Regular Council Meeting MINUTES Monday, June 3, 2024 106 Center Street, Excelsior, MN 55331 – Entrance located on Center Street 6:30 P.M. 1. CALL TO ORDER Acting Mayor Caron called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Acting Mayor Caron and Councilmembers Dierking, Hersman, and Tyler Absent: Mayor Carlson Also Present: City Manager Luger, Public Works Director Amundsen, Consulting Engineer Bradford, City Engineer Dawley, Assistant City Manager/City Attorney Staunton, and Administrative Services Director Williams 3. APPROVAL OF MINUTES (a) May 6, 2024 City Council Work Session Minutes (b) May 6, 2024 City Council Meeting Minutes (c) May 13, 2024 Special Work Session Minutes (d) May 20, 2024 City Council Work Session Minutes (e) May 20, 2024 City Council Meeting Minutes Hersman moved, Dierking seconded to approve the May 6, 2024 City Council Work Session minutes, May 6, 2024 City Council meeting minutes, May 13, 2024 Special Work Session minutes, May 20, 2024 Work Session minutes, and May 20, 2024 City Council minutes. Motion carried 4/0. Minutes City Council Meeting Monday, June 3, 2024 Page 2 4. OPEN FORUM Myrle Mackenzie, 106 East First Street, addressed the Council about the Farmers Market. Gabriel Jabbour, 985 Tonka Road, addressed the Council about moorings. Bruce Kelly, 165 Maple Street, addressed the Council about the proposed cell tower. Peter Hartwich, 186 George Street, addressed the Council about housing. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) 339 Third Street Construction Update Mark Madero, Ironmark, gave an update on the 339 Third Street Construction. John Bradford, WSB, gave an update on the 339 Third Street project funds. (b) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District. (c) Lift Station Project Update Public Works Director Amundsen gave an update on the Met Council Lift Station project. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Tyler moved, Dierking seconded, to approve the June 3, 2024 City Council meeting agenda. Motion carried 4/0. Minutes City Council Meeting Monday, June 3, 2024 Page 3 (b) Consent Agenda Dierking moved, Tyler seconded, to approve the June 3, 2024 consent agenda. Motion carried 4/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approved Verified Claims over $20,000. 2. April Financials Action – Approved April Financials. 3. 106 Center Street Roof Placement Action – Approved the base bid from Allstar Construction Commercial for $37,190 and allow staff to work with the contractor. 4. Bathhouse Condemnation Action – Approved the condemnation of the bathhouse by the beached in The Commons and appropriate for Public Works storage until the structure can be demolished. 5. The Port Trash Enclosure Action – Approved the quotation from Ridgeline Fence for the cost of $10,580.05 to install a new trash enclosure at The Port. 6. Second Reading Emergency Ordinance No. 667 E-Bikes Action – Waived second reading and adopted ordinance No. 667 E-Bikes Minutes City Council Meeting Monday, June 3, 2024 Page 4 7. Schedule a Special Work Session on June 18 Action – Scheduled a Special Work Session on June 18th 5:30 P.M. – 6:30 P.M. at City Hall. 8. PUBLIC HEARINGS (All Continued to June 17, 2024 City Council Meeting) (a) 163 Second Street Variance (b) 536 Division Street Residential Review Permit (c) 500 Third Street Variance (d) 631 Mill Street Residential Review Permit and Variance 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Fee Schedule Change Hersman moved, Tyler seconded, to adopt resolution 2024-21 adopting an amended fee schedule with the changes as discussed. Motion carried 4/0. 10. ORDINANCES and RESOLUTIONS (a) First Reading Ordinance No. 668 Heritage Preservation Commissioners Tyler moved, Dierking seconded, to waive the first reading and schedule the second reading of ordinance no. 668 at the June 17, 2024 City Council meeting. Motion carried 4/0. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None Minutes City Council Meeting Monday, June 3, 2024 Page 5 13. NEW BUSINESS (a) Structural Engineering Scope – Historic Wastewater Building The Council provided staff with direction. 14.
