February 16, 2022 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., February 15, 2022, by President Stonecipher. Upon roll call, it was found that Mayor Franklin and Council Members Tuohy, Vogeli, Rhyne, Schwab, Zarlingo, Fosse, and President Stonecipher were present. Council Member Tuohy led the Pledge of Allegiance. On behalf of the City Council, Council Member Zarlingo acknowledged the original inhabitants of this place, the sduhub people and their successors, the Tulalip Tribes. APPROVAL OF MINUTES The minutes of January 28, 2022, were approved as printed. The minutes of February 9, 2022, were approved as printed, except Council Member Vogeli and President Stonecipher, who abstained. MAYOR Mayor Franklin had no comments. COUNCIL Council Member Vogeli mentioned a Resolution regarding Project Labor Agreements ( PLAs), which includes a threshold of $5M to be considered for city projects. She stated that with ARPA and Infrastructure funds coming soon, she wants more city projects to be able to employ workers that receive guaranteed living wages and benefits and provide apprenticeship programs to train individuals for future projects. She requested that the Legal department draft an ordinance to lower the Project Labor Agreements ( PLA) threshold to $ 1M and include language for either an apprenticeship program or a community workforce agreement ( CWA). 1 February 16, 2022 Moved by Council Member Vogeli, seconded by Council Member Fosse, to request the legal department draft an ordinance to lower the Project Labor Agreements ( PLA) threshold to $ 1M and add language for an apprenticeship program or a community workforce agreement, to bring to Council for consideration. City Attorney David Hall stated he would work with Council Member Vogeli to draft the Ordinance to bring to Council for consideration. President Stonecipher asked for a briefing on the previous resolution and the process for determining whether a project should be considered for a project labor agreement. Comments and liaison reports were provided by Council Members Tuohy, Rhyne, Schwab, Zarlingo, Fosse, and President Stonecipher. ADMINISTRATION UPDATE ON PRIOR BUSINESS Deputy Mayor Nick Harper had no updates. CITY ATTORNEY City Attorney David Hall notified Council that Legal is working with Administration on revising the Council Procedures per direction from the Council Retreat and will bring it to Council for discussion at a future date. He also stated that there was no executive session. PUBLIC COMMENT Deb Williams stated the Council received no written comments or anyone wishing to speak. CONSENT ITEMS: Moved by Council Member Rhyne, seconded by Council Member Schwab, to approve the following consent items: RESOLUTION - CLAIMS 2 February 16, 2022 To adopt Resolution No. 7743 authorizing claims against the City of Everett in the amount of $ 1, 572, 092. 71 for the period of January 29, 2022, through February 4, 2022. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7744 authorizing payroll claims against the City of Everett in the amount of $ 4, 414, 796. 53 for the period of January 29, 2022, through February 4, 2022. PURCHASE — JOHN DEERE EXCAVATOR To award and authorize the purchase of one John Deere 135G Hydraulic Excavator from Sourcewell, Contract # 032119 — JDC/ EVT # 2020- 002 for 259, 204.20, including Washington State Sales Tax. PURCHASE— VACTOR SUCTION TRUCK To award and authorize the purchase of one Peterbilt 567, 15- yard Vactor suction truck to Owen Equipment Company from Washington State Department of Enterprise Services, Contract # 00120/ EVT # 2021- 024 for $ 614, 491. 47, including Washington State Sales Tax. BID AWARD —2022 BIOSOLIDS REMOVAL AND DISPOSAL To award and authorize the Mayor to sign the contract with American Process Group, LLC for 2022 Biosolids Removal and Disposal. GRANT AGREEMENT- ASPCA To authorize City staff to apply for, and if granted, receive and authorize the Mayor to sign all necessary documents and agreement with the ASPCA regarding the application, acceptance, and use of the ASPCA Grant for $58, 000. AGREEMENT— EMPOWER 457 ( B) PLAN 3 February 16, 2022 To authorize the Mayor to sign the updated City of Everett Empower 457( b) Plan documents and Administrative Services Agreement. Roll was called with all council members voting yes. Motion carried. PROPOSED ACTION ITEMS: COUNCIL BILL 2202- 02 SECOND READING: AN ORDINANCE amending and closing the Special Construction Fund entitled " Everett Fire Administration Building Tenant Improvements Project,"Fund 342, Program 027, as established by Ordinance No. 3661- 19, and amended by Ordinance 3764- 20. COUNCIL BILL 2202- 03 SECOND READING: AN ORDINANCE closing a Special Improvement Project entitled " Phil Johnson Ballfields Renovation," Fund 354, Program 054, as established by Ordinance No. 3589- 18, and amended by Ordinance No. 3677- 19. PUBLIC HEARING: PUBLIC HEARING — RESOLUTION ADOPTING THE 2022 PARKS, RECREATION, AND OPEN SPACE ( PROS) PLAN President Stonecipher opened the Public Hearing regarding the 2022 Parks, Recreation, and Open Space ( PROS) Plan. 4 February 16, 2022 There were no members from the public who wished to speak. Discussion followed among Council Members Tuohy, Vogeli, Rhyne, Schwab, Zarlingo, Fosse, and President Stonecipher. Moved by Council Member Tuohy, seconded by Council Member Vogeli, to close the public hearing. Roll was called with all council members voting yes. Motion carried. Moved by Council Member Vogeli, seconded by Council Member Tuohy, to adopt Resolution No. 7745 adopting the 2022 Parks, Recreation, and Open Space ( PROS) Plan. Roll was called with all council members voting yes. Motion carried. COUNCIL BRIEFING AGENDA: American Rescue Plan ( ARPA) Proposed Investments Update Presented by: Deputy City Mayor Nick Harper, and Community Development Director Julie Willie Discussion followed among Council Members Tuohy, Vogeli, Rhyne, Schwab, Zarlingo, Fosse, and President Stonecipher.
