Farmers Branch, TX 75234 Meeting Minutes - Final City Council Tuesday, September 3, 2013 6:30 PM Council Chambers Study Session Meeting to be held at 4:00 PM in Study Session Room A. STUDY SESSION Mayor Glancy called the Study Session Meeting to order at 4:02 p.m. Presiding: 1 - Mayor William P. Glancy Present: 5 - Mayor Pro Tem Jeff Fuller, Deputy Mayor Pro Tem Kirk Connally, Council Member Ben Robinson, Council Member Harold Froehlich and Council Member Ana Reyes Staff: 15 - Gary D. There were no questions on any agenda items. A.2 Discuss the City Manager's balanced budget and organizational funding requests related to the adoption of the Farmers Branch 2013-14 fiscal year budget. Charles Cox, Finance Director, stated City Administration is seeking direction from City Council regarding Organizational Funding Requests, Neighborhood Revitalization, and Street Projects. Organizational Funding Requests - the consensus of the City Council was to fund the following amounts totaling $275,000 in the 2013-2014 fiscal year budget: $75,000 - Farmers Branch Chamber of Commerce $7,500 - Metrocrest Chamber of Commerce $170,000 - Metrocrest Social Services (includes a one time increase of $20,000) $7,500 - Family Place $10,000 - Metrocrest Community Clinic $5,000 - Bea's Kids Neighborhood Revitalization - the consensus of the City Council was to put this before the voters in the May, 2014 election Street Projects - the consensus of the City Council was to put this before the voters in City of Farmers Branch Page 1 City Council Meeting Minutes - Final September 3, 2013 the May, 2014 election A.3 Receive an overview of June 13, 2013 Town Hall Meeting survey results. Andy Gillies, Planning Director, provided an overview of the June 13, 2013 Town Hall Meeting survey results. A.4 Discussion regarding Senate Bill 1297 Online Message Boards. City Attorney Kevin Laughlin provided an overview of Senate Bill 1297. The general consensus of the City Council was for City Administration to gather further information and costs related to an online message board and report back to City Council at a future meeting. Mayor Glancy called the Regular City Council Meeting to order at 6:33 p.m. B. INVOCATION & PLEDGE OF ALLEGIANCE Brother Eddy Ketchersid from The Branch gave the Invocation and Council Member Froehlich led the Pledge of Allegiance. C. CEREMONIAL ITEMS C.1 Presentation of the Fire Department’s Award for Exemplary Action to Farmers Branch resident Carolyn Halliburton. Fire Chief Steve Parker, Mayor Glancy, and resident Mr. Donald Rodriguez presented the Award of Exemplary Action to Ms. Carolyn Halliburton. C.2 Proclamation recognizing September as Library Card Sign-up Month. Mayor Glancy presented a proclamation to members of the Library Board. C.3 Proclamation recognizing September 3, 2013 as Fred Ferguson Day in Farmers Branch. Mayor Glancy presented a proclamation to Mr. Fred Ferguson for his service to the community. D. REPORT ON STUDY SESSION ITEMS Deputy Mayor Pro Tem Connally reported on the following items : Organizational Funding Requests were discussed, with a total of $275,000 to be included in the proposed 2013-2014 fiscal year budget Funding for Neighborhood Revitalization & Street Projects will be put before the voters in the May, 2014 election Received an overview on results of the June 13, 2013 Town Hall Meeting survey SB 1297 was reviewed and City Administration will research & present further information at a future City Council Meeting E. ITEMS OF COMMUNITY INTEREST Mayor Glancy reported Brother Eddy Ketchersid will host a meeting at The Branch on City of Farmers Branch Page 2 City Council Meeting Minutes - Final September 3, 2013 September 11 at 11:30 a.m. with local clergy to encourage persons to become United States citizens. Topics presented for the City Manager's Report included: ~Skate Park Relocation - the park will be relocated to the west side of the Community Recreation Center and is expected to open in mid-September ~First Meeting in October - because of the Texas observance of National Night Out , the regularly scheduled City Council meeting will be moved to Wednesday , October 2 at 6:30 p.m. ~Health & Wellness Expo - to be held on Saturday, September 14 at the Community Recreation Center and will feature a variety of free health screenings, nutrition information, blood drive and more ~Library Movie Series - the Manske Library presents three outdoor movies in their amphitheater in September (Back to the Future-September 7; North by Northwest-September 14; Oz: The Great and Powerful-September 21) Movie in the Park - Disney-Pixar's "Up" will be shown beginning at dusk on September 28 at the Barney Wood Athletic Complex F. CITIZEN COMMENTS Lib Grimmett (3225 Damascus Way) - Friends of the Branch.com will hold a "Support the Businesses" in Farmers Branch on September 13, 2013 Richard Sheridan (3022 Forest Lane, Dallas, TX) - spoke against the City's decision to appeal the immigration lawsuit G. CONSENT AGENDA Approval of the Consent Agenda A motion was made by Mayor Pro Tem Fuller , seconded by Council Member Froehlich, to approve Consent Agenda Items G.1 and G.2. The motion carried by the following vote: Aye: 5- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson, Council Member Froehlich and Council Member Reyes G.1 Consider approval of minutes of the City Council meeting held on August 20, 2013 and take appropriate action. The Minutes were approved. G.2 Consider approving Resolution No. 2013-054 allowing a “Temporary Carnival” per Ordinance No. 1770 for the Mary Immaculate Catholic Church Annual Parish Fall Festival, located at 2800 Valwood Parkway, to be held on October 4, 2013 and October 5, 2013, and take appropriate action. This Resolution was approved. H. PUBLIC HEARINGS H.1 Conduct a public hearing and consider adopting a 57.31-cent City of Farmers Branch Page 3 City Council Meeting Minutes - Final September 3, 2013 property tax rate and take appropriate action. Charles Cox, Finance Director, reported the first public hearing was held on August 20, 2013. Tonight is the second public hearing. Mayor Glancy opened the public hearing. Kathleen Matsumura (3138 Clubway) spoke. Mayor Glancy closed the public hearing. H.2 Conduct a public hearing and consider adopting Ordinance No. 3242 approving a Specific Use Permit allowing a detached accessory building greater than 120 square feet in area, located at 3320 Rockmartin Drive, and within the One Family Residential District 1 (R-1) and take appropriate action. Andy Gillies, Planning Director presented background information on this project. Mayor Glancy opened the public hearing. No one wished to speak; Mayor Glancy closed the public hearing. A motion was made by Deputy Mayor Pro Tem Connally, seconded by Mayor Pro Tem Fuller, that this Ordinance be adopted. The motion carried by the following vote: Aye: 5- Mayor Pro Tem Fuller, Deputy Mayor Pro Tem Connally, Council Member Robinson, Council Member Froehlich and Council Member Reyes H.3 Conduct a public hearing and receive a presentation of the 2013 City of Farmers Branch/Dallas County Hazard Mitigation Action Plan (HazMAP) Update. Fire Chief Steve Parker gave a brief overview of the plan. Mayor Glancy opened the public hearing. No one wished to speak; Mayor Glancy closed the public hearing. I. REGULAR AGENDA ITEMS There were no Regular items on this agenda. The Mayor announces that the items of the agenda for the Regular Session have been concluded. After a short recess, the meeting will convene for items in the Executive Session. The meeting will then reconvene into open Regular Session after the items have been discussed in the Executive Session to consider any necessary action. J. EXECUTIVE SESSION There were no Executive Session items on this agenda. K. THE CITY COUNCIL RECONVENES INTO OPEN SESSION Consider necessary action on items discussed in the Executive Session. There was no action taken. L. Farmers Branch, TX 75234 Meeting Agenda - Final City Council Tuesday, September 3, 2013 6:30 PM Council Chambers Study Session Meeting to be held at 4:00 PM in Study Session Room Hard copies of the full City Council agenda packet are accessible prior to every regularly scheduled Tuesday Council meeting according to the following locations and schedule : 1) Manske Library on the Saturday prior to the meeting 2) Justice Center on the Friday evening prior to the meeting 3) City Hall on the day of the meeting Additionally, the agenda packet is available for download from the City’s web site at www.farmersbranch.info after 10 a.m. on the day of every regularly scheduled City Council meeting. This download may be accessed from any computer with Internet access, including computers at the Manske Library and in the lobby of City Hall. As authorized by Section 551.071(2) of the Texas Government Code, this meeting may be convened into closed Executive Session for the purpose of seeking confidential legal advice from the City Attorney on any agenda item listed herein. Any individual who wishes to speak on an agenda item should fill out a Registration Form for Appearance before City Council (white card located in the back of the Council Chambers) and submit the completed card to the City Secretary or City staff member prior to the start of the City Council meeting. Those individuals will be recognized during the meeting at the time the agenda item is presented. REPORT ON STUDY SESSION ITEMS E. ITEMS OF COMMUNITY INTEREST Pursuant to Section 551.0415 of the Texas Government Code the City Council may report on the following items: 1) expression of thanks, congratulations or condolences, 2) information about holiday schedules, 3) recognition of individuals, 4) reminders about upcoming city events, 5) information about community events and 6) announcements involving an imminent threat to public health and safety. F. CITIZEN COMMENTS The City Council invites citizens to speak to the City Council on any subject not listed on the City Council agenda. Any person who desires to address the City Council on such item shall complete and submit a Citizen Comments Registration Card to the City Secretary or City staff member prior to the start of the City Council meeting. Those individuals will be recognized by the Mayor during the meeting at the time Citizen Comments Section is reached. When your name is called please approach the speaker's podium in the center of the Council Chambers, state your name and address for the record, and discuss the specific subject or topic of interest. Please direct your comments to the Mayor. Each speaker will be limited to three (3) minutes. Speaker time may not be shared with, or reserved for, other speakers. The City Council may not take specific action on any subject raised by a speaker during Citizen Comments. The City Council may: have the item placed on a future agenda for action; refer the item to the City Manager and/or staff for further study or action; briefly state existing City policy; or provide a brief statement of factual information in response to the inquiry. ADJOURNMENT Farmers Branch City Hall is wheelchair accessible. Access to the building and special parking are available at the main entrance facing William Dodson Parkway.
