks and pedestrian safety. 277  September 18, 2019 CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7421 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $ 1, 679, 407. 85 for the period of August 31, 2019, through September 6, 2019. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7422 authorizing payroll claims against the City of Everett in the amount of$ 4, 182, 530. 90 for the period ending August 31, 2019. RESOLUTION — ELECTRONIC CLAIMS To adopt Resolution No. 7423 authorizing electronic claims against the City of Everett in the amount of $ 8, 158, 892. 48 for the period of July 1, 2019, through July 31, 2019. RESOLUTION — SURPLUS AND SALE OF BACKHOE LOADER To adopt Resolution No. 7424 declaring a 1994 Caterpillar 416B Backhoe Loader surplus and authorizing sale at public auction. PURCHASE— SOLE SOURCE PURCHASE OF MOBILE DATA TERMINALS FOR PARATRANSIT To approve Sole Source purchase of Mobile Data Terminals for Paratransit and authorize the Mayor to sign Contract Amendment No. 5 with Trapeze Software Group, Inc, dba TripSpark Technologies, to provide Mobile Data Terminals for Paratransit in the amount of$ 119, 719, not including Washington State sales tax or use tax. 278  September 18, 2019 AGREEMENT AMENDED— GENERAL CONSTRUCTION SERVICES To authorize the Mayor to sign Job Order Contract Amendment No. 1 to RFP 2018- 22 for General Construction Services to Forma Construction and Burton Construction, Inc. AGREEMENT AMENDED— JOB ORDER CONTRACTING AND CONSULTING SERVICES To authorize the Mayor to sign Professional Services Amendment No. 1 with the Gordian Group Inc. for Job Order contracting and consulting services in the estimated annual amount of$ 350, 000 for the remainder of the contract. RESOLUTION — SOLE SOURCE PURCHASE OF NEPTUNE WATER METERS AND REPAIR PARTS To adopt Resolution No. 7425 to waive public bidding requirements and approve a continuous sole source purchase of Neptune Water Meters and repair parts from Core & Main LP. PURCHASE— FIRE AND LIFE SAFETY SERVICES AND MINOR REPAIRS To award purchase of Fire and Life Safety Services and minor repairs from APi National Service Group, using Sourcewell contract for approximately$ 150, 000 annually, including Washington State sales tax. ACTION ITEMS: GRANT— EPA BROWNFIELD ASSESSMENT COALITION 279  September 18, 2019 Moved by Council Member Moore, seconded by Council Member Tuohy, to authorize staff to pursue the 2019- 2020 EPA Brownfield Assessment Coalition Grant. GRANT— INCREASING RESIDENTIAL BUILDING CAPACITY Moved by Council Member Tuohy, seconded by Council Member Murphy, to authorize staff to pursue the State Department of Commerce " Increasing Residential Building Capacity" Grant. RFQ AND RFP— CONSTRUCTION OF THE EAST CLEARWELL ROOF REPLACEMENT Moved by Council Member Murphy, seconded by Council Member Tuohy, to authorize the Request for Qualifications and Request for Proposals for the Design- Build construction of the East Clearwell Roof Replacement. Motion carried. 280  September 18, 2019 CONTRACT AWARD — CISCO NETWORKING EQUIPMENT, LICENSING, MAINTENANCE AND SUPPORT Moved by Council Member Tuohy, seconded by Council Member Murphy, to award contract and authorize approximately$ 250, 000 to be spent annually with Ednetics Inc. from Washington State Department of Enterprise Services Contact 01114/ EVT# 2018- 092 for Cisco networking equipment, equipment, licensing, maintenance and support. Roll was called with all council members voting yes, except Council Members Vogeli, Roberts, and Stonecipher who were excused. Motion carried. CONTRACT AWARD — EVERETT STATION PARKING EXPANSION Moved by Council Member Moore, seconded by Council Member Murphy, to award the construction contract for the Everett Station Parking Expansion to Rodarte Construction in the amount of$ 1, 026, 969. Roll was called with all council members voting yes, except Council Members Vogeli, Roberts, and Stonecipher who were excused. Motion carried. COUNCIL BRIEFING AGENDA: Public Hearing and Workshop on the 2020 Revenue and Expenses. Presented by Susy Haugen, Finance Mayor Franklin spoke about steps taken to address the City' s structural deficit, and she thanked Finance Director Haugen, the Finance team, the Council Budget Subcommittee, and City staff for their work over the last few months. 281  September 18, 2019 Susy Haugen presented information about City services, budget priorities, citywide and general government expenditures and revenue, and a five- year outlook comparison. President Bader opened the public hearing and invited public comment. There were no citizens who wished to speak. Moved by Council Member Moore, seconded by Council Member Tuohy, to close the public hearing. Authorize the Mayor to sign a Resolution establishing Human Needs Priorities for 2020 Grant Funding. Presented by Becky McCrary, Community Development Ms. McCrary noted the citizens' advisory committee discussed providing grants to more fully fund programs as opposed to spreading dollars out to multiple smaller grants. Authorize the Mayor to execute the 2012 and 2013 Community Development Block Grant Loan Agreement Amendments in a form approved by the City Attorney. Presented by Becky McCrary, Community Development Ms. McCrary stated the Cocoon House is requesting an amendment to two Community Development Block Grant forgivable loans that were executed in 2012 and 2013.
