City of Excelsior Regular Council Meeting Agenda Monday, May 1, 2023 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Tyler Absent: None Also Present: City Manger Luger, City Attorney/Assistant City Manager Staunton, Community Development Director Mullin, City Architect Larson, and Public Works Director Tim Amundsen 3. APPROVAL OF MINUTES (a) April 17, 2023 Work Session Minutes Caron moved, Hersman seconded, to approve the April 17, 2023 City Council Work Session Minutes. Motion carried 5/0. 4. OPEN FORUM None 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Ironmark, gave an update on the 339 Third Street construction. John Bradford, WSB, gave an update on the 339 Third Street project funds. Dan Johnson, Red Leaf Partners, gave an update on the parcel at 300 Water Street and the interim use permit. (b) Excelsior-Lake Minnetonka Chamber of Commerce Update No report. (c) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District. (d) Odd/Even Watering Restrictions to begin May 1 Mayor Carlson reminded residents that Odd/Even Watering Restrictions start May 1. (e) No Mow May Mayor Carlson reminded residents that No Mow May starts May 1 and that it is a voluntary program. (f) Spring Clean Up – May 20 Mayor Carlson gave an update on Spring Clean Up on Saturday, May 20, 2023. 6. MEET EXCELSIOR None 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Tyler seconded, to approve the May 1, 2023, Meeting Agenda with the removal of Item 8(a). Motion carried 5/0. (b) Consent Agenda Tyler moved, Dierking seconded, to approve Items 7(b)2, 3, 5, 6, 7, and 8. Motion Carried 5/0. 1. March 2023 Financials Caron moved, Tyler seconded, to continue March 2023 Financials to the May 15 City Council meeting. Agenda City Council Meeting Monday, May 1, 2023 Page 2 2. Concessions Change Order No. 5 – Ballfield Stairs Work Action - Approved Change Order No. 5. 3. Approve 2023 Business License Action - Approved 2023 Business License. 4. Second Reading and Adoption of Ordinance No. 648 Dierking moved, Caron seconded, to approve the Second Reading and Adopt Ordinance No. 648. Motion carried 2/3. Councilmembers Hersman and Tyler voted no. 5. April Building Permit Report Action - Accepted April Building Permit Report. 6. Lake Street Watermain Replacement Action - Accepted Lake Street Watermain Replacement Update. 7. Approve Pay Voucher No. 1 Excelsior Blvd Lift Station Rehabilitation Action - Approved Pay Voucher No. 1 Excelsior Blvd Lift Station Rehabilitation. 8. First Quarter Gambling Report Action - Accepted First Quarter Gambling Report. 8. PUBLIC HEARINGS (a) 163 Second Street, Residential Review Permit Applications Item removed. (b) 254 Lake Street, Residential Review Permit Application Peter Eskuche, Eskuche Design Group, addressed the Council. Troy Mathwig, Applicant, addressed the Council. Dierking moved, Hersman seconded, to approve the 163 Second Street Residential Review Permit. Motion carried 3/2. Councilmembers Caron and Tyler voted no. (c) 541 William Street, Residential Review Permit and Variance Applications Renee and Jeff Pietzrak, Applicant, addressed the Council. Diane Bolles, 229 George Street, addressed the Council with concerns about the project. Dierking moved, Hersman seconded, to approve the 541 William Street Residential Review Permit. Motion carried 4/1. Councilmember Caron voted no. Tyler moved, Dierking seconded, to approve the 541 William Street Variance Application. Motion carried 4/1. Councilmember Caron voted no. 9. PETITIONS, REQUESTS and COMMUNICATIONS None 10. ORDINANCES and RESOLUTIONS None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Proposal for Baseball Storage at The Commons Ballpark Dierking moved, Hersman seconded, to approve Option 2 for Baseball Storage at the Commons Ballpark. Motion carried 5/0. (b) Fencing Plan and Options for the Oak Savanna Project Hersman moved, Caron seconded, to approve fencing three areas with wood post and rope rails and planting native seeding or sedge meadow. UNFINISHED BUSINESS (a) 2023 City of Excelsior Objectives Dierking moved, Hersman seconded, to continue the 2023 City of Excelsior Objectives to the June 5, 2023, City Council meeting. 13.
