City of Excelsior City Council Closed Session I MINUTES Monday, August 15, 2022 5:30 P.M. 1. CALL TO ORDER/ROLL CALL Acting Mayor Caron called the meeting to order at 5:32 P.M. City Council: Acting Mayor Caron and Councilmembers Hersman and Kurschner Absent: Mayor Carlson and Councilmember Dierking Also Present: City Manager Luger and Assistant City Manager/City Attorney Staunton 2. AGENDA APPROVAL Kurschner moved, Hersman seconded, to approve the August 15, 2022 City Council Closed Session Agenda. Motion carried 3/0. 3. MOTION TO CLOSE THE MEETING PURSUANT TO MINN. STAT. § 13D.05, SUBD. 3(B) Kurschner moved, Hersman seconded, to close the meeting pursuant to Minn. Stat. § 13d.05, subd. 3(b) to consult with legal counsel regarding pending litigation, David Miller v. City of Excelsior. Motion carried 3/0. 4. CLOSED SESSION TO CONSULT WITH LEGAL COUNSEL REGARDING PENDING LITIGATION, DAVID MILLER V. CITY OF EXCELSIOR 5. MOTION TO RETURN TO OPEN SESSION Kurschner moved, Hersman seconded, to return to open session. Motion carried 3/0.  Minutes City Council Closed Session I Monday, August 15, 2022 Page 2 6.
