MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road June 5, 2012 WORK MEETING The work meeting to discuss the 2012-2013 budget began at 6:10 PM. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Don Carroll, Craig Hill and Mayor Todd Stevenson. Council Members Bette Hubrich and Eileen Moss were excused. STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones and Recording Secretary Susan Cranford VISITORS: None City Manager Brandon Green discussed the Tentative Budget for 2012-2013 with the City Council. He stated the biggest challenge to the budget will be the Storm Water Fund. The county recommends that none of the cities in the county hold a Truth in Taxation Hearing this year because the county will be adjusting the property tax rate and the cities will be getting more property tax revenue. City Manager Green stated there are two storm water projects and one water project the city needs to do next year. The City Council will have to decide if both storm water projects can be budgeted. The city also needs to realign Hidden Valley Drive and the drive into Apple Acres to match the road in the Kaysville subdivision across Main Street. It was decided that City Manager Green and Mayor Todd Stevenson will meet later in the week to discuss the salary for the city manager. Mayor Stevenson will then make a recommendation to the City Council at the next City Council meeting. The City Council members questioned the amount ($10,500) that Fruit Heights annually pays to Kaysville for participation in joint city events such as the July 4th festivities. Kaysville representatives have stated they make enough money during the July 4th breakfast to fund the events. City Manager Green stated he will talk to Dean Storey, Finance Director for Kaysville, regarding the amount. The council stated they would like an accounting of the recreation and civic committee expenditures and revenues. The work meeting ended at 7:00 PM. 1 Fruit Heights City Council Meeting June 5, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:05 PM. The Pledge of Allegiance was recited and Todd Stevenson gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Don Carroll, Craig Hill and Mayor Todd Stevenson. Council Member Bette Hubrich entered the meeting at 7:30 PM. Council Member Eileen Moss was excused. STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: David Baird Agenda Item: 2. APPROVAL OF MINUTES OF MEETING – May 15, 2012 Council Member Don Carroll made a motion to approve the minutes of May 15, 2012. Council Member Craig Hill seconded the motion and it was approved unanimously by those in attendance. 3. SPECIAL PRESENTATIONS A. Fruit Heights LDS Stake Announcing the Dedication of the New Fruit Heights Meetinghouse Resident David Baird from the Fruit Heights LDS stake was present and invited the Fruit Heights Mayor and City Council to the Open House of the newest LDS building at 77 South Orchard Drive. The Open House will be held June 23 from 4 to 7 PM. The dedication of the building will be held June 24. Mayor Todd Stevenson stated that the new building is a great addition to the city. City Manager Brandon Green stated the new road (Peachtree Lane) connecting the church to Mountain Road should be completed in the next couple of weeks. B. Items from the Public No items from the public were presented. 2 Fruit Heights City Council Meeting June 5, 2012 4. PUBLIC HEARING Public Hearing on FY 2012-2013 Tentative Budget 1:01:57 Council Member Craig Hill made a motion to move into public hearing to discuss the 2012-2013 Tentative Budget. Council Member Don Carroll seconded the motion and it was approved unanimously by those in attendance. City Manager Brandon Green reviewed the Tentative Budget with the council. It is anticipated the city will generate $1,853,779 in revenue. The General Fund covers the operations of the city, parks and streets, police, fire and animal control services. The Capital Projects Fund expenditures total $429,597. There will be a transfer of $180,717 from the General Fund to the Capital Projects to help with projects in the city. The city will begin the third year of a five-year water plan. The base water rates will increase on July 1 from $24.50 to $27.00 per resident. The Sewer Fund is a pass-through fund that goes to the Central Davis Sewer District. The Storm Water Enterprise Fund will have two large projects next fiscal year. The Storm Water Utility fee is not generating enough to fund these projects. The Capital Projects Fund will help fund these projects. It may also be necessary to borrow money from the General Fund. The city is in the process of reviewing the storm water utility fee. The city is currently considering installing a recycling program which may affect the Solid Waste Fund. The only vehicle to be purchased next year will be a large mower. Capital projects proposed next year are:  The water line in the Little Canyon drainage area  Completion of Nicholls Road from Highway 89 to the Orchard Farms development  Complete the waterline loop at Eastoaks  Main Street water line  West Nicholls Road rebuild  1800 East storm drain upgrade  Country Road land drain  Nicholls Park trail  Upgrading sprinkling system There were no comments from the public. 3 Fruit Heights City Council Meeting June 5, 2012 Council Member Diane Anderson made a motion to close the public hearing. Council Member Don Carroll seconded the motion and it passed unanimously by those in attendance. 5. NEW BUSINESS A. Approve/Deny FY 2012 – 2013 Tentative Budget Council Member Craig Hill made a motion to approve the 2012-2013 tentative budget as presented by City Manager Brandon Green. Council Member Don Carroll seconded the motion and it passed unanimously by those in attendance. Council Member Bette Hubrich entered the meeting at this point. B. Discussion on FY 2012-2013 General Fund Budget Mayor Todd Stevenson announced the City Council discussed the General Fund Budget during tonight’s work meeting. C. Discussion on FY 2012-2013 Salaries and Wages City Manager Brandon Green stated a wage increase is scheduled for employees of the city. He will take 2.5 percent of the total of wages and distribute it according to merit to the employees. An increase is not proposed for the Mayor and City Council members. D. Discussion on Amendments to the FY 2011-2013 Budget 1:24:29 City Manager Brandon Green stated the bore work under Highway 89 at Nicholls was not in the budget. The final payment for the Mountain Road project needs to be made. Those payments will come out of the General Fund. Final adjustments will be made at the next City Council meeting. E. Discuss/Approve/Deny Firework Ordinance 1:28:50 Mayor Todd Stevenson stated temporary fire ordinances have been adopted previously in the city, based on how dry conditions are. Tonight staff is proposing a fireworks ordinance for this year. City Manager Brandon Green stated he would like a permanent fireworks ordinance in the city but the proposal presented to the council tonight will be in effect until the end of November 2012. He stated he is concerned because of the dry season and the likelihood of a fire on the hillside. The ordinance prohibits fireworks on the east side of Mountain Road including all the areas north of 400 North and east of Highway 89. 4 Fruit Heights City Council Meeting June 5, 2012 The council discussed the possibility of extending the prohibition along the Baer Canyon Hollow. It was decided to adopt the ordinance tonight as presented and restrict additional areas at the next City Council meeting if staff or council members deem it necessary. Council Member Don Carroll made a motion to approve Ordinance 2012-06 prohibiting the discharge of fireworks within specified areas of Fruit Heights City. Council Member Diane Anderson seconded the motion and it passed unanimously by those in attendance. D. Discussion on Appointment of Two Planning Commissioners Council Member Craig Hill stated the terms of Planning Commissioners Susan Hunt and Kristi Bybee will expire on July 1. They have indicated they would like to reapply. Mayor Todd Stevenson requested those positions be advertised in the RidgeRunner or with the next utility billing. 6. OLD BUSINESS 1:48:10 Discuss/Approve/Deny Title 3A – Administration/Ordinance 2012-04 Mayor Todd Stevenson stated this section of the ordinance has been discussed by the City Council members previously, but the requested changes were not shown in the ordinance presented to the council tonight. City Engineer Brandon Jones stated he has not reviewed the proposed ordinance. This item was tabled. 7. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report City Engineer Brandon Jones reported he met with Chris Peterson, Region 1 Director for UDOT, regarding the Hidden Valley Drive realignment at Main Street. It is estimated it will cost $31,600 to install a center median on Main Street. Ivory Homes has indicated they may be willing to participate in the expenditure to correct the problem. The solution to the alignment problem is not final. Mayor Todd Stevenson stated Kaysville may be willing to participate in the funding also. A Storm Water Committee meeting will be held tomorrow at 5 PM. B. City Planner’s Report 5 City Planner Jeff Oyler stated the moratorium on the R-3 Zone will be lifted soon. The Planning Commission will be holding a public hearing on the proposed R-3 Zone. He Fruit Heights City Council Meeting June 5, 2012 will bring the proposed zone to the City Council for their review prior to the public hearing. He will make some recommendations on the locations to include in the new Green Space Ordinance. A developer has purchased the old motel property on Lloyd Road and will bring in a proposal for the property. C. City Manager’s Report City Manager Brandon Green reported he met with Ross and Pat Mann, chairmen of the Founders Day Picnic that will be held August 4. The Davis County Health Department has required the city obtain a mass gathering permit because the annual picnic exceeds two hours and has over 500 people in attendance. It will be necessary to have more bathroom facilities available and paramedics in attendance. D. City Council Members’ Reports Council Member Bette Hubrich reported the Trails Committee met last week and they were presented a preliminary plan for the trail in the Baer Canyon Hollow prepared by resident Curtis Tanner. Five Kaysville residents attended the meeting and they are concerned about a trail in their back yard. A few of them stated their property line goes to the creek and their homeowners association does not allow them to install a fence. The Davis High Cross Country team is concerned about the trail and options are still being considered. She requested the recommendation from Mayor Todd Stevenson for seven permanent members on the committee. Mayor Stevenson requested Scott Hess be invited to the meeting when the public hearing for the trails is held. He also said the city doesn’t want to defeat the purpose of the trail to accommodate the cross country team. Council Member Don Carroll inquired when paving will be done on city streets to replace pavement that has been torn up. City Manager Brandon Green stated he is waiting for money to make the repairs. Council Member Carroll stated he is impressed with the new monument sign placed at the bottom of Nicholls Road. City Manager Green stated he would like to have two or three more identical monuments at different locations in the city. Council Member Diane Anderson reported eight volunteers are assisting Ross and Pat Mann with the Founders Day Picnic. E. Mayor’s Report Mayor Todd Stevenson requested recommendations for this year’s Unsung Hero from the council members. 8. CLOSED MEETING 6 A closed meeting was not held.
