City of Excelsior City Council Meeting MINUTES Monday, December 2, 2019 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 p.m. 2. ROLL CALL City Council: Councilmembers Caron, Dierking, Kurschner, Miller and Mayor Carlson Absent: None Also Present: Interim City Manager Wisdorf, City Attorney Staunton, Public Works Superintendent Amundsen, City Planner Becker, Event Planner Edwards, Finance Director Horn and City Clerk Peterson 3. APPROVAL OF MINUTES (a) November 18, 2019 Work Session Minutes Dierking moved, Caron seconded, to approve the November 18, 2019 Work Session Minutes. Motion carried 5/0. (b) November 18, 2019 City Council Minutes Caron moved, Dierking seconded, to approve the November 18, 2019 City Council Minutes. Motion carried 5/0. 4. OPEN FORUM Bob and Joan Piche, 723 Water Street, addressed the City Council regarding clarification of the snow clearing policy for the downtown business district and sidewalks throughout the community. Ross McGlasson, 723 Water Street, addressed the City Council regarding preserving the Minnehaha. Minutes City Council December 2, 2019 Page 2 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior Elementary School Report on Possible Solution for the Flooding in the Excelsior Commons The Excelsior Elementary 4th and 5th Grade Lego Robotics Team presented on raingardens as a possible solution for the flooding in the Excelsior Commons. (b) Ice Rinks in The Commons Update Amundsen provided an update on the progress of the ice rinks at The Commons. Rhoda Brooks, 723 Water Street, addressed the City Council regarding the ice rinks at The Commons. (c) Excelsior Fire District Update Miller provided an update of the Excelsior Fire District. (d) Project Advisory Committee for the Band Shell Caron provided an update on the Project Advisory Committee for the Band Shell. (e) Christkindlsmarkt Mayor Carlson thanked the City crews, organizers and everyone involved with Christkindlsmarkt. 6. MEET EXCELSIOR Pei-Lin, Something Safari, 310 Water Street, addressed the City Council. 7. AGENDA APPROVAL (a) Meeting Agenda Caron moved, Kurschner seconded, to approve the December 2, 2019 Meeting Agenda continuing item 12(a) 287/289 Water Street Conditional Use Permits to the December 16, 2019 meeting and adding new business item 13(a) Process for LMCD Appointment. Motion carried 5/0. (b) Consent Agenda Caron moved, Dierking seconded, to approve the Consent Agenda for December 2, 2019. Motion carried 5/0. Minutes City Council December 2, 2019 Page 3 1. Approve Verified Claims – Approve for Payment Manual Checks 085908 – 085956 Action - Approved for payment manual checks 085908 - 085956. 2. Approve 2020-2022 Teamsters’ Union Contract Action – Approved the 2020-2022 Labor Agreement between the City of Excelsior and Teamsters Local 320. 3. St. Alban’s Bay Lake Improvement District – Joint Cooperation Agreement Action – Approved the St. Alban’s Bay Lake Improvement District Cooperation Agreement IV, the 2020 budget and authorized the Mayor and City Manager to sign the Agreement. 4. November Building Permit Report Action – Accepted the November Building Permit Report. 5. September and October Financial Report Action – Accepted the September and October Financial Report for filing. 8. PUBLIC HEARING (a) Presentation of 2020 Budget and 2019 Property Tax Collectible in 2020 and Acceptance of Public Comments Mayor Carlson opened the public hearing at 7:42 p.m. Ross McGlasson, 723 Water Street, addressed the City Council with questions regarding The Waters TIF District. Terry Rossi, 182 George Street, addressed the City Council with questions regarding The Waters TIF District. Hearing no further comments, Mayor Carlson closed the public hearing at 7:52 p.m. Caron moved, Kurschner seconded to add item 13(b) Schedule Special Meeting to Approve the 2020 Budget to the agenda. Motion carried 5/0. (b) 181 George Street Variance Requests Mayor Carlson opened the public hearing at 8:01 p.m. Mayor Carlson referenced letters received from Brenda Gauvin- Chadwick, Jim Agre and Jonathan Sandberg. Minutes City Council December 2, 2019 Page 4 Hearing no additional comments from the public, Mayor Carlson closed the public hearing at 8:02 p.m. Caron moved, Miller seconded, to adopt Resolution 2019-57 approving variance requests from the required rear yard setback and maximum impervious surface for the property located at 181 George Street with the addition of Number 5 to the Conclusions: The lot adjoins the Hennepin County Regional Trail, so the mass and scale does not impact adjacent property owners in the rear of the property. Motion carried 5/0. 9. PETITIONS, REQUEST and COMMUNICATIONS (a) None. 10. ORDINANCES AND RESOLUTIONS (a) Second Reading of Amendments to Special Events Permit Ordinance Eric Snyder, 25 Center Street, representing Community for The Commons, addressed the City Council. Staunton and Edwards will work on suggested changes to the ordinance, route to the Park and Recreation Commission and Community for The Commons for their review and comments and bring back to the January 6, 2020 Council meeting for the second reading. 11. REPORTS OF OFFICERS, BOARDS, and COMMITTEES (a) None. 12. UNFINISHED BUSINESS (a) 287/289 Water Street Conditional Use Permits for Parking Impact Fee and Two Principal Buildings on a Base Lot Requests This item was continued to the December 16 Council meeting. (b) Approve Fundraising Agreement with Community for The Commons to Facilitate Fundraising and Financing of Phase One of the Implementation of The Commons Master Plan Eric Snyder, 25 Center Street, representing Community for The Commons, addressed the City Council. Minutes City Council December 2, 2019 Page 5 Caron moved, Miller seconded, to approve the Fundraising Agreement with Community for The Commons to Facilitate Fundraising and Financing of Phase One of the Implementation of The Commons Master Plan. Motion carried 5/0. (c) Deadlines for Eastside Subarea Plan; Historic Preservation Ordinance Designation of Homes and Review of Goals for All Commissions Becker reported the Planning Commission is reviewing the Eastside Subarea Plan at their December 23 meeting. This will be brought to the Council for review in February. Becker reported the Heritage Preservation Commission will be discussing the HPC Ordinance Designation of Homes at their December meeting. Becker reported the Council meets with all City Commissions in late spring/early summer to review goals. Mayor Carlson will work with staff to bring forward a timeline at the December 16 meeting. 13. NEW BUSINESS (a) Timeline for Appointment to LMCD Councilmember Caron volunteered to conduct the interview for the one applicant for the LMCD vacancy. (b) Set Special Meeting to approve Budget Caron moved, Kurschner seconded to set a Special Meeting for December 20, 2019 at 8 a.m. Motion carried 5/0. 14.
