October 13, 2021 The regular meeting of the Everett City Council was called to order on Wednesday, October 13, at 6: 30 p. m., Council Member Murphy presiding. Council Member Murphy announced that the Council is still abiding by Governor Inslee' s Healthy Washington guidelines, and as a result, City Council meetings will continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. He stated the City Council is prepared to open the Council chambers when public health considerations indicate it is safe to do so. Council Member Murphy announced that citizens are encouraged to view meetings live on Comcast Channel 21, Frontier Channel 29, and on the City website at www.everettwa. gov/ citycouncil. Individuals may also call in to listen to the live meeting at any point by dialing 425. 616. 3920, Conference ID 724 887 726#. He stated the public is welcome to provide comments on any matter via email at council@everettwa. gov. He also provided instructions for community members wishing to participate live during a future meeting. He asked that comments be respectful, and remarks limited to three minutes. He added that the Council does not allow comments on certain issues such as: campaigning of any kind —whether for or against ballot measures or candidates running for office— is legally prohibited at the meeting, and comments focused on personal matters that are unrelated to City business. On behalf of the City council, Council Member Moore acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. Council Member Murphy led the Pledge of Allegiance. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Vogeli, and Bader were present. Mayor Franklin and Council Members Stonecipher and Tuohy were excused. MAYOR Mayor Franklin was excused. 1  October 13, 2021 COUNCIL Council Member Bader provided a liaison report from his attendance at the Snohomish Health District Board meeting. He encouraged everyone to get their COVID- 19 vaccination. Council Member Vogeli provided a liaison report from her attendance at the Westmont- Holly Neighborhood Association meeting last evening. She also noted she would not be available to attend the Lowell Neighborhood meeting next week and requested attendance by one of her colleagues. Council Member Vogeli requested Consent Item No. 6 be moved to Action Items to allow for discussion. She also spoke about the possibility of installing a speed bump on Norton Avenue and requested the Public Works Department provide information about the impacts for stalled cars or speeding drivers, and the feasibility of creating a one- way street that allows for south flow only. Council Member Roberts provided a liaison report from his meeting with Planning staff. He thanked staff for their work on Rethink Housing and for discussion about Comprehensive Plan and Baker Heights, as well as an update on the pallet shelter project. He also reported on his attendance, on behalf of Council Member Tuohy, at the Cultural Arts Commission meeting. He announced the Pacific Chamber Orchestra is planning a concert on December 5, and he requested that Tyler Chism provide information to all council members. Council Member Roberts also reported that he attended the Riverside Neighborhood Association meeting. Council Member Murphy commented on the Mayor' s budget address. He stated that he met with Mayor Franklin and President Stonecipher regarding the $ 20 million in American Rescue Plan ( ARP) funding. He requested the acceleration of a discussion by Council by two to three weeks regarding the use of ARP funds as part of the budget for 2022. ADMINISTRATION UPDATE In response to Council Member Murphy' s request, Deputy Mayor Nick Harper stated that he would coordinate a discussion among Administration, President Stonecipher, and Council Member Murphy regarding ARP funding. r 2  October 13, 2021 CITY ATTORNEY City Attorney David Hall had no comments. PUBLIC COMMENTS: Deb Williams, Council, stated the City received no written comments. Angela Di Filippo, Everett, commented on the importance of housing availability and affordably for all residents. APPROVAL OF MINUTES: The minutes of the October 6, 2021, City Council meeting were approved as printed. CONSENT ITEMS: At the request by Council Member Vogeli, Council Member Murphy moved Consent Item No. 6 to the Action agenda to allow for discussion. Moved by Council Member Bader, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7701 authorizing claims against the City of Everett in the amount of $ 1, 485, 814. 80 for the period of September 25, 2021, through October 1, 2021. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7702 authorizing payroll claims against the City of 3  October 13, 2021 Everett in the amount of $ 4, 254, 641. 10 for the period ending September 25, 2021. RESOLUTION — SURPLUS OF 2002 BL- Pegson X800X550 To adopt Resolution No. 7703 declaring a 2002 Terex BL- Pegson X800X550 M0048) surplus and authorizing sale to Powerscreen of Washington for a 50, 000 trade- in allowance towards the purchase of H0074 Rock Crusher. RFP # 2021- 020 AWARD— ROCK CRUSHER To award Request for Proposal # 2021- 020 Rock Crusher to Powerscreen of Washington in the amount of$ 488, 020 including Washington State sales tax. RESOLUTION — SURPLUS OF 2009 HONDA POLICE MOTORCYCLE To adopt Resolution No. 7704 declaring a 2009 Honda ST1300PA police motorcycle ( P0901) surplus and authorizing sale at public action. GRANT APPLICATION — RFP FOR LESS THAN LETHAL EQUIPMENT To authorize city staff to apply for and if awarded, authorize the Mayor to sign all necessary documents and agreements with the Washington State Department of Commerce regarding the application, acceptance, and utilization of the Request for Proposal for Less than Lethal Equipment in the amount of$ 50, 569. 00. MOVED TO ACTION ITEMS. GRANT APPLICATON — FY 2021 WASHINGTON STATE STOP FORMULA To authorize city staff to apply for and if awarded, authorize the Mayor to sign all necessary documents and agreements with the Washington State Department of Commerce regarding the application, acceptance, and utilization of the FY 2021 Washington State STOP Formula Grant in the amount of$ 32, 720. 4  October 13, 2021 AGREEMENT— TRAINING OF SOCIAL WORK STUDENTS To authorize the Mayor or her designee( s) to execute the Affiliation Agreement with University of Washington. AGREEMENT AMENDED— REIMBURSEMENT OF DEPLOYMENT COSTS To authorize the Mayor to sign the contract amendment authorizing the Washington Military Department to reimburse the city for deployment costs estimated at $ 118, 098. 60. AGREEMENT — JOB ORDER CONTRACTING FOR GENERAL CONSTRUCTION SERVICES To award Request for Proposal # 2021- 022 Job Order Contracting ( JOC) for General Construction Services to Forma Construction Company & Burton Construction, Inc for two years with one ( 1) bilateral option term of one year. RFP # 2021- 002— AUTOMATED PARKING MANAGEMENT SYSTEM To award Request for Proposal # 2021- 002 Automated Parking Management System to OSP US, Inc. dba Orbility for a two-year contract with three ( 3) one- year extension options in the amount of $ 255, 962. 66 including Washington State sales tax. AGREEMENT— SETTLEMENT To authorize the Mayor to sign the Settlement Agreement between the City of Everett and Michael E. Weaver and Amy Weaver. JOB COMPLETE— PHIL JOHNSON BALLFIELDS RENOVATION PROJECT To accept the construction of the Phil Johnson Ballfields Renovation Project as complete and authorize the Mayor to sign the Certificate of Completion with Premier Field Development, Inc. in the amount of$ 4, 041, 013. 04. 5  October 13, 2021 Roll was called with all council members voting yes, except Council Members Stonecipher and Tuohy who were excused. ACTION ITEMS: GRANT APPLICATION — RFP FOR LESS THAN LETHAL EQUIPMENT Moved by Council Member Roberts, seconded by Council Member Bader, to authorize city staff to apply for and if awarded, authorize the Mayor to sign all necessary documents and agreements with the Washington State Department of Commerce regarding the application, acceptance, and utilization of the Request for Proposal for Less than Lethal Equipment in the amount of 50, 569. 00. Council Member Vogeli commented on the wording in the Request for Proposal relating to the use of de- escalation tactics, including a description of special actions that would require less than lethal equipment. Police Chief Templeman responded to Council Member Vogeli' s questions regarding de- escalation training and situations that might require use of less than lethal equipment. Council Members expressed support for the challenging work performed by the Police Department and the need for additional equipment. Motion carried. 6  October 13, 2021 COUNCIL BILL 2109- 36 THIRD AND FINAL READING: AN ORDINANCE vacating a portion of Summit Avenue lying between 26th Street and the east- west alleys located south of 2601 Summit Avenue and 2614 Summit Avenue together with that portion of the east-west alley abutting 2601 Summit Avenue Moved by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and final reading of Council Bill No. 2109- 36. The City Clerk was directed to call the roll for the final disposition of the ordinance. RESOLUTION — 2022 HUMAN NEEDS PRIORITIES AND REALLOCATIONS Moved by Council Member Bader, seconded by Council Member Roberts, to adopt Resolution No. 7705 concerning 2022 Human Needs Priorities and reallocations of CDBG- CV Funds. Kembra Landry, Community Development, provided a brief overview on CDBG- CV funds, committed and uncommitted, awards, and total allocations. Motion carried. 7  October 13, 2021 COUNCIL BRIEFING AGENDA: COUNCIL BILL 2110- 37 FIRST READING: AN ORDINANCE approving the appropriations of the 2021 revised City of Everett Budget and amending Ordinance No. 3825- 21 Presented by Susy Haugen, Finance Finance Director Susy Haugen presented information on proposed 2021 Budget Amendment No. 3, including a breakdown of General Government and Non- General Government expenditures. Council Member Vogeli inquired about the status of the Washington State Department of Corrections work crew services. Susy stated she would bring the requested information back at a future date.
