CURRENT WORK  Staff is presenting this proposed meeting schedule for review by the Technical Committee.  Staff will seek considered adoption of the 2022 meeting schedule and Technical Committee Resolution 2021-1 at the December 8 meeting. Oliver Street  FARMINGTON METROPOLITAN PLANNING ORGANIZATION TECHNICAL COMMITTEE RESOLUTION NO. 2021-1 A RESOLUTION ESTABLISHING THE PROCEDURES TO BE FOLLOWED AND NOTICE TO BE GIVEN PURSUANT TO THE PROVISIONS OF THE NEW MEXICO OPEN MEETINGS ACT, PROVIDING FOR THE ANNUAL DETERMINATION OF REASONABLE NOTICE OF MEETINGS, AND ESTABLISHING THE MEETING TIMES, DAYS AND LOCATIONS FOR THE FARMINGTON METROPOLITAN PLANNING ORGANIZATION TECHNICAL COMMITTEE DURING THE CALENDAR YEAR 2022. WHEREAS, the Technical Committee of the Farmington Metropolitan Planning Organization (FMPO) met in regular session in Commission Chambers at San Juan County’s Administrative Building, 100 South Oliver, Aztec, New Mexico on December 8, 2021 at 10:00 o’clock a.m., in accordance with the law; and WHEREAS, Sections 10-15-1 (B) of the Open Meetings Act (NMSA 1978, Section 10- 14-1 to 10-15-4) states that, except as may be otherwise provided in the Constitution or the provisions of the Open Meetings Act, all meetings of a quorum of members of any board, council, commission, administrative adjudicatory body or other policymaking body of any state or local public agency held for the purpose of formulating public policy, discussing public business or for the purpose of taking any action within the authority of or the delegated authority of such body, are declared to be public meetings open to the public at all times; and WHEREAS, any meetings subject to the Open Meetings Act at which discussion or adoption of any proposed resolution, rule, regulation or formal action occurs shall be held only after reasonable notice to the public; and WHEREAS, Section 10-15-1(D) of the Open Meetings Act requires the Technical Committee of the FMPO to determine annually what constitutes reasonable notice of its public meetings; NOW, THEREFORE, BE IT RESOLVED BY THE Farmington Metropolitan Planning Organization Technical Committee that: 1. For calendar year 2022, the regular meeting of the FMPO’s Technical Committee will be held at the times, dates, and places as shown on the attached Exhibit “A” hereto. 2. An agenda for such meetings will be available at least seventy-two (72) hours prior to the meeting from the office of the Farmington Metropolitan Planning Organization, Downtown Center Building, 100 W Broadway, Farmington, New Mexico. 3. Notice of regular meetings will be given by publishing a list of regular meetings to be held in each calendar year in the Farmington Daily Times or another newspaper of general circulation in San Juan County in January of each year. The notice shall indicate when and where a copy of the agenda for each meeting may be obtained. A copy of this notice and the list of regular meetings will also be posted in the foyer of Farmington MPO TC Resolution 2021-1  the Farmington City Hall, 800 Municipal Drive, Farmington, New Mexico and in similar public places in the city/town hall buildings for the entities of Aztec, Bloomfield, Kirtland, and San Juan County, New Mexico as well as other locations noted in the MPO’s Public Participation Plan. This notice shall be posted in January of each year and shall remain posted throughout the calendar year. Copies shall also be sent via regular mail or fax to any local television stations and radio broadcast stations at their request. 4. Special meetings may be called by the Committee Chair or by a majority of Committee members upon three (3) days’ notice. If time exists for a notice of such meeting to be published in the legal notices of the Farmington Daily Times or another newspaper of general circulation in San Juan County prior to the meeting, such notice shall be published. If not, notice shall be given by e-mail, fax or some other instantaneous method to a newspaper of general circulation, any local television station and at least one local radio broadcasting station. The notice shall include an agenda for the meeting or information on how members of the public may obtain a copy of the agenda. The agenda shall be available to the public at least twenty-four hours before any special meeting. 5. Emergency meetings will be called only under unforeseen circumstances that demand immediate action to protect the health, safety and property of citizens or to protect the FMPO or its participating governmental agencies from substantial financial loss. The Committee will avoid emergency meetings whenever possible. Emergency meetings may be called by the Committee Chair or a majority of the members of the Committee upon twenty-four (24) hours’ notice, unless threat of personal injury or property damage requires less notice. The notice for all emergency meetings shall be given, except as to the amount of time required, in the manner provided above for special meetings. 6. The Technical Committee of the FMPO may close a meeting to the public only if the subject matter of such discussion or action is accepted from the open meeting requirement under Section 10-15-1(H) of the Open Meetings Act. (a) If any meeting is closed during an open meeting, such closure shall be approved by a majority vote of a quorum of the Committee taken during the open meeting. The authority for the closed meeting and the subjects to be discussed shall be stated with reasonable Farmington MPO TC Resolution 2021-1 specificity in the motion to close and the vote of each individual member on the motion to close shall be recorded in the minutes. Only those subjects specified in the motion may be discussed in the closed meeting. (b) If the decision to hold a closed meeting is made when the committee is not in an open meeting, the closed meeting shall not be held until public notice, appropriate under the circumstances, stating the specified provision of law authorizing the closed meeting and the subject to be discussed with reasonable specificity, is given to the members and to the general public. (c) Following completion of any closed meeting, the minutes of the open meeting that was closed, or the minutes of the next open meeting if the closed meeting was separately scheduled, shall state whether the matters discussed in the closed meeting were limited only to those specified in the motion or notice for closure. (d) Except as provided in Section 10-15-1(H) of the Open Meetings Act, any action taken as a result of discussion in a closed meeting shall be made by vote of the Committee in an open public meeting. AMENDMENT #1 TO THE FFY2022-2027 TIP Subject: Amendment #1 to the FFY2022-2027 TIP Prepared by: Peter Koeppel, MPO Officer Date: November 10, 2021  BACKGROUND  The first Call for Projects for the FFY2022-2027 TIP Amendment #1 was sent on October 19, 2021; a reminder sent out on October 31.  The Public Notice for Amendment #1 to the FFY2022-2027 TIP was published on the MPO’s website and in the Daily Times on October 31, 2021  The amendment includes the addition of one project: US-550 pavement rehabilitation from MP 161 to 168.3  The Technical Committee will consider recommending approval of proposed Amendment #1 and the Self-Certification for Amendment #1 to the Policy Committee on November 10 AMENDED TIP PROJECT(S)  US-550 pavement rehabilitation from MP 161-168.4 in federal fiscal year 2025 o Estimated cost $9.5 million ACTION ITEM  Staff recommends that the Technical Committee consider recommending approval to the Policy Committee of proposed Amendment #1 and the Self- Certification for Amendment #1 to the FFY2022-2027 TIP. APPLICABLE CITATIONS  § 450.328 TIP revisions and relationship to the STIP.  (a) An MPO(s) may revise the TIP at any time under procedures agreed to by the cooperating parties consistent with the procedures established in this part for its development and approval. In nonattainment or maintenance areas for transportation-related pollutants, if a TIP amendment involves non- exempt projects (per 40 CFR part 93), or is replaced with an updated TIP, the MPO(s) and the FHWA and the FTA must make a new conformity determination. In all areas, changes that affect fiscal constraint must take place by amendment of the TIP. The MPO(s) shall use public participation procedures consistent with § 450.316(a) in revising the TIP, except that these procedures are not required for administrative modifications.) After approval by the MPO(s) and the Governor, the State shall include the TIP without change, directly or by reference, in the STIP required under 23 U.S.C. 135. In nonattainment and maintenance areas, the FHWA and the FTA must make a conformity finding on the TIP before it is included in the STIP. A copy of the approved TIP shall be provided to the FHWA and the FTA.  (c) The State shall notify the MPO(s) and Federal land management agencies when it has included a TIP including projects under the jurisdiction of these agencies in the STIP. DISCUSSION: Mr. Koeppel explained that Amendment 1 to the FFY2022-2027 TIP was to add in a segment of US 550 pavement rehabilitation (milepost 161 to 168.3) in federal fiscal year 2025. The estimated cost of the project is $9.5 million funded with surface transportation funds as well as some federal pavement preservation funds. The rest of the roadway segment to the Colorado border is in the informational years of the STIP. FMPO Staff recommends approval of Amendment #1 and the Self- Certification for Amendment #1. Mr. Martinez added that he had just attended the District 5 STIP meeting and another project has fallen out of FY2022 so this pavement rehabilitation project may replace it to ensure the funding stays with District 5. Chair Porell opened the public hearing. No comments were received. Chair Porell closed the public hearing. ACTION: Ms. Escobar moved to recommend approval to the Policy Committee of TIP Amendment #1 and the Self Certification for Amendment #1. Mr. Martinez seconded the motion. DISCUSSION: Mr. Koeppel asked the members to please review the proposed meeting schedule for 2022 (Page 5 of the Agenda) for any issues. The calendar proposes keeping the meetings at 10:00 a.m. on the second Wednesday of the month. This schedule will be brought back to the Committee for considered approval in December. 5. NATIONAL PERFORMANCE MANAGEMENT MEASURES FOR HIGHWAY SAFETY IMPROVEMENT PROGRAM (PM 1) Subject: National Performance Management Measures for Highway Safety Improvement Program (PM 1) Prepared by: Peter Koeppel, MPO Officer Date: November 10, 2021 BACKGROUND  23 CFR §490 Subpart B – National Performance Management Measures for Highway Safety Improvement Program (see attached).  The FHWA requires that MPOs establish targets for five (5) safety performance measures for all public roads in the MPO planning area within 180 days after the State establishes each target.  The five Performance Measures to be considered are: 1) Number of Fatalities, 2) Number of Serious Injuries, 3) Fatalities per 100 Million VMT (Vehicle Miles Traveled) or Fatality Rate, 4) Serious Injuries per 100 Million VMT (Vehicle Miles Traveled) or serious injury rate, and, 5) Number of Non- Motorized Fatalities and Non-Motorized Fatalities and Serious Injuries.  The first three targets are common measures and must be identical to the targets established for the Highway Safety Plan (HSP).  MPOs may either: Agree to support State targets OR Establish specific numeric targets for a safety performance measure (number or rate).  Reporting is done on an annual basis, leaving the choice to adopt State standards vs. establish MPO specific targets up to the MPO Policy Committee each year. CURRENT ISSUES & RECOMMENDATIONS  This item will be presented to both committees in November for their information. It will be brought back to both the Technical and Policy Committees in January for their recommendation/approval.  Staff recommends that the state targets be adopted for 2022.  FMPO Policy Committee action is due no later than February 27, 2022. INFORMATION ITEM  This is being presented during the November meeting as an introduction. APPLICABLE CITATIONS Requirement for MPOs to establish performance targets for Federal-aid highway measures and public transportation established by USDOT.  23 USC 134(h)(2)  49 USC 5303(h)(2)  49 USC 5304(d)(2) Requirements to include discussion in the metropolitan and statewide transportation improvement program as to how the planned program will achieve State/MPO targets:   23 USC 134(j)(2)(D)  23 USC 135(g)(4)  49 USC 5303(j)(2)(D)  49 USC 5304(g)(4) DISCUSSION: Mr. Koeppel noted that Federal law requires the adoption of safety performance targets (PM 1) each year. Considered adoption of PM 1 targets for 2022 will be brought back to both Committees in January 2022. Mr. Koeppel reviewed some of the background on why performance targets are required:  Performance-based planning and programming refers to the application of performance management to achieve desired performance outcomes: o Improved investment decision making; o Improved return on investments and resource allocation; o Demonstrates link between funding and performance; o Improved system performance being overall goal.  MAP-21 and subsequently the FAST Act (new transportation bill is pending) required the establishment of national goals and measures annually for Safety. o Other areas include: infrastructure condition, congestion reduction, system reliability, freight movement and economic vitality, environmental sustainability, and reduced project delivery delays. o Overall goal is to improve accessibility and mobility.  Federal → State → MPO o State sets targets and goals and MPOs can set their own measureable targets or choose to adopt state’s.  Safety targets are implemented to achieve a significant reduction in traffic fatalities and injuries on all public roads (includes neighborhood streets). There are five (5) targets/goals: o Number of fatalities o Rate of fatalities per 100 million vehicle miles traveled (VMT) o Number of serious injuries o Rate of serious injuries per 100 million VMT o Number of non-motorized fatalities and non-motorized serious injuries  NMDOT’s targets for 2022: Performance Measure 2022 Target Number of total fatalities 421.9 Number of serious injuries 1030.5 Rate of fatalities per 100 million VMT 1.645 Rate of serious injuries per 100 million VMT 3.824 Number of non-motorized fatalities and serious injuries 190.6 Staff recommends that FMPO support NMDOT’s performance measures. Considered adoption of the PM 1 performance measures will be brought back to both Committees in January 2022. The members were encouraged to complete NMDOT’s online survey on safety related measures that the FMPO had forwarded to everyone. Mr. Koeppel also reported that the FMPO is working with NMDOT and FHWA on developing local road safety plans. The virtual workshop is scheduled for December 16 at 9:00 a.m. and is for anyone interested in weighing in on safety in the region for all modes of transportation. Mr. Koeppel will send out the workshop information again and asked the members to share it with others who might have an interest. Ms. Escobar asked where e-scooters and e-bikes might fall in a safety plan. Mr. Koeppel said these present more of a problem as to whether they travel on roadways or sidewalks. He said he would look into this further. 6. Committee members will have an opportunity to provide any needed feedback/updates/details regarding the status of current projects. DISCUSSION: The Technical Committee members provided their project updates: City of Aztec – Steve Morse East Aztec Arterial The consultant is reworking the environmental and right-of-way clearance issues. The City expects to go out to bid in March 2022 and begin construction in May. McWilliams Road The City is ready to begin the design process for the McWilliams Road project with design completion expected in January. Mr. Morse stated that there may be a potential right-of-way issue at the intersection with Oliver Drive that will have to be worked through. City of Bloomfield – Jason Thomas Mr. Thomas was not in attendance at the meeting, but provided the following update on the East Blanco Bridge project: Environmental document drafted; design revisions still in progress. City of Farmington – Virginia King Foothills Drive Enhancement Phase II Construction is in progress. The City has granted the contractor a 30-day extension to finish the project and complete the paving before winter hits. East Pinon Hills Blvd. Extension Phases I & II No update 20th Street Phase III Project to be re-bid in December Foothills Drive Enhancement Phase III The right-of-way process will begin in December. Town of Kirtland – Dan Flack CR 6405 and 6411 The Town is finishing the agreements with NMDOT and awaiting the notice to proceed. San Juan County – Nick Porell CR 5500 Bridge Replacement Construction is ongoing. The contractor plans to work through the winter with completion still on track for May 2022. Kirtland Schools Walk Path Extension This project is out to bid and closes on December 9. Pre-bid meeting scheduled for November 16. Glade Run Recreation Area Trails Extension This project is nearing completion and should be done in early December. NMDOT – District 5 – Javier Martinez East Pinon Hills Blvd. Extension The City of Farmington submitted letters to District 5 regarding an extension to the ten-year rule on funding and for forgiveness on the process for the East Pinon Hills Blvd. Extension. District 5 is reviewing the request and will then send a letter to FHWA for their concurrence. NM 173 The plans have been turned in for PS&E and then out to bid. Construction should begin next spring/summer. US 550 Pavement Rehabilitation This project will be an accelerated project with the consultant already on board. NMDOT plans to also upgrade the guardrail and replace signage. This will be Phase I of the project and funding for the remainder of the project will be sought. NM 371 / N 36 NMDOT and Navajo DOT are finalizing the funding agreement for this project. Construction should begin next year. 7. REPORTS FROM NMDOT Planning Bureau – Rosa Kozub Ms. Kozub is temporarily filling in as the Planning Liaison for the FMPO as Joe Moriarty was promoted to Technical & Freight Planning Supervisor. Ms. Kozub encouraged all members to take NMDOT’s online survey for the Strategic Highway Safety Plan Update process and asked that it be shared with each of the agencies’ divisions who may touch on aspects of roadway safety. District 5 – Javier Martinez Mr. Martinez reported that the entities should have already received the agreements for their TPF applications. He asked that each entity be sure to return their documents to NMDOT so the agreements can be put in place in December. 8.
