City of Excelsior Regular Council Meeting MINUTES Monday, August 1, 2022 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:41 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Manager Luger, Public Works Superintendent Amundsen, City Engineer Dawley, Community Development Director Mullin, Assistant City Manager/City Attorney Staunton, and City Clerk Williams 3. APPROVAL OF MINUTES (a) July 18, 2022 City Council Work Session Minutes (b) July 18, 2022 City Council Minutes (c) July 18, 2022 City Council Closed Session Minutes Dierking moved, Hersman seconded, to approve the July 18, 2022 City Council Work Session Minutes, July 18, 2022 City Council Minutes, and July 18, 2022 City Council Closed Session Minutes. Motion carried 5/0. 4. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about moratoriums, software, City Hall, and the Planning Commission. Minutes City Council Meeting Monday, August 1, 2022 Page 2 Bruce Kelly, 165 Maple Street, addressed the Council about 339 Third Street. Dan Johnson, 240 Third Street, addressed the Council about 429 Second Street and cottage commercial structures. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update Tiffany King, Excelsior-Lake Minnetonka Chamber of Commerce, gave an update on upcoming events. (b) Mill Street Trail Project Chad Ellis and Tim Brewer, Hennepin County, gave a presentation on the Mill Street Trail Project. Bruce and Linda Lorentson, 401 Mill Street, addressed the Council. (c) Parks and Recreation Commission Update Tim Amundsen, Public Works Superintendent, gave an update on the Parks and Recreation Commission. (d) Concession/Plaza Project Update Tim Amundsen, Public Works Superintendent, and Morgan Dawley, City Engineer, gave an update on the Concession/Plaza Project. (e) Construction Update Tim Amundsen, Public Works Superintendent, gave an update on construction. (f) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District. Minutes City Council Meeting Monday, August 1, 2022 Page 3 (g) South Lake Minnetonka Police Department Update Mayor Carlson gave an update on the South Lake Minnetonka Police Department. (h) Night to Unite – August 2nd Mayor Carlson stated that Night to Unite is on August 2nd. (i) 339 Third Street Update No Update. (j) Apple Day Volunteers Councilmember Kurschner offered to volunteer for the Apple Day Events. (k) Elections City Clerk Williams gave an update on the Primary Election and the Candidate Filing Period. (l) Mayor Updates Mayor Carlson gave an update on parking for local businesses. 6. MEET EXCELSIOR (a) Mark Kroll, Lake Minnetonka Conservation District Representative Mark Kroll, Lake Minnetonka Conversation District Representative (LMCD), gave an update on the current issues on Lake Minnetonka. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded, to approve the August 1, 2022 Meeting Agenda with the change to continue Item 13(a) to the August 15, 2022 City Council meeting and the addition of Item 13(c). (b) Consent Agenda Dierking moved, Hersman seconded, to approve Items 7(b) 1,2,4,5, and 6 and pull Item 7(b)3 for discussion. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Approve June Building Permit Report Action – Approved June Building Permit Report. 3. Waive Second Reading and Approve Zoning Amendments Ordinance No. 638 Caron moved, Hersman seconded, to waive the second reading and approve Zoning Amendments Ordinance No. 638. Motion carried 4/1. Councilmember Kurschner voted no. 4. Approve June 2022 Financials Action – Approved June 2022 Financials. Minutes City Council Meeting Monday, August 1, 2022 Page 5 5. Acknowledge 10% Quarterly Gambling Donations Second Quarter 2022 Action – Acknowledged 10% Quarterly Gambling Donations Second Quarter 2022. 6. Approve July Building Permit Report Action – Approved July Building Permit Report. 8. PUBLIC HEARINGS (a) 678 Pleasant Street Variance Amendment Mark and Kari Knapp, 678 Pleasant Street, Applicants, addressed the Council. Kurschner moved, Hersman seconded, to bring the 678 Pleasant Street Variance Amendment back to the Planning Commission for further review. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Excelsior Flats PUD Application 690 Excelsior Boulevard Bob Sarna, 1397 Orono Lane, Applicant, addressed the Council. Mike Sharratt, 464 Second Street, Architect, addressed the Council. Dierking moved, Kurschner seconded, to adopt Resolution 2022-33 Approving the Preliminary Plan for a Planned Unit Development (PUD) for Excelsior Flats located at 690 Excelsior Boulevard replacing the previous approval made at the June 20, 2022 City Council meeting and with the updates to the findings, conditions, and whereas clause as discussed. Motion carried 4/1. Councilmember Hersman voted no. (b) Excelsior Bay Hotel, 10 Water Street Sketch Plan Review Councilmember Kurschner recused himself. Minutes City Council Meeting Monday, August 1, 2022 Page 6 Dale Kurschner, 221 Third Street, Applicant, gave a presentation. Ethan Bartos, TKWA, Architect, gave a presentation. The Council provided feedback to the applicant. Councilmember Kurschner rejoined the meeting. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) 106 Center Street Proposals Continued to the August 15, 2022 City Council Meeting. (b) Set Date for General Election Canvassing Board Hersman moved, Dierking seconded, to set the General Election Canvassing Board Meeting to Thursday, November 17th in the afternoon. Motion carried 5/0. (c) Wake Boats The Council provided staff with direction. Minutes City Council Meeting Monday, August 1, 2022 Page 7 14.
