Monday, June 17, 2024
1. CALL TO ORDER
Mayor Carlson called the meeting to order at 6:33 P.M.
2. ROLL CALL
City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and
Tyler
Also Present: City Manager Luger, Assistant City Manager/City Attorney Staunton,
Public Works Director Amundsen, and Community Development
Director Mullin
3. APPROVAL OF MINUTES
(a) June 3, 2024 City Council Work Session Minutes
(b) June 3, 2024 City Council Meeting Minutes
Hersman moved, Dierking seconded to approve the June 3, 2024 City Council Work
Session minutes and the June 3, 2024 City Council meeting minutes. Mayor Carlson
abstained from the vote. Motion carried 4/0.
4. OPEN FORUM
Brenda Boime, 826 Pleasant Street, addressed the Council requesting the use of the
building at the Plaza for the non-profit program “Sunshine Stop”.
Sheila McMillian, Community for the Commons, addressed the Council on the Ballfield
project.
Andrew Punch, 561 Third Street, addressed the Council with concerns about
private parking signs and private parking areas not being up to the city code.

5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS
(a) South Lake Minnetonka Police Department Update
Mayor Carlson provided an update on the South Lake Minnetonka Police
Department.
(b) Hanging Baskets
The Council decided to forgo having hanging baskets on Water Street for this year.
(c) Parks and Recreation Commission Update
Public Works Director Amundsen gave an update on the Parks and Recreation
Commission.
(d) Oak Street Project
Public Works Director Amundsen gave an update on the lift station project on Oak
Street.
(e) Additional Mayor Updates
Mayor Carlson acknowledged Mike Phillippi from the Excelsior Lions for his service.
Mayor Carlson announced that the So Hi Playground had its grand opening and
congratulated all that made the playground possible.
Mayor Carlson announced that Nalisha Wiliams, Administrative Services Director,
will be leaving the City of Excelsior and thanked her for her contributions to the
City.

7. AGENDA APPROVAL
(a) Meeting Agenda
Tyler moved, Dierking seconded, to approve the June 17, 2024 City Council meeting
agenda with the change to move item 9(a) before Public Hearing Item 8(a). Motion
carried 5/0.
(b) Consent Agenda
Caron moved, Dierking seconded, to approve the June 17, 2024 consent agenda.
Motion carried 5/0.
1. Review Verified Claims under $20,000 and Approve Verified Claims over
$20,000
Action – Reviewed Verified Claims under $20,000 and Approved Verified
Claims over $20,000.
2. Resolution 2021-21 Appointing 2024 Primary and General Election Judges
Action – Appointed 2024 Primary and General Election Judges.
3. Resolution 2024-21 Adopting Ordinance No. 668 Heritage Preservation
Commissioner
Action – Waived the second reading and adopted Ordinance No. 668 Reducing
the number of Heritage Preservation Commission Members.
4. Bench Request for Commons
Action – Approved bench request for the east knoll behind the Pavilion at the
Commons.

5. Tonka Boat Rentals Commercial Pier Lease (2024 Mooring Season)
Action – Approved Commercial Pier Lease for the 2024 Mooring Season.
6. May Building Permits Report
Action – Accepted May Building Permits Report.
7. Ballfield Scheduling Policy Update
Action – Approved the proposed language update to the Ballfield Scheduling
Application and Policy.
8. Motion to Transfer Funds
Action – Approved transfer of funds.
8. PUBLIC HEARINGS
(a) 163 Second Street - Residential Review Permit and Variance Applications
Adam Price, Price Custom Homes, addressed the Council.
Janet Hughes, 141 West Lake Street, addressed the Council in support of the
residential review application and building height variance and not in favor of the
front yard setback variance.
Rutger Heffelfinger, 173 Second Street, addressed the Council in support of all three
applications.
John Gilles, 166 Linwood Avenue, addressed the Council in support of the project
with conditions.
Adam Price, Price Custom Homes, addressed the Council with clarification and
follow-up to questions.

The City Council directed staff to bring back a resolution to support the residential review
permit application and variance application for building height and to deny the variance for
a front yard setback to the July 15th City Council Meeting.
(b) 631 Mill Street - Residential Review Permit and Variance Applications
Jane Stark, 559 Wheeler Drive, addressed the Council in favor of the project
and concerns about stormwater management.
Dierking moved, Hersman seconded to adopt Resolution 2024-22 Approving a
Residential Review Permit and Variance from the Side Yard Setback at 631 Mill
Street. Motion carried 5/0.
(c) 536 Division Street - Residential Review Permit Application
Adelle Peterson, 536 Division Street, addressed the Council.
Dierking moved, Caron seconded, to approve Resolution 2024-23 adding a condition
that staff sign off on the proposed window placement to the north and south sides
of the structure verifying four-sided architecture alignment as provided in the
Good Neighbor Guidelines. Motion carried 5/0.
Dierking moved, Caron seconded, to amend the previous motion to add that the
removal of trees be approved and signed off by the City Arborist and City Staff.
Motion carried 5/0.
(d) 500 Third Street – Variance Application – Continued to July 15th City Council
Meeting
Dierking moved, Tyler seconded, to continue item 8(d) to the July 15th City Council
Meeting. Motion carried 5/0.

9. PETITIONS, REQUESTS and COMMUNICATIONS
(a) The Commons Ballfield PAC Presentation (moved ahead of Public Hearings)
Sheila McMillian, Community for the Commons, addressed the Council.
Kevin Clark and Paul Page, HKGI, addressed the Council.
The Council provided feedback to staff and HKGI. No action taken.
