The City Council met in special emergency closed and open session meeting, City
Hall on the date and time written above.

APPROVE AGENDA
On motion of Councilmember Karbassi, seconded by Councilmember
Soria,the above Action was approved. The motion carried by the
following vote:

Open Session
C. ID ***Approve the 48th Amendment to Annual Appropriations Resolution No.
20-00668 2019-133 to Appropriate $1,012,900 for the Purpose of Funding the Transfer of
State of California COVID-19 Emergency Homeless Funding to the County of
Fresno (Requires 5 Votes) (Subject to Mayor’s veto)
The above item was introduced to Council by Council President Arias,
District 3. There was no Council discussion and no public comment.
RESOLUTION 2020-119 ADOPTED
On motion of President Arias, seconded by Councilmember Chavez,
that the above Action Item be adopted. The motion carried by the
following vote:

Esparza
B. ID Approve Resolution concerning implementation of the COVID-19 Housing
20-00664 Retention Grant Program.
The above item was introduced to Council by Councilmember Soria, District

1. Upon call, there was no public comment.
Councilmember Karbassi amended the motion to include a new section 3 to
the Resolution moving the current number 3 to number 4, stating "any
contract over $50,000 shall return to Council for a vote, at a special or
emergency meeting. The City Administration shall oversee the program,
ensuring compliance with any applicable restrictions on use of allocated
funding." Council Vice President Caprioglio and Councilmember Soria
agreed to the amended motion.
Discussion was held between Councilmembers regarding the CARES Act
money, the Housing Retention Grant Program subcommitee, members on
the subcommittee are Councilmember Soria, Councilmember Chavez and
Council President Arias. There are no General Fund or Community
Development Block Grant (CDBG) Fund dollars being used, and if the funds
can be used on any illegal individuals.
Councilmember Bredefeld stated he does not support the above item.
Councilmember Karbassi asked City Attorney Sloan if Council is violating
any laws in moving forward with the above item regarding undocumented
individuals. City Attorney Sloan stated this resolution does not violate the
law.

On motion of Vice President Caprioglio, seconded by Councilmember
Soria, that the above Action Item be adopted as amended. The motion
carried by the following vote:

essential public services, and to the public’s right of access to public
services and public facilities, and related actions pertaining to the

Declaration by Governor Newsom of a State of Emergency to Help State
Prepare for Broader Spread of COVID-19, and related local concerns.
City Council recessed into Closed Session at 11:27 A.M. and returned from
Closed Session at 12:14 P.M.
There was no announcement after Closed Session and the above item was
discussed.
City Council recessed for lunch at 12:14 P.M. and returned from lunch at 1:43 P.M.
A. ID Consider emergency amendment to FMC Article 5, Emergency Services
20-00663 Ordinance, adding Section 2-515 to the Fresno Municipal Code regarding
outdoor dining during the COVID-19 pandemic emergency, and adopt a
finding that the ordinance is exempt from the requirements of CEQA
pursuant to Section 15269(c) of the CEQA Guidelines (requires 5
affirmative votes).
The above item was introduced to Council by Councilmember Karbassi,
District 2, Council Vice President Caprioglio, District 4. Upon call, the
following member of the public addressed Council: Lisa Flores.
Councilmember Soria amended the motion to include in section (a) City
property and permission of the City Manager. Councilmember Karbassi and
Council Vice President Caprioglio agreed to the amendment to the motion.
Councilmember Esparza asked City Attorney Sloan if any part of the
Ordinance is out of State guidelines or compliance and how does City of
Fresno settle any business disputes or complaints. City Attorney Sloan
responded.

On motion of Vice President Caprioglio, seconded by Councilmember
Karbassi, that the above Action Item be adopted as amended. The
motion carried by the following vote:
