City of Excelsior Regular Council Meeting MINUTES Tuesday, January 17, 2023 6:30 P.M. OATH – ANNE MARK Mayor Carlson administered the Oath of Office to Anne Mark. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:37 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Dierking, Hersman, and Tyler Absent: Councilmember Caron Also Present: City Manager Luger, Public Works Superintendent Amundsen, City Engineer Dawley, City Attorney/Assistant City Manager Staunton, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) January 9, 2023 City Council Closed Session Minutes Dierking moved, Hersman seconded, to approve the January 9, 2023 City Council Closed Session Minutes. Motion carried 4/0. 4. OPEN FORUM Bob Bolles, 229 George Street, addressed the Council about City Hall and the proposed redevelopment at 339 Third Street. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update Tiffany King, Excelsior-Lake Minnetonka Chamber of Commerce, gave an update on upcoming events. (b) South Lake Minnetonka Police Department Update Mayor Carlson gave an update on the South Lake Minnetonka Police Department Coordinating Committee Meeting. (c) City Hall Closed January 23-26 for Moving Administrative Services Director, Nalisha Williams, gave an update on City Hall Closing January 23-26. (d) Upcoming Council Meeting – February 6, 2023 at 339 Third Street City Manager, Kristi Luger, gave an update on the February 6, 2023 City Council Meeting location. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Tyler seconded, to approve the January 17, 2023 Meeting Agenda. Motion carried 4/0. (b) Consent Agenda Hersman moved, Dierking seconded, to approve Items 7(b)1,2,3, and 5, and pull Item 7(b)4 for discussion. Motion carried 4/0. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. 2023 Pay Equity Report Action – Approved the Pay Equity Report and Directed Staff to Submit the Report to the Minnesota Management and Budget Department. 3. Resolution 2023-07 Redevelopment Grant Program Action – Adopted Resolution 2023-07 Resolution Approving an Application to the Minnesota Department of Employment and Economic Development Redevelopment Grant Program. 4. Resolution 2023-06 Ratifying Approval of Purchase Agreement 339 Third Street Dierking moved, Hersman seconded, to adopt Resolution 2023-06 Ratifying Approval of Purchase Agreement 339 Third Street. Motion carried 3/1. Mayor Carlson voted no. 5. Continue Second Reading of Ordinance No. 647 (Food Truck Licensing) Action – Continued Second Reading of Ordinance No. 647 to the February 21, 2023 City Council Meeting. 8. PUBLIC HEARINGS (a) Resolution 2023-05 Granting On Sale Wine and Intoxicating Malt License 234 Water Street Tyler Nelson, Applicant, 234 Water Street, addressed the Council. Minutes City Council Meeting Tuesday, January 17, 2023 Page 4 Hersman moved, Dierking seconded, to adopt Resolution 2023-05 Grant On Sale Wine and Intoxicating Malt License 234 Water Street with the changes as discussed. Motion carried 4/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Change Order #2 The Commons Concessions Tyler moved, Hersman seconded, to continue this item to the February 2, 2023 Special City Council Meeting. Motion carried 4/0. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) LMCD Board Appointment Hersman moved, Dierking seconded, to accept recommendation from the Interview Committee and appoint Mark Kroll to the Lake Minnesota Conservation District Board. Motion carried 4/0. 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) Settlement of Miller v. City of Excelsior Dierking moved, Hersman seconded, to Approve the Settlement Agreement and Authorize the Mayor, City Manager, and City Attorney to execute any documents necessary to complete the settlement. Motion carried 4/0. Minutes City Council Meeting Tuesday, January 17, 2023 Page 5 (b) Schedule Special Work Session Hersman moved, Tyler seconded, to schedule a Special City Council Meeting on February 2, 2023 at 6:00 P.M.
