Regular Council Meeting MINUTES Monday, February 5, 2024 Trinity Episcopal Church - 322 Second Street, Excelsior, MN 55331 6:30 P.M. 1. CALL TO ORDER Maryor Carlson called the meeting to order at 6:32 P.M. 2. ROLL CALL City Council: Mayor Carlson, Councilmembers Caron, Dierking and Hersman. Absent: Councilmember Tyler, City Manager Luger Also Present: City Attorney/Assistant City Manager Staunton, Community Development Director Mullin, and Administrative Services Director Williams. 3. APPROVAL OF MINUTES (a) January 22, 2024 Work Session Minutes Caron moved, Hersman seconded, to approve the January 22, 2024 Work Session Minutes. Mayor Carlson abstained. Motion carried 3/0. John Bradford, WSB, gave an update on the 339 Third Street project. (b) Planning Commission Update Julia Mullin, Community Development Director, gave an update on the Planning Commission. (c) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District. (d) 2024 Elections Nalisha Williams, Administrative Services Director, gave an update on the 2024 elections. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded, to approve the February 5, 2024 Meeting Agenda. Motion carried 4/0. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. Ordinance No. 665 Amending Chapter 26 for Employee Earned Sick and Safe Time Action – Waived the second reading and adopted Ordinance No. 665 and approved summary Resolution No. 2024-02 Resolution Approving Publication of Ordinance No. 665 by Title and Summary. 3. December Financials Action – Accepted report for filing. 4. January Building Permit Report Action – Accepted January Building Permit Report. 5. Continue Pavilion Signage Action – Continued Plaza Signage to the February 20, 2024 City Council Meeting. 6. Resolution 2024-04 Request for Lawful Gambling Premise Permit – Minnetonka Youth Hockey association at Montego Blue – 304 Water Street. Action – Adopted Resolution 2024-04 Approving Issuance of Premise Permit by State of Minnesota Gambling Control Board. 7. PaddleTap Request Action – Approved the Commercial Pier Lease amendment with the addition of another PaddleTap boat at Transient Pier 1, Slip 5 and authorized the Mayor and City Manager to sign the lease amendment. Minutes City Council Meeting Monday, February 5, 2024 Page 4 8. Acknowledge 10% Gambling Donations for Fourth Quarter 2023 Action – Acknowledged charitable gambling donations. 9. Approve Pay Voucher No. 9 East Parking Lot Improvement Project Action – Approved Construction Pay Voucher No. 9 and Final for the East Parking Lot Improvement Project and authorized payment in the amount of $13,019.01 to GMH Asphalt Corporation. 10. Hennepin County Assessing Agreement Action – Initiated an extension of the agreement with Hennepin County to assess the commercial and apartment properties. 8. PUBLIC HEARINGS (a) None 9. ORDINANCES and RESOLUTIONS (a) Second Reading and Adoption of Ordinance No. 644 Amendments to Articles 2, 14 and 41 of the Excelsior Zoning Ordinance. Caron moved and Dierking seconded, to continue the second reading and adoption of Ordinance No. 644 Amendments to Articles 2, 14 and 41 of the Zoning Ordinance to February 20, 2024 City Council Meeting. Motion carried 4/0. (b) THC License Ordinance Amendment Dierking moved, Caron seconded, to waive the second reading and adopt Ordinance No. 666.
