November 6, 2019 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., November 6, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Mayor Franklin was excused. Members of Boy Scout Troop 90 led the Pledge of Allegiance. The minutes of the October 30, 2019, City Council meeting were approved as printed. Council Member Stonecipher abstained from the vote. MAYOR Mayor Franklin was excused. COUNCIL Council Member Roberts congratulated Council Members Vogeli, Bader, Stonecipher, and Tuohy on their reelections. He also spoke about the passage of State Initiative 976 ( 1- 976) and what that will mean for future transit challenges. President Bader, in Mayor Franklin' s absence, asked for concurrence with appointments to the Everett Housing Authority Board. APPOINTMENTS Moved by Council Member Tuohy, seconded by Council Member Vogeli, to concur with the following appointments: Everett Housing Authority Board Appointment of Kevin Phan to Position 2 for a five- year term expiring October 6, 2024. 328  November 6, 2019 Appointment of Charles Burgess to Position 6 for a five- year term expiring October 6, 2024. Roll was called with all council members voting yes. Motion carried. ADMINISTRATION UPDATE ON PRIOR BUSINESS Nick Harper, Administration, had no report. CITY ATTORNEY City Attorney Hall had no report. PUBLIC COMMENT Jean Rittmann, Everett, spoke about a zoning code issue. President Bader asked Ms. Rittmann to discontinue her comments due to attacks on individual city employees rather than addressing the city as a whole. Sean Renfro, Everett, spoke about a Police Department issue. CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION - CLAIMS 329  November 6, 2019 To adopt Resolution No. 7446 authorizing claims against the City of Everett in the amount of $ 1, 805, 740. 42 for the period of October 19, 2019, through October 25, 2019. AGREEMENT— TARGET ZERO GRANT FUNDS To authorize the Mayor to sign all necessary documents and agreements with Traffic Safety Commission regarding utilization and acceptance of Target Zero Grant funds. JOB COMPLETE— WETMORE AVENUE STORMWATER BYPASS PROJECT To accept the Wetmore Avenue Stormwater Bypass Project with Interwest Construction Inc. as complete, and authorize the Mayor to sign the Certificate of Completion. AGREEMENT AMENDED — EVERPARK GARAGE STRUCTURAL REPAIRS PROJECT To authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with Reid Middleton to provide additional engineering services for the Everpark Garage Structural Repairs Project, in the form substantially provided. AGREEMENT— TEMPORARY CONSTRUCTION EASEMENT AT 4020 COLBY To authorize the Mayor to sign a Temporary Construction Easement Agreement with McDonald' s Corporation. AGREEMENT — TEMPORARY CONSTRUCTION EASEMENT AT 41ST AND COLBY To authorize the Mayor to sign a Temporary Construction Easement Agreement with Brust Development Co. PUBLIC HEARING: 2020 BUDGET President Bader announced that Public Hearing Items 7 and 8 would be presented together. He stated this is the second of three public hearings regarding the 2020 budget, which will remain open until the conclusion of the third and final reading and budget hearing on November 13, 2019. An overview of the 2020 budget was presented by Susy Haugen, Finance. Discussion ensued regarding the voluntary separation program, filling lateral hires in the Police Department, the Evergreen Branch Library opening, which is set for December 6 at 2 p. m. Discussion also included golf revenue, FTE reductions, federal permit compliance requirements in Public Works, and the effect that passage of 1- 976 would have on streets overlay funding. Council Member Murphy requested a list of what comprises the 3. 8 million in proposed expenditures for Fund 119 Streets Improvement. Council Member Roberts requested information about the current allocation for car tab fees, before the impact of the possible passage of 1- 976. Ms. Haugen stated she would provide the requested information to Council. COUNCIL BILL 1910- 52 SECOND READING: AN ORDINANCE adopting the budget for the City of Everett for the year 2020 in the amount of$ 649, 986, 342 331  November 6, 2019 There were no citizens who wished to speak. PUBLIC HEARING: VACATION — PORTION OF LOT 1, BLOCK 739, PLAT OF EVERETT LAND COMPANY' S FIRST ADDITION President Bader opened the public hearing and invited public comment. There were no citizens who wished to speak. Moved by Council Member Roberts, seconded by Council Member Stonecipher, to close the public hearing. Roll was called with all council members voting yes. Motion carried. Moved by Council Member Moore, seconded by Council Member Murphy, to approve the vacation of that portion of the east/ west alley adjacent to Lot 1, Block 739, Plat of Everett Land Company' s First Addition to Everett, and direct staff to prepare an ordinance subject to the conditions as contained in the staff report. ACTION ITEMS: RESOLUTION — EVERETT WOMAN' S BOOK CLUB 332  November 6, 2019 Moved by Council Member Tuohy, seconded by Council Member Stonecipher, to adopt joint Resolution No. 7447 recognizing the longevity and service of the Everett Woman' s Book Club. Roll was called with all council members voting yes. Motion carried. Council Vice President Tuohy presented the Resolution to members of the Everett Woman' s Book Club. Lauray Stupey, Everett Woman' s Book Club President, thanked Council for the honor and recognition. COUNCIL BRIEFING AGENDA: Community Transit— Transportation Network Vision le Presented by Emmett Heath and Roland Behee, Community Transit Council Member Tuohy left council chambers at 7: 42 and returned at 7: 43. Considerable discussion ensued regarding maintenance and operations, sales tax difference of funding Community Transit vs. Everett Transit, adding Everett to the Community Transit Public Transpiration Benefit Area and how this would be end up becoming a ballot measure, the unions within Community Transit and Everett Transit, paratransit services, and the structure of the Community Transit board. Paul Kaftanski, Administration, stated that staff will be presenting three policy options regarding Everett Transit at the next transit workshop. Christina Strand, Everett, spoke about Community Transit and connecting Everett to the rest of the county. Bryan Partington, Everett, spoke about Community Transit and the future of transit in Everett. 4 334 S November 6, 2019 Steve Oss, Everett, spoke about sales tax increases, paratransit services, and Swift bus operation by Community Transit. Victor Harris, Everett, spoke about electric busses in the Everett Transit fleet and paratransit services. JT Dray, Everett, spoke about other transportation options and the future of transit services. A Resolution establishing a fee waiver program as described in the attached resolution. Presented by Nick Harper, Administration Discussion ensued regarding where the city would be encouraging economic development, potentially establishing a sunset clause on this resolution, and revenue from these permit fees. Council Member Murphy asked for an approximate amount of what permit fee waivers would be for projects. Deputy Mayor Harper stated he would provide that to Council. PROPOSED ACTION ITEMS: COUNCIL BILL 1910- 53 SECOND READING: AN ORDINANCE amending Ordinance No. 3633- 18, entitled " Everett Municipal Building Window Replacement Project" ( formerly the Wall Street Building Window Replacement Project), Fund 342, Program 025, to accumulate the construction costs for the project in the amount of 535, 000 335  S.
