1. CALL TO ORDER
Acting Mayor Caron called the meeting to order at 6:35 P.M.
2. ROLL CALL
City Council: Acting Mayor Caron and Councilmembers Dierking and
Hersman
Absent: Mayor Carlson and Councilmember Kurschner
Also Present: Public Works Amundsen, City Engineer Dawley, Finance
Director Palmer, Assistant City Manager/City Attorney

Hersman moved, Dierking seconded, to approve the September 6, 2022 City Council
Work Session Minutes and September 6, 2022 City Council Minutes. Motion carried
3/0.

Peter Hartwich, 186 George Street, addressed the Council about 106 Center Street.

Tim Amundsen, Public Works Superintendent, gave an update on the Parks and
Recreation Commission.
(b) Concession/Plaza Project Update
Tim Amundsen, Public Works Superintendent, gave an update on the
Concession/Plaza Project.
(c) Construction Update
Tim Amundsen, Public Works Superintendent, and City Engineer, Morgan Dawley,
gave an update on construction.
(d) Fall Clean-Up October 29th
Fall Clean-Up is scheduled for October 29th.

Jim Flattum, Excelsior Lions Club, addressed the Council.

Agenda. Motion carried 3/0.

Dierking moved, Hersman seconded, to approve Items 7(b) 1,2,4,6,7, and 8. Motion

2. First Reading of Ordinance No. 641 - 106 Center Street Landmark
Designation
Action – Waived first reading of Ordinance No. 641 – 106 Center Street
Landmark Designation and scheduled second reading and adoption for the
October 3, 2022 City Council meeting.
3. Second Reading and Adoption of Ordinance No. 640 - Repeal of Chapter
1306
Dierking moved, Hersman seconded, to waive the second reading and adopt
Ordinance No. 640- Repeal of Chapter 1306 with the changes as discussed.
Motion carried 3/0.
4. Scheduling a Public Hearing Creation of a TIF District at 339 Third Street
Action – Adopted Resolution 2022-40 Scheduling a Public Hearing for
November 7, 2022 to consider the creation of a TIF District at 339 Third
Street.
5. Resolution 2022-37 Approving Variance Amendment for Garage 678
Pleasant Street
Action – Hersman moved, Dierking seconded, to continue this item to the
October 3, 2022 City Council meeting. Motion carried 3/0.
6. Approve Pay Voucher No. 6 East Parking Lot Improvements Project

8. PUBLIC HEARINGS
(a) Assessment Hearing for Unpaid Utilities and Other Charges
Peter Hartwich, 186 George Street, addressed the Council about notification and a
payment schedule.
Hersman moved, Dierking seconded, to adopt Resolution 2022-38 Resolution
Levying Assessments for costs incurred by the City for delinquent utilities and other
charges. Motion carried 3/0.
9. PETITIONS, REQUESTS and COMMUNICATIONS
(a) Oak Street/Water Street Gateway
Diane Bolles, 229 George Street, addressed the Council.
Greg Thomas, Excelsior Men’s Garden Club, addressed the Council.
Bob Bolles, 229 George Street, addressed the Council.
Bruce Kelly, 165 Maple Street, addressed the Council.
Dierking moved, Hersman seconded, to continue this item to the October 17, 2022
City Council meeting with a plan and budget submitted for discussion. Motion
carried 2/1. Acting Mayor Caron voted no.

(b) Duffy Boat 2022 Recap and 2023 Proposal
Ryan Lloyd & Ryan Jaeger gave a presentation.
The Council provided staff with direction to update the lease and to bring back the
updated lease to a future council meeting.
(c) Rotary Concert Agreement
The Council provided staff with direction.
(d) Highway 7 Road Safety Audit Results and Recommendations
Derek Leuer, MnDOT, gave a presentation.

The Council provided staff with direction.
