Everett City Council

October 9, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., October 9, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Council Member Moore was excused. President Bader asked for a moment of silence in remembrance and honor of former council member and long- time Everett Civic leader Carl Gipson who passed away this week. Council Member Tuohy led the Pledge of Allegiance. The minutes of the October 2, 2019, City Council meeting were approved as printed. Council Member Bader abstained from the vote. MAYOR Mayor Franklin recognized Carl Gipson for the many years of dedicated service to the city and residents. She stated Mr. Gipson served on the Everett City Council for 24 years. COUNCIL Council Member Murphy echoed comments about Mr. Gipson' s service to the city, as well as the United States Military and offered condolences to the Gipson family. Council Member Murphy announced the 2020 lodging tax applications will be available this Friday. He noted the submittal deadline is November 14 by 5 p. m. and interested persons with questions may call the City Council office. He also provided a report on his attendance at the Riverside Neighborhood meeting last evening. Council Member Roberts spoke about Carl Gipson' s service and offered condolences to the Gipson family. He announced the Planning Commission is holding a public workshop on the draft Climate Action Plan next Tuesday at 300  October 9, 2019 5: 30 p. m. in the council chambers. Council Member Roberts also announced the General Government Subcommittee is scheduled to meet in the council chambers next Wednesday at 5: 00 p. m. Council Member Tuohy spoke about the dedicated service Carl Gipson gave to the community and offered condolences to the family. She also provided a reminder that the Monte Cristo Awards presentation is scheduled for tomorrow evening, October 10, at the Historic Everett Theatre. She noted doors open at 6: 30 p. m. and the program begins at 7 p. m. Council Member Stonecipher spoke about the Gipson family' s years of service to Everett and offered condolences. She reported on her attendance on Monday at the Westmont- Holly Neighborhood meeting. Council Member Stonecipher also provided an update on the Public Safety Subcommittee meeting, which was held earlier this evening. President Bader offered condolences and tribute to Carl Gipson for his extraordinary service to the city. President Bader also provided an update from the Snohomish Health District Board regarding the potential funding for the provision of Naloxone to law enforcement officials. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no comments. CITY ATTORNEY City Attorney David Hall had no comments. PUBLIC COMMENT The following retail cannabis licensees with current Title Certificates spoke in support of increasing the number of retail marijuana stores with medical 301  i October 9, 2019 endorsements. They also encouraged council members to consider revising the buffer requirement between stores. Shawn Preder, Lake Stevens Tyler Hart, Snohomish Jona Cheatham, Monroe Kara Jones, Everett, spoke about the importance of medical marijuana for symptom management of disease- related side effects and the scarcity of shops that provide medical cannabis. Kristina Franklin, general manager of Kushman' s, spoke in support of increasing the number of retail stores and offered community support to the city. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7434 authorizing claims against the City of Everett in the amount of $ 805, 026. 51 for the period of September 21, 2019, through September 27, 2019. BID CALL— WATER MAIN REPLACEMENT U PROJECT To authorize Call for Bids for the Water Main Replacement U Project. BID AWARD— BIOSOLIDS FROM ITB 2019- 070 To award all biosolids from ITB 2019- 070 not used for fall application by low bidder Sno- Valley Farms Inc. or by second- low bidder Elysian Fields to third low bidder Tenelco. 302  October 9, 2019 GRANT AWARD— FEMA ASSISTANCE TO FIREFIGHTERS GRANT ( AFG) To accept the FEMA AFG grant award at a cost to the city of $ 3, 488. 73 and authorize the Mayor to sign the grant agreement. RFQ CALL— 2022 UTILITY CONSULTANT ROSTER To authorize the Call for Request for Qualifications for 2020- 2022 Utility Consultant Roster. RFP RELEASE— TREE EVALUATION, TRIMMING, AND REMOVAL SERVICE To authorize release of Request for Proposal # 2019- 097 Tree Evaluation, Trimming, and Removal Service. AGREEMENT— RENEWAL OF FY 2019 STOP FORMULA GRANT To authorize the Mayor to sign all necessary documents and agreements with Washington State Department of Commerce regarding utilization and acceptance of the FY 2019 WA State STOP Formula Renewal Grant in the amount of$ 32, 170. ACTION ITEMS: RESOLUTION — ACCEPT PETITION AND SET HEARING FOR PROPOSED VACATION Moved by Council Member Vogeli, seconded by Council Member Tuohy, to adopt Resolution No. 7435 accepting the petition and setting November 6, 2019, at 6: 30 p. m. as the date and time of the public hearing for the proposed vacation 303  October 9, 2019 of the east/ west alley adjacent to Lot 1, Block 739, Plat of Everett Land Company' s First Addition to Everett. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. INTERLOCAL AGREEMENT— CITY/ COUNTY CORPORATE BOUNDARY REVISION Moved by Council Member Roberts, seconded by Council Member Tuohy to approve the Interlocal Agreement with Snohomish County relating to the Revision of the City/ County corporate boundary authorizing the Mayor to execute the Agreement and all other documents as necessary to fulfill the agreement. Roll was called with all council members voting yes, except Council Member Moore who was excused. Motion carried. AGREEMENT— FEMA STAFFING FOR ADEQUATE FIRE AND EMERGENCY RESPONSE SAFER) GRANT Moved by Council Member Tuohy, seconded by Council Member Roberts, to accept the FEMA SAFER grant award at a three- year cost to the city of 1, 027, 374, and authorize the Mayor to sign the grant agreement. Motion carried. 304  October 9, 2019 COUNCIL BILL 1909- 48 THIRD AND FINAL READING: AN ORDINANCE creating a Special Improvement Project, entitled " Water Main Replacement U," Fund 336, Program 003 Moved by Council Member Roberts, seconded by Council Member Murphy, that this is declared to be the third and final reading of Council Bill No. 1909- 48, and the City Clerk is directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Murphy, Vogeli, Bader, Stonecipher, and Tuohy NAYS: None EXCUSED: Moore Ordinance No. 3703- 19 adopted. COUNCIL BRIEFING AGENDA: Adopt Resolution to consider the use of Project Labor Agreements and Community Work Force Agreements for major constructions projects. Presented by Paul Kaftanski, Administration Council Member Murphy requested additional information about the potential impact on women- and minority- owned businesses by implementation of this requirement. Paul Kaftanski stated he would obtain this information and report back to the Council. Council Member Roberts stated he supports these approaches; however, he suggests the City communicate with the Snohomish County Labor Council and Sound Transit. He also suggested further conversation about the $ 5 million threshold and the impact on certain businesses when this threshold is not met. 305  October 9, 2019 Council Member Vogeli asked about the Council process. Mr. Kaftanski provided detailed information. Council Member Stonecipher inquired about private providers of apprenticeship programs that would meet the criteria. Mr. Kaftanski stated he would get information from staff and report back to Council. Council Member Murphy spoke about the report mentioned that suggested an increase of project costs is inconclusive. He expressed concern about increased costs and internal staffing. Sonja Forster, Associated General Contractors ( AGC) of Washington, stated the AGC is neutral on the topic of project labor agreements, and the AGC believes the decision to enter into a collective bargaining agreement should be left up to the contractor, employer, and their employees. She urged the Council to not advance the proposed resolution so the City can continue to offer fair and legal contracting opportunities for all businesses. Stacy Martin, Everett Local 292, stated project labor agreements add another layer to assist with finding responsible bidders. He suggested the City can add Disadvantaged Business Enterprise ( DBE) requirements that best suit the city of Everett. President Bader acknowledged a request by Cheryl Hensley to speak about a police matter. He stated that the time for public comment was closed, but he would be willing to discuss her concerns following the meeting.
