The Administrative Review Board met in regular session on Thursday, October 8, 2015 at 6:00 p.m. in the City Council Chamber, 800 Municipal Drive, Farmington, New Mexico. Members present: Chairman Ireke Cooper James Dennis Paul Martin Lynn Scott Adam Soukup Members absent: None Staff present: Mary Holton Cindy Lopez Keith Neil Steven Saavedra Karen Walker Others addressing the board: Todd Wagener Call to Order The meeting was called to order at 6:00 p.m. by Chair Cooper and there being a quorum present the following proceedings were duly had and taken. Approval of the Agenda A motion was made by Board Member Martin, seconded by Board Member Dennis, to approve the agenda. The motion passed unanimously by a vote of 5-0. Approval of the Minutes from the August 6, 2015 Regular Meeting Board Member Martin made a motion to approve the minutes of the August 6, 2014, regular meeting. The motion was seconded by Board Member Dennis and passed unanimously by a vote of 5-0. Swearing in of Witnesses All parties that wished to speak on behalf of any agenda item were sworn in by Karen Walker. Petition ARB 15-12 Variance to Front Yard Setbacks Discussion of ARB 15-12 on October 8, 2015 Associate Planner Keith Neil presented the staff report for ARB 15-12, a request from Don Elwell Jr., represented by Todd Wagener of Wagener Engineering, for a variance to allow a front yard setback of 12 feet in the IND Industrial District for property located at 1610 E. Cedar Street. The property is two vacant parcels of land on the northwest corner of Cedar Street and Illinois Avenue. The Petitioner has applied for a summary plat to consolidate the two lots as well as make a boundary line adjustment on the western most parcels. The building will be used for the NM Corrections Department Probation and Parole Division, a legal use in the IND District. The NM Corrections Department requires a public parking area and a secured parking area for security reasons. The petitioner also needs room for expansion of the proposed building’s northern portion in the future and must maintain the required 20 foot rear yard setback. The building has a specific internal layout for security purposes that dictates separate parking lots must be located on premise. This leads to further constraints on the property layout. For security purposes, the general parking lot will have a wrought iron fence along the street frontage and has a gate that will be closed during non-business hours. The petitioner is requesting a variance to the front yard setback because of these constraints. Todd Wagener, 1410 N. Missouri, Roswell, NM, the representative for Mr. Elwell, stated the property meets all the needs for the NM Corrections Department. The specific floor plan and layout of the building is necessary to allow secure conditions for parolees and employees. Board Member Dennis commented that the location appeared to be appropriate and the NM Corrections Department should maintain the look of the building. Board Member Martin asked if there has been any opposition from the neighborhood. Ms. Lopez stated that the Community Development Department has not received any phone calls or letters in opposition. Administrative Review Board Action of October 8, 2015 A motion was made by Board Member Martin and seconded by Board Member Scott to approve Petition No. ARB 15-12 for a variance to allow a front yard setback of 12 feet in the IND Industrial District for property located at 1610 E. Cedar Street. AYE: Chair Cooper, Board Members Dennis, Martin, Scott, and Soukup. NAY: None ABSTAIN: None ABSENT: None MOTION TO APPROVE 5-0 Business from the Floor: There was no business from the Floor. Business from the Chair: There was no business from the Chair.
