Councilman Wolfe was absent. CALL TO ORDER PLEDGE OF ALLEGIANCE INVOCATION Mayor Savage provided the invocation. MINUTES January 27, 2025 February 3, 2025 February 10, 2025 Councilman Helms made a MOTION to approve the minutes of the January 27, 2025, February 3, 2025, and February 10, 2025, council meetings. SECONDED by Councilman Garrison. Passed 6-0. One citizen spoke during Public Comment regarding the bump on Academy Street and poor condition of Banks Street. PRESENTATIONS Page 1|5  Presentation #1 Presentation of Stormwater Award Eric Davis, CEO/Assistant Town Manager, explained to council that Lt. Governor Evette and SCDES Interim Director Myra Reece recently presented representatives of the Watershed Evaluation Team (WET) with SCDES’s Power of Partnerships Award. WET is a working group comprised of stakeholders from multiple jurisdictions in York County: City of York, York County, City of Rock Hill, Catawba Regional Council of Governments, Catawba Indian Nation, City of Fort Mill, and the City of Tega Cay. These stakeholders assembled WET in 2022 to better understand and manage York County’s water resources and through their cooperative efforts, developed watershed plans in the region. The watershed plans are used to implement improvements for protecting water quality. OLD BUSINESS Old Business Item #1 Public Hearing & Second Reading - Approval of Budget Amendment 25-5. Mayor Savage opened the floor for a public hearing. No one came forth to speak. Mr. Davis had previously explained that when working with our Auditors (Mauldin & Jenkins; CPA), they recommended that we retroactively amend our FY24 budget in order to re-classify the funds in which the Town Hall property acquisition and related debt issuance were originally assigned. Originally, the transaction was coded to the General Fund, but it is more preferable and accurate to code this project to the Capital Project Fund. This budget amendment does not authorize the receipt or expense of any new dollars. This is simply a re-coding of the revenue and expenditure line items. Similar transactions would normally be handled administratively by staff, but since this reclassification crosses multiple Funds, then approval can only be granted by the Town Council. Mr. Davis also stated that no changes have been made since First Reading. Councilwoman Cook made a MOTION to approve Second Reading of an ordinance approving Budget Amendment 25-5. SECONDED by Councilman Garrison. Passed 6-0. NEW BUSINESS New Business Item #1 Resolution authorizing 2025 Downtown Events Chris Sardelli, Communications and Marketing Manager, presented a resolution that designates the following locations as sites of a public festival at which alcoholic beverage may be sold, possessed and consumed and authorize a special event permit for live music and sound amplifying equipment: • Saturday, March 15, 2025, from 12PM-8PM on Main Street, Fort Mill from Tom Hall Street to Academy Street; and • Saturday, September 20, 2025, from 12PM-9PM on Main Street, Fort Mill from Tom Hall Street to Academy Street; and Page 2|5  • Saturday, December 6, 2025, from 3 p.m. and 7 p.m., on Main Street, Fort Mill from Tom Hall Street to Academy Street; and • Thursday, July 3, 2025, 2 p.m. until 9:30 p.m., Friday, July 4, 2025, 10 a.m. until 12 p.m., and Thursday, December 4, 2025, 2 p.m. until 8 p.m. on Main Street (Tom Hall to Academy Street-Barricade Zone) Councilman Garrison made a MOTION to approve the resolution for 2025 Downtown events. New Business Item #2 First Reading - Amendment to the Budget Ordinance for the Town of Fort Mill, South Carolina for the Fiscal Year beginning October 1, 2024, and ending September 30, 2025. Eric Davis told council that this item is a follow up to the presentation made by Chief Wilkerson at the Council’s February work session regarding the acquisition of two (2) fire trucks for the Fort Mill Fire Department. Mr. Davis said that this budget amendment will allow for the order and purchase of two fire trucks and is described below: 1. Enter into a contract for the purchase of a Stock Unit-Engine and equipment not to exceed expenditure of $1.1 million. Payment is due at time of delivery in approximately 5 – 8 months. 2. Enter into a contract for the purchase of a custom design Engine and equipment This item is a follow for $1,307,104.00. Payment will be due in 48 – 51 months at the time of apparatus delivery. Councilman Hudgins made a MOTION to approve First Reading of Budget Amendment 2025-6 for the purchase of 2 fire trucks and equipment. SECONDED by Councilman Helms. Passed 6- 0. New Business #3 First Reading – An ordinance amending the Town of Fort Mill’s event authorization process for Town hosted and sponsored events. Chris Pettit, Assistant Town Manager, explained that historically, Town Council has approved via resolution both the consumption and possession of alcoholic beverages at Town hosted or sponsored events as well as the granting of a special event permit to authorize noise amplifying equipment at Town hosted or sponsored events. This ordinance, as drafted, would amend our current processes such that Town hosted or sponsored events only require the sign off of the Town Manager or his designee for the purpose of authorizing the consumption and possession of alcoholic beverages at Town hosted or sponsored events as well as for the purpose of allowing noise amplifying equipment at Town hosted or sponsored events. Councilwoman Cook made a MOTION to approve First Reading of an ordinance amending the Town of Fort Mill’s event authorization process for Town hosted and sponsored events. SECONDED by Councilman Moody. Passed 6-0. Page 3|5  New Business #4 First Reading - Ordinance authorizing the sale of real property located at 112 Confederate Street. Cary Vargo, Town Manager, explained that this is an ordinance authorizing the sale of real property located at 112 Confederate Street, pursuant to the terms and conditions of a contract of purchase and sale dated May 16, 2024. Second Reading will be scheduled for March 24, 2025. The closing date is scheduled for Friday, April 14, 2025. Councilman Moody recused himself from the voting of this item. Councilman Helms made a MOTION to approve an ordinance authorizing the sale of real property located at 112 Confederate Street. SECONDED by Councilman Garrison. Passed 5-0. New Business #5 First Reading - Ordinance authorizing the entry into and execution of a lease agreement between the Town of Fort Mill and David Martin related to the real property located at 112 Confederate Street. Councilman Moody recused himself from the voting of this item. Mr. Vargo informed council that this ordinance authorizes the lease of approximately 4,343 square feet of space at 112 Confederate Street. The leased premises shall consist of that portion of the ground floor of the building currently occupied by the Fort Mill Police Department which houses the following: dispatch, squad room, showers, lockers, booking, interrogation, breathalyzer, break room, sally port and cell blocks A and B. Additionally, the telephone room (IT closet) in the ground floor lobby shall be included in the leased premises . The term of the Lease shall commence upon the final closing on the sale of the real property to Buyer and run through February 28, 2026, unless terminated earlier by Lessee. This Lease shall be considered a month-to-month lease, that should the relocation extend past the date referenced above, the Lessee shall have the right to continue to lease the Premises on a month-to-month basis, the same not to exceed six (6) additional months. NOW, THEREFORE, pursuant to the authority granted by the Constitution and the General Assembly of the State of South Carolina, BE IT ENACTED BY THE TOWN COUNCIL FOR THE TOWN OF FORT MILL: SECTION I. The Code of Ordinances for the Town of Fort Mill; Section 24-30(b); is hereby amended to add a subsection (3) that reads as follows: 3) Any public area which is the site of a Town hosted or sponsored event that has been signed off on by the Town Manager or his designee. SECTION II. The Code of Ordinances for the Town of Fort Mill; Section 24-34(c)(2)(l); is hereby amended to read as follows: l. Sound-amplifying devices generally. Operating or causing or permitting to be operated any automatic or electrical plane, phonograph, graphophone, victrola, radio or loudspeakers, or any instrument or sound-producing or sound-amplifying device of like character so loud as to unreasonably disturb persons in the vicinity thereof or in such a manner as to render the instrument or device a public nuisance; provided, however, that upon application to and approval by the town council, permits may be granted to responsible organizations to broadcast programs of music, speeches or general entertainment as a part and in recognition of a community celebration of national, state or town events, public festivals, or outstanding events of a noncommercial character, provided that traffic on the streets is not obstructed by reason thereof and adequate provisions will be made to minimize the disturbance to neighboring residential areas. School sanctioned events and activities taking place on school grounds between the hours of 7:00 a.m. and 11:00 p.m. shall be exempt from the provisions of this paragraph. Town hosted or sponsored events that have been signed off on by the Town Manager or his designee shall be exempt from the provisions of this paragraph.  SECTION III. Severability. If any section, subsection, or clause of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections, and clauses shall not be affected thereby. SECTION IV. Conflicting Ordinances Repealed. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION V. Effective Date. WHEREAS, the Town of Fort Mill, owns real property located at 112 Confederate Street, in Fort Mill, South Carolina (the “Property”); and WHEREAS, South Carolina Code § 5-7-40 and § 5-7-260(6) provides the Town with the power to sell its real property by way of ordinance; and WHEREAS, after the Fort Mill Town Council authorized its Town Manager and Town Attorney to negotiate and enter into a contract for the sale of the Property, a Contract to Buy and Sell Real Estate was executed on May 16, 2024 (the “Contract”); and WHEREAS, the Contract was amended by Addendum to Contract, dated February 20, 2025; and WHEREAS, the Fort Mill Town Council finds that the sale and conveyance of the Property pursuant to the terms and conditions contained in the Contract, as amended, is in the best interest of the Town; and NOW, THEREFORE, pursuant to the authority granted by the Constitution and General Assembly of the State of South Carolina, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF FORT MILL: SECTION 1. WHEREAS, the Town of Fort Mill, is under Contract to sell the real property located at 112 Confederate Street, in Fort Mill, South Carolina (the “Property”) to David Martin (“Martin”); and WHEREAS, South Carolina Code § 5-7-40 and § 5-7-260(6) provides the Town with the power to lease real property by way of ordinance; and WHEREAS, as part of its Contract to Buy and Sell Real Estate, which was executed on May 16, 2024, and amended on February 20, 2025, (the “Contract”) the Town agreed to lease a portion of the Property from Martin for a period of time to allow for the ultimate relocation of the Town’s 911 communications center; and WHEREAS, the Fort Mill Town Council finds that it is in the best interest of the Town of Fort Mill to enter in to the lease agreement under the terms and conditions contained in the Contract, as amended; and NOW, THEREFORE, pursuant to the authority granted by the Constitution and General Assembly of the State of South Carolina, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF FORT MILL: SECTION 1. AUTHORIZATION TO LEASE. The Fort Mill Town Council hereby authorizes the Town Manager to enter into a lease agreement with Martin on a portion of the Property located at 112 Confederate Street, Fort Mill, South Carolina in accordance with the terms and conditions contained in Contract dated May 16, 2024, as amended on February 20, 2025. The Town Manager is authorized to execute the lease agreement and any other appropriate documents and agreements necessary to consummate a leasehold interest in the Property. SECTION 2. EFFECTIVE DATE. This ordinance shall take effect upon the date of its adoption. Background Information Background Information: The Town of Fort Mill’s Procurement Code was adopted in 2004. Since that time, changes in procurement practice throughout the State of South Carolina have taken place. One change that has taken place over time is the dollar threshold referred to as a small purchase amount. Our current small purchase amount is $1,000, meaning anything over $1,000 requires a requisition to be created by a manager or supervisor. Once the requisition is approved it is then converted and approved by the Procurement Manager into a Purchase Order. Below are examples of the small purchase amounts in our area. The City of Rock Hill $2,000 The City of Tega Cay $2,000 Lancaster County $2,500 York County $2,500 The State of South Carolina $2,500 With the proposed change of the small purchase amount to $2,500, Town staff will still be required to gather three (3) quotes for any purchase over the new amount of $2,500 dollars. All safeguards, approvals and procedures will remain in place to spend responsibly and follow all procurement policies. With this change the Town will be in line with other agencies in our area and across the state of South Carolina. Current: 3-204 Small Purchases. Any procurement not exceeding the amount of $10,000 for goods and services or $25,000 for construction contracts may be made by the Director of Procurement under this section, provided, however, that procurement requirements shall not be artificially divided so as to constitute a small purchase under this Section. When the procurement exceeds $1,000, but is less than $10,000 for goods and services or $25,000 for construction contracts, the Director of Procurement shall obtain when practical at least three telephone bids or prices obtained by catalogue or internet searches for the goods, services or construction contract sought to be procured. Small purchases of $1,000 or less may be accomplished without securing competitive quotations if the prices are considered by the Director of Procurement to be reasonable.
