Please contact the MPO Administrative Assistant if a summary or other type of accessible format is needed.  FARMINGTON METROPOLITAN PLANNING ORGANIZATION Agenda Item #3 Subject: Amendment #1 to the FFY2022-2027 TIP Prepared by: Peter Koeppel, MPO Officer Date: November 18, 2021 BACKGROUND  The first Call for Projects for the FFY2022-2027 TIP Amendment #1 was sent on October 19, 2021; a reminder sent out on October 31.  The Public Notice for Amendment #1 to the FFY2022-2027 TIP was published on the MPO’s website and in the Daily Times on October 31, 2021  The amendment includes the addition of one project: US-550 pavement rehabilitation from MP 161 to 168.3  The Technical Committee recommended approval of proposed Amendment #1 and the Self-Certification for Amendment #1 to the Policy Committee on November 10, AMENDED TIP PROJECT(S)  US-550 pavement rehabilitation from MP 161-168.4 in federal fiscal year 2025 o Estimated cost $9.5 million ANTICIPATED WORK  Hold a public hearing on TIP Amendment #1 on November 18, 2021.  Seek approval of the Amendment #1 and the Self-Certification at the November 18, 2021 Policy Committee meeting. ACTION ITEM  The Technical Committee and Staff recommend that the Policy Committee consider approval of proposed Amendment #1 and the Self-Certification for Amendment #1 to the FFY2022-2027 TIP. APPLICABLE CITATIONS  § 450.328 TIP revisions and relationship to the STIP.  (a) An MPO(s) may revise the TIP at any time under procedures agreed to by the cooperating parties consistent with the procedures established in this part for its development and approval. In nonattainment or maintenance areas for transportation-related pollutants, if a TIP amendment involves non-exempt projects (per 40 CFR part 93), or is replaced with an updated TIP, the MPO(s) and the FHWA and the FTA must make a new conformity determination. In all 1  areas, changes that affect fiscal constraint must take place by amendment of the TIP. The MPO(s) shall use public participation procedures consistent with § 450.316(a) in revising the TIP, except that these procedures are not required for administrative modifications.) After approval by the MPO(s) and the Governor, the State shall include the TIP without change, directly or by reference, in the STIP required under 23 U.S.C. 135. In nonattainment and maintenance areas, the FHWA and the FTA must make a conformity finding on the TIP before it is included in the STIP. A copy of the approved TIP shall be provided to the FHWA and the FTA.  (c) The State shall notify the MPO(s) and Federal land management agencies when it has included a TIP including projects under the jurisdiction of these agencies in the STIP. 2  FARMINGTON MPO SELF-CERTIFICATION STATEMENT FFY2022-2027 TIP Amendment #1 In accordance with 23 U.S.C. 450.334, the New Mexico Department of Transportation, and the Farmington Metropolitan Planning Organization for the Cities of Aztec, Bloomfield, Farmington, Town of Kirtland, and the urbanized area of San Juan County hereby certify that the transportation planning process meets the Performance‐Based Planning and Programming (PBPP) requirements established in 23 CFR 450.326(d), 49 CFR 625, and 49 CFR 630. The project(s) identified in Amendment #1 to the FFY2022–2027 Transportation Improvement Program (TIP) are consistent with the priorities outlined in the NMDOT Asset Management Plan, the New Mexico Strategic Highway Safety Plan, and the New Mexico Freight Plan; and from the priorities outlined in the Red Apple Transit Asset Management Plan of the City of Farmington. The projects support the adopted Performance Targets of the FMPO for Performance Measure 1 (Safety), Performance Measure 2 (State of Good Repair), Performance Measure 3 (System Performance), and Transit Asset Management. Amendment #1 to the TIP was reviewed by the FMPO in accordance with the FMPO Public Participation Plan and the FMPO Title VI Plan. The FMPO also certifies that the transportation planning process is addressing the major issues in the metropolitan planning area and is conducted in accordance with all applicable requirements of: (1) The fiscal constraint required in 23 CFR 450; (2) 49 U.S.C. 5323(l), 23 U.S.C. 135, and 23 U.S.C. 450.220; (3) Title VI of the Civil Rights Act of 1967 and the Title VI assurance executed by each State under 23 U.S.C. 324 and 29 U.S.C. 794; (4) Section 1101(b) of the Transportation Equity Act for the 21st Century (Pub. L. 105- 178) regarding the involvement of Disadvantaged Business Enterprises in FHWA and 3  FTA funded planning projects (Sec. 105(f), Pub. L. 97-424, 96 Stat. 2100; 49 CFR, Subtitle A, Part 26); (5) The provisions of the Americans with Disabilities Act of 1990 (pub. L. 101-336, 104 Stat. 327, as amended) and U. S. This schedule has been considered in developing this proposal. CURRENT WORK  Final approval of Policy Committee Resolution 2021-4 and the FFY22 meeting schedule will be sought on November 18  It is recommended that the Policy Committee continue to hold eight (8) regular meetings during 2021.  Meetings are recommended for January, February, April, May, June, August, September, and November. ATTACHMENTS  Proposed Policy Committee Resolution 2021-4  Proposed FY2022 Policy Committee Meeting Schedule ACTION ITEM  Staff recommends that the Policy Committee consider approving the proposed 2022 meeting calendar and proposed Policy Committee Resolution 2021-4. 7  FARMINGTON METROPOLITAN PLANNING ORGANIZATION POLICY COMMITTEE RESOLUTION NO. 2021-4 A RESOLUTION ESTABLISHING THE PROCEDURES TO BE FOLLOWED AND THE NOTICE TO BE GIVEN PURSUANT TO THE PROVISIONS OF THE NEW MEXICO OPEN MEETINGS ACT, PROVIDING FOR THE ANNUAL DETERMINATION OF REASONABLE NOTICE OF MEETINGS, AND ESTABLISHING THE MEETING TIMES, DAYS AND LOCATIONS FOR THE FARMINGTON METROPOLITAN PLANNING ORGANIZATION POLICY COMMITTEE DURING THE CALENDAR YEAR 2022. WHEREAS, the Policy Committee of the Farmington Metropolitan Planning Organization (FMPO) met in regular session in Council Chambers at Bloomfield City Hall, 915 North First Street, Bloomfield, New Mexico on November 18, 2021 at 10:30 a.m. in accordance with the law; and WHEREAS, Sections 10-15-1 (B) of the Open Meetings Act (NMSA 1978, Section 10-14-1 to 10-15-4) states that, except as may be otherwise provided in the Constitution or the provisions of the Open Meetings Act, all meetings of a quorum of members of any board, council, commission, administrative adjudicatory body or other policymaking body of any state or local public agency held for the purpose of formulating public policy, discussing public business or for the purpose of taking any action within the authority of or the delegated authority of such body, are declared to be public meetings open to the public at all times; and WHEREAS, any meetings subject to the Open Meetings Act at which discussion or adoption of any proposed resolution, rule, regulation or formal action occurs shall be held only after reasonable notice to the public; and WHEREAS, Section 10-15-1(D) of the Open Meetings Act requires the Policy Committee of the FMPO to determine annually what constitutes reasonable notice of its public meetings; NOW, THEREFORE, BE IT RESOLVED BY THE Farmington Metropolitan Planning Organization Policy Committee that: 1. For calendar year 2022, the regular meeting of the FMPO’s Policy Committee will be held at the times, dates, and places as shown on the attached Exhibit “A” hereto. 2. An agenda for such meetings will be available at least seventy-two (72) hours prior to the meeting from the office of the Farmington Metropolitan Planning Organization, Downtown Center Building, 100 W Broadway, Farmington, New Mexico. 8 3. Notice of regular meetings will be given by publishing a list of regular meetings to be held in each calendar year in the Farmington Daily Times or another newspaper of general circulation in San Juan County in January of each year. The notice shall indicate when and where a copy of the agenda for each meeting may be obtained. A copy of this notice and the list of regular meetings will also be posted in the foyer of the Farmington City Hall, 800 Municipal Drive, Farmington, New Mexico and in similar public places in the city/town hall buildings for the entities of Aztec, Bloomfield, Kirtland, and San Juan County, New Mexico, along with the other locations as noted in the MPO’s Public Participation Plan. This notice shall be posted in January of each year and shall remain posted throughout the calendar year. Copies shall also be sent via regular mail or fax to any local television stations and radio broadcast stations at their request. 4. Special meetings may be called by the Committee Chair or by a majority of Committee members upon three (3) days’ notice. If time exists for a notice of such meeting to be published in the legal notices of the Farmington Daily Times or another newspaper of general circulation in San Juan County prior to the meeting, such notice shall be published. If not, notice shall be given by e- mail, fax or some other instantaneous method to a newspaper of general circulation, any local television station and at least one local radio broadcasting station. The notice shall include an agenda for the meeting or information on how members of the public may obtain a copy of the agenda. The agenda shall be available to the public at least twenty-four hours before any special meeting. 5. Emergency meetings will be called only under unforeseen circumstances that demand immediate action to protect the health, safety and property of citizens or to protect the FMPO or its participating governmental agencies from substantial financial loss. The Committee will avoid emergency meetings whenever possible. Emergency meetings may be called by the Committee Chair or a majority of the members of the Committee upon twenty-four (24) hours’ notice, unless threat of personal injury or property damage requires less notice. The notice for all emergency meetings shall be given, except as to the amount of time required, in the manner provided above for special meetings. 6. The Policy Committee of the FMPO may close a meeting to the public only if the subject matter of such discussion or action is accepted from the open meeting requirement under Section 10-15-1(H) of the Open Meetings Act. (a) If any meeting is closed during an open meeting, such closure shall be approved by a majority vote of a quorum of the Committee taken during the open meeting. The authority for the closed meeting and the subjects to be discussed shall be stated with reasonable specificity in the motion to close and the vote of each individual member on the motion to close shall be recorded in the minutes. Only those subjects specified in the motion may be discussed in the closed meeting. (b) If the decision to hold a closed meeting is made when the committee is not in an open meeting, the closed meeting shall not be held until public notice, appropriate under the circumstances, stating the specified provision of law authorizing the closed meeting and the subject to be discussed with reasonable specificity, is given to the members and to the general public. (c) Following completion of any closed meeting, the minutes of the open meeting that was closed, or the minutes of the next open meeting if the closed meeting was separately scheduled, shall state whether the matters discussed in the closed meeting were limited only to those specified in the motion or notice for closure. First Street 11  FARMINGTON METROPOLITAN PLANNING ORGRANIZATION Agenda Item #5 Subject: National Performance Management Measures for Highway Safety Improvement Program (PM 1) Prepared by: Peter Koeppel, MPO Officer Date: November 18, 2021 BACKGROUND  23 CFR §490 Subpart B – National Performance Management Measures for Highway Safety Improvement Program (see attached).  The FHWA requires that MPOs establish targets for five (5) safety performance measures for all public roads in the MPO planning area within 180 days after the State establishes each target.  The five Performance Measures to be considered are: 1) Number of Fatalities, 2) Number of Serious Injuries, 3) Fatalities per 100 Million VMT (Vehicle Miles Traveled) or Fatality Rate, 4) Serious Injuries per 100 Million VMT (Vehicle Miles Traveled) or serious injury rate, and, 5) Number of Non-Motorized Fatalities and Non-Motorized Fatalities and Serious Injuries.  The first three targets are common measures and must be identical to the targets established for the Highway Safety Plan (HSP).  MPOs may either: Agree to support State targets OR Establish specific numeric targets for a safety performance measure (number or rate).  Reporting is done on an annual basis, leaving the choice to adopt State standards vs. establish MPO specific targets up to the MPO Policy Committee each year. CURRENT ISSUES & RECOMMENDATIONS  This item is being presented to both committees in November for their information. It will be brought back to both the Technical and Policy Committees in January for their recommendation/approval.  Staff recommends that the state targets be adopted for 2021.  FMPO Policy Committee action is due no later than February 27, 2021. Generally, the projected 5‐year moving average for each measure is the target. However, the 2020 preliminary data shows impact from the COVID‐19 public health travel restrictions and NMDOT’s Planning Division is proposing adjusting two of the measures to account for this. In each case where the projected 5‐year moving average is not the proposed 2022 target a justification is provided. The five performance measures are included as well as the VMT. VMT does not require a target but is included for reference. Please contact me if you have questions or comments regarding the proposed targets. PRESENTATION: Kathryn Leys gave a quarterly educational presentation on the data made available in the 2020 Census redistricting data released on August 12, which provides a first look at the demographic characteristic of the local communities. Additional data in other formats is expected to be released by September 30, with even more detailed Census results to be released in 2022. The following is a summary of the five topic areas covered in the overview presentation: 22 Population The MPO region overall saw a decline in population although there were pockets of growth in and around the edges of Farmington and the far northeastern sections of the MPO. Race Most communities saw an increase in the Native American population with the largest increase seen in Farmington. Additionally, there was an overall decline in the White population with smaller declines seen in the rural areas and edges of the city. Diversity Index The diversity index refers to the chance that two people chosen at random will be of different ethnic groups. Comparing 2010 and 2020 Census data, the greatest diversity changes occurred along US 64 between Bloomfield and Farmington and along US 550 between Aztec and Bloomfield. Hispanic or Latino This index followed the overall trends with the MPO experiencing a decline in the Hispanic or Latino population. Farmington was the only community to show a slight increase in the Hispanic or Latino population of 1.3%. Over 18 Most communities saw a decline in the population over 18 years of age. Farmington was the only community to see an increase in the population over 18 of 3%. Staff will provide additional information to the Committee on the soon to be released Census data as it becomes available. 1. CALL TO ORDER A quorum was met at 10:44 a.m. and Chair Sharer called the official Policy Committee meeting to order. 2. APPROVE THE MINUTES FROM THE AUGUST 26, 2021 POLICY COMMITTEE MEETING Councilor Bingham-Kelly moved to approve the minutes from the August 26, 2021 Policy Committee meeting. Mr. Brasher seconded the motion. The motion passed with no opposition. 4. 2022 ANNUAL MEETING SCHEDULE Subject: 2022 Annual Meeting Schedule Prepared by: Peter Koeppel, MPO Officer Date: September 23, 2021 23  BACKGROUND  Each year the Policy Committee approves a resolution ensuring compliance with the open meetings act and establishes its meeting schedule for the coming year.  The NMDOT STIP Procedures Manual outlines an annual calendar for TIP Amendments, which impacts the meeting schedule on a quarterly basis. This schedule has been considered in developing this proposal. CURRENT WORK  The proposed 2022 meeting schedule is being presented for discussion by the Policy Committee.  Final approval of Policy Committee Resolution 2021-4 and the FFY22 meeting schedule will be sought on November 18  It is recommended that the Policy Committee continue to hold eight (8) regular meetings during 2021.  Meetings are recommended for January, February, April, May, June, August, September, and November. INFORMATION ITEM  Staff recommends that the Policy Committee review the proposed 2022 meeting calendar and proposed Policy Committee Resolution 2021-4. Final approval will be on November 18. DISCUSSION: Mr. Koeppel referred the Committee to Pages 3-6 of the Agenda for a preliminary review of the proposed meeting schedule for 2022. The proposed schedule follows the previous year’s schedule (day of the month and time) with the Committee meeting eight times during the year (the months highlighted on the calendar are to seek final approval on TIP amendments). Approval of this proposed 2022 meeting schedule will be sought at the November 18 meeting. 5. REVIEW THE PROPOSED FFY2022 FMPO BUDGET FOR NON-REIMBURSABLE EXPENDITURES Subject: Review and Approve the Proposed FFY2022 FMPO Budget for Non-Reimbursable Expenditures Date: September 23, 2021 BACKGROUND  As outlined in the MPO JPA effective October 1, 2020, “any expenditure deemed non-reimbursable by NMDOT shall require the advance approval of the Policy Committee and shall be subject to the funding formula contained in Paragraph A” (Section 5.B, page 9). 24   Non-reimbursable expenditures include those deemed ineligible by NMDOT for reimbursement by the Planning PL and FTA 5303 federal grants.  These expenditures include late billings, refreshments for meetings, bottled water for the MPO, and similar purchases.  The expenditures are expended as needed by MPO staff via the fiscal agent, and then the fiscal agent has been reimbursed with payments from the member entities on a quarterly basis. The Policy Committee approved $2,000 for FFY2021. Through three quarters of FFY2021 the MPO has spent less than $500 on non-reimbursable expenses.  MPO Staff will propose a maximum amount to the Policy Committee on an annual basis before the start of each FFY.  The proposed amount for FFY2022 is $2,000.  Applying the JPA’s reimbursement formula: Aztec would pay $140; Bloomfield would pay $160; Farmington would pay $960; Kirtland would pay $20; and the County would pay $720. Of course, these reimbursement payments would be spread over the four quarters and assumes all $2,000 is spent.  Previously, expenditures were absorbed by the City of Farmington’s Community Development Department. RECOMMENDATION  It is recommended that the Policy Committee review and consider approving up to $2,000 for the MPO’s FFY2022 to ensure sufficient funding for these expenditures is available to the MPO during FFY2022 (October 1, 2021 – September 30, 2022). DISCUSSION: Mr. Koeppel explained that the MPO invoices NMDOT quarterly for expenses incurred during the prior quarter. Some expenditures, however, are deemed ineligible by NMDOT and these are then charged to the entities in accordance with the local match percentage set out in the Joint Powers Agreement (percentage determined by estimated population). These expenses can include late billings, refreshments for meetings, bottled water for the MPO, and similar purchases. To date, these expenses are less than $500. The MPO is requesting Policy Committee approval of up to $2,000 for FFY2022 to ensure sufficient funding for the ineligible expenses. There was no objections and the recommended $2,000 for FFY2022 was approved by consensus. 6. REPORTS FROM NMDOT Planning Bureau – Joseph Moriarty Mr. Moriarty was unable to attend the meeting. District 5 – Paul Brasher Mr. Brasher reported that District 5 had recommended approval of all six of the MPO projects submitted for consideration under the state’s Transportation Project Fund (TPF) 25 call for projects. During the August meeting of the State Transportation Commission, five of those projects received approval for funding: Aztec – McWilliams Road paving/sidewalks Bloomfield - East Blanco Bridge Farmington - Foothills Drive, Phase III Kirtland – Roads 6405 and 6411 resurfacing San Juan County - CR 6100 resurfacing There was some confusion on whether the resurfacing project on Wildflower Parkway had received approval for TPF funding. It was later clarified that this project had not received funding. 7. INFORMATION ITEMS Subject: Information Items Prepared by: MPO Staff Date: September 23, 2021 INFORMATION ITEMS c. Status of RTP/CMAQ/TAP. The Project Feasibility Forms (PFF) for projects being considered were submitted to MPO staff by August 13. Subsequently, MPO staff and applicants have scheduled meetings with NMDOT to review the PFFs to make any necessary changes. Completed applications will be due to the MPO by mid-October to allow sufficient time for them to be evaluated for eligibility and completeness before submittal to DISCUSSION: Mr. Koeppel reported that Staff is working with the Technical Committee members and NMDOT on developing applications for RTP/CMAQ/TAP funding. These projects are typically for bicycle, pedestrian, and air quality. Completed applications will be uploaded to NMDOT by the end of October. 26 The MPO was approached by FHWA and NMDOT Planning Division to participate in a local roads safety plan project for the MPO region. There is a similar project ongoing on the Navajo Nation. Except for staff time, there is no cost to the MPO for the project. 9. BUSINESS FROM THE CHAIRMAN, MEMBERS AND STAFF There is no meeting for the Policy Committee in November. There was no additional business from the Chairman, Members and Staff. 10. PUBLIC COMMENT ON ANY ISSUES NOT ON THE AGENDA There was no public comment on any issues not on the agenda. 11. ADJOURNMENT Councilor Bingham-Kelly moved to adjourn the meeting.
