City of Excelsior Regular Council Meeting MINUTES Monday, October 18, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:40 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Manager Luger, Public Works Superintendent Amundsen, City Engineer Dawley, Community Development Director Mullin, Planning Consultant Richards, City Attorney Staunton, and City Clerk Williams 3. APPROVAL OF MINUTES (a) October 4, 2021 City Council Work Session Minutes (b) October 4, 2021 City Council Minutes (c) October 11, 2021 Special Work Session Minutes Hersman moved, Kurschner seconded, to approve the October 4, 2021 City Council Work Session Minutes, October 4, 2021 City Council Minutes, and October 11, 2021 Special Work Session Minutes. Motion carried 4/0 for the approval of the October 4, 2021 Work Session and Council Minutes. Mayor Carlson abstained his vote. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about the gazebo at the Port of Excelsior. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update No update. (b) Construction Updates Tim Amundsen, Public Works Superintendent, gave an update on current construction projects. (c) South Lake Minnetonka Police Department Coordinating Committee Meeting Mayor Carlson gave an update on the South Lake Minnetonka Police Department Coordinating Committee Meeting. 6. MEET EXCELSIOR (a) Representative Kelly Morrison Representative Kelly Morrison was not in attendance at the meeting. 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Caron seconded, to approve the October 18, 2021 Meeting Agenda with the amendment of Parking Permits to Item 9(a) and addition of Item 11(b). Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. September Building Permit Report Action – Accepted September Building Permit Report. 3. Resolution 2021-64 Imposing Temporary Parking Restrictions Halloween Parade Action – Adopted Resolution 2021-64 Imposing Temporary Parking Restrictions Halloween Parade. 4. Expanding the Permitted Use of Sick Leave Action – Approved allowing employees to use sick leave for the qualifying reasons that were identified under the emergency paid sick leave act. 5. Resolution 2021-65 Designating Annual Polling Place Action – Adopted Resolution 2021-65 Designating Annual Polling Place. 6. PUBLIC HEARINGS (a) Resolution Adopting Assessment Roll for 2020 Street & Utility Improvements Project Peter Hartwich, 186 George Street, addressed the Council about the option to waive an assessment. Hersman moved, Dierking seconded, to adopt Resolution 2021 – 68 Resolution Adopting the Assessment Roll for the 2020 Street & Utility Improvements Project. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS Minutes City Council Meeting Monday, October 18, 2021 Page 5 (a) Parking Permits and Review of Paid Parking Trial The Council agreed to increase resident parking permits to $20 per permit, increase business parking permits to $150 per permit, and to keep non-resident parking permits at $225. Erin Martin, 212 Water Street, addressed the Council about the enforcement of parking. Caron moved, Hersman seconded, to convert the parking trial on Second and Third Street to a permanent paid parking system, install permanent parking signs, directed staff to work on parking enforcement. Motion carried 3/2. Mayor Carlson and Councilmember Kurschner voted no. Caron moved, Dierking seconded, to authorize staff to develop an analysis of Downtown parking considering potential revenues, costs, better enforcement, business engagement, and compliance. Motion carried 5/0. The Council directed staff to bring back the parking kiosk placements with the parking analysis to a future meeting. (c) Remote Attendance at Meetings of City Council and Commissions The Council provided staff with direction to get feedback from the Commissions on this topic. 10. ORDINANCES and RESOLUTIONS (a) Commercial District Ordinance Amendment Dierking moved, Caron seconded, to waive first reading and schedule the second reading for the November 15, 2021 Council Meeting with direction provided to staff. Motion carried 5/0. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES Minutes City Council Meeting Monday, October 18, 2021 Page 6 (a) Accept Resignation and Declare Vacancy on City Commission Kurschner moved, Dierking seconded, to accept Mark Stang’s resignation and appoint Councilmember Hersman to conduct interviews. Motion carried 5/0. (b) Heritage Preservation Commission Vacancy (Amended) Kurschner moved, Dierking seconded, to advertise the vacancy until November 4, 2021 and appoint Mayor Carlson to conduct interviews. Motion carried 5/0. 12. UNFINISHED BUSINESS (a) Beach Safety The Council provided staff with direction and will continue the lifeguard discussion at an upcoming meeting. 13. NEW BUSINESS (a) None 14.
