Councilmember Chavez thanked City Manager Quan-Schecter and
Administration for the big Francher Creek clean-up.

three years with an option for two one-year year extensions to

Council President Soria asked staff to explain why one of the bidder was so
low and if that is the amount that has been paid for the last few years.

Section 15301 (existing facilities) of the California Environmental
Quality Act Guidelines for the Emergency Ordinance;

4-D ID18-0938 ***RESOLUTION - Submitting to City Electors a proposal to
amend the Charter to modify or eliminate provision that are
contrary to and preempted by state or federal law and providing
for the placement of the measure on the November 6, 2018,
General Election ballot. (Subject to Mayor’s Veto.)
Councilmember Baines returned to the meeting at 5:18 P.M.

Upon call the following member of the public addressed Council: Doug
Vagim
City Attorney Sloan clarified the item and what changes are being made in
the City Charter. City Attorney Sloan explained the provision in section 309
- limits when candidates who are running for City office can raise money;
section 701 -requires City Manager to be a resident of the City within six
months of taking office; section 1225 prohibits residential water heaters and
section 1207-requires a balance budget.
Council Vice President Brandau asked City Attorney Sloan to speak more
about the residental water heater and asked if the provision is required in all
of the state of California and asked if they can be put on the ballot as one
item. Council Vice President Brandau also asked what it would be like to
separate the items and suggested to vote on the item individually. City
Attorney Sloan said it would cost about $10,000 for more printing space.
Councilmember Baines asked City Attorney Sloan about the communication
that was received today and what was the response. City Attorney Sloan
replied that placing all the items under one item would not violate the single
subject rule.

4-E ID18-0939 ***RESOLUTION - Submitting to the City electors a Balanced
Budget Charter Amendment. (Subject to Mayor’s veto)
City Attorney Sloan read into the record additional technical language to be

Upon call, there was no public comment.
Councilmember Olivier asked City Attorney Sloan if it was state law that
Municipalities have to have a balanced budget. City Attorney Sloan
responded no there is no requirement.
Couniclmember Baines asked Assistant City Manager Sumpter have we
ever adopted an unbalanced budget in the past and asked staff to explain
what a balanced budget is. Assistant City Manager Sumpter responded.
Council Vice President Brandau asked City Attorney Sloan does Council
have the power to direct Administration on what expenditures are being
spent. City Attorney Sloan replied.
Council President Soria asked Assistant City Manager Sumpter who the
burden lies when making the budget balanced. Assistant City Manager
Sumpter responded.

Mayor Brand, Councilmember Olivier and Councilmember Chavez spoke
regarding there support for a balanced budget.
Councilmember Caprioglio spoke regarding his opposition to the item.

The Fresno City Council welcomes you to City Council Chambers, located in City

The City of Fresno’s goal is to comply with the Americans with Disabilities Act (ADA)

The Council meeting can be viewed live on Comcast Channel 96 and AT&T Channel
99 from 9:00 a.m. and is re-played beginning at 8:00 p.m.. The meeting can also be
viewed online at https://fresno.legistar.com.
PROCESS: For each matter considered by the Council there will first be a staff
presentation followed by a presentation from the involved individuals, if present.
Testimony from those in attendance will then be taken. All testimony will be limited to
three minutes per person. If you would like to speak fill out a Speaker Request Form
available from the City Clerk’s Office and in the Council Chambers. The three lights
on the podium next to the microphone will indicate the amount of time remaining for
the speaker.
The green light on the podium will be turned on when the speaker begins. The yellow
light will come on with one minute remaining. The speaker should be completing the
testimony by the time the red light comes on and tones sound, indicating that time
has expired. A countdown of time remaining to speak is also displayed on the large
screen behind the Council dais.
No documents shall be accepted for Council review unless they are submitted to the
City Clerk at least 24 hours prior to the Council Agenda item being heard.
Following is a general schedule of items for Council consideration and action. The
City Council may consider and act on an agenda item in any order it deems
appropriate. Actual timed items may be heard later but not before the time set on
agenda. Persons interested in an item listed on the agenda are advised to be present
throughout the meeting to ensure their presence when the item is called.
