Roll Call Present: 7 - President Miguel Angel Arias Vice President Paul Caprioglio Councilmember Esmeralda Z. Soria Councilmember Mike Karbassi Councilmember Luis Chavez Councilmember Garry Bredefeld Councilmember Nelson Esparza Closed Session: City Council recessed into Closed Session at 4:08 P.M. and returned from Closed Session at 4:42 P.M. There were no announcements after Closed Session and the below item was discussed. ID A. CONFERENCE WITH LEGAL COUNSEL - PUBLIC SECURITY 20-001066 - Government Code Section 54957(a): Matters posing a threat to the security of public buildings, the security of essential public services, and to the public ’s right of access to public services and public facilities, and related actions pertaining to the Declaration by Governor Newsom of a State of Emergency to Help State Prepare for Broader Spread of COVID-19, and related local concerns. Open Session: Upon call the following members of the public addressed Council: Ivanka Saunders, Lisa Flores and Tyler Mackey. A. ID ***RESOLUTION - Directing Approval of and Procedures for 20-001067 CARES Act Funding (Subject to Mayor’s Veto) Council President Arias motioned to adopt as amended, omitting paragraph 6 "The expenditures attached hereto as Exhibit A meet the eligibility requirements for the Coronavirus Relief Fund, and therefore shall be reimbursed." and paragraph 8 "City personnel or contractors shall not utilize time and resources to conduct audits of CARES recipients during the City of Fresno ***Subject to Mayoral Veto Page 2 City Council Meeting Minutes - Final August 17, 2020 pendency of the COVID-19 Emergency; any audits shall follow the conclusion as directed by Council." Councilmember Chavez seconded the motion. RESOLUTION 2020-177 ADOPTED On motion of President Arias, seconded by Councilmember Chavez, that the above Resolution be adopted as amended. The motion carried by the following vote: Aye: 7 - Arias, Caprioglio, Soria, Karbassi, Chavez, Bredefeld and Esparza B. ID Approve CARES Act expenditure and contracts for food distribution and 20-001068 grocery relief: 1. ***RESOLUTION - Adopting the 11th Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $4,512,600 in CARES Act Funds for food distribution programs (Requires 5 affirmative votes) (Subject to Mayor’s Veto) 2. Approve agreement with Neighborhood Industries 3. Approve agreement with The Fresno Center 4. Approve agreement with Every Neighborhood Partnership 5. Approve agreement with Reading & Beyond 6. Approve agreement with Education and Leadership Foundation 7. Approve agreement with Southeast Fresno Community Economic Development Association, Inc. 8. Approve agreement with Fresno Unified School District Councilmember Chavez motioned to adopt the item as presented and to include in each agreement "up to" the amount appropriated and include payments in the form of installments. Councilmember Soria seconded the motion. Council Vice President Caprioglio stated he does not support the item due to the lack of time he had to review the supporting documents. Councilmember Bredefeld agreed with Council Vice President Caprioglio's comments and stated the only item he does not support is item C - Approve agreement with Fresno Building Healthy Communities. The motion carried by the following vote: Aye: 6 - Arias, Soria, Karbassi, Chavez, Bredefeld and Esparza No: 1 - Caprioglio C. ID Approve CARES Act expenditure and contracts for testing and tracing: 20-001069 1. ***RESOLUTION - Adopting the 12th Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $3,818,100 in CARES Act Funds for testing and tracing programs (Requires 5 affirmative votes) (Subject to Mayor’s Veto) 2. Approve agreement with Fresno Building Healthy Communities 3. Approve agreement with Fresno Economic Opportunities Commission 4. Approve agreement with North Fresno Primary Care, Inc. (Bautista Medical Group) Councilmember Chavez recused himself from the above item. The above item was continued to August 20, 2020. On motion of Councilmember Karbassi, seconded by President Arias, that the above Resolution be continued. The motion carried by the following vote: Aye: 6 - Arias, Caprioglio, Soria, Karbassi, Bredefeld and Esparza Recused: 1 - Chavez D. ID Approve CARES Act expenditure and contracts for small business relief: 20-001070 1. ***RESOLUTION - Adopting the 13th Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $2,000,000 in CARES Act Funds for small business relief (Requires 5 affirmative votes)(Subject to Mayor’s Veto) 2. Approve agreement with Fresno Area Hispanic Foundation Council Vice President Caprioglio proposed an amendment to the motion, that those who have previously asked for Paycheck Protection Program (PPP) funding and who have received it, will still be eligible to apply for the City of Fresno ***Subject to Mayoral Veto Page 4 City Council Meeting Minutes - Final August 17, 2020 funding and asked that it be open to all businesses. Council President Arias stated the item today is to only appropriate the money and the changes will be made and finalized at the August 27, 2020 Council Meeting. RESOLUTION 2020-179 ADOPTED On motion of Councilmember Soria, seconded by Councilmember Karbassi, that the above Resolution be adopted. The motion carried by the following vote: Aye: 7 - Arias, Caprioglio, Soria, Karbassi, Chavez, Bredefeld and Esparza Adjournment City Council adjourned at 4:59 P.M. in memory of Ray Robinson, the father of City Clerk Spence.
