Also in attendance were Town Manager Adam Mitchell, Assistant Town Manager Mark Matthews, Assistant Town Manager Jim Seymour, Town Attorney James Adcock, Deputy Town Clerk Eva Mayfield, IT Director Scott Clark, and various other department directors. Town Clerk Teresa Wilder was on vacation. CALL TO ORDER Mayor Massengill called the meeting to order at 7:02 pm. INVOCATION AND PLEDGE Commissioner Bryan Haynes provided the invocation, and Commissioner Jason Wunsch led the Pledge of Allegiance. VIRTUAL MEETING PROTOCOL Town Manager Mitchell reviewed the meeting protocol, noting that it was in-person and live-streamed on the Town’s YouTube Channel and Facebook Page. APPROVAL OF MINUTES 3A The June 2, 2025, Town Board of Commissioners Regular Scheduled Meeting. MOTION: Commissioner Adcock SECOND: Mayor Pro-Tem Gardner MOTION RESULTS: Passed Unanimously (5-0) PRESENTATIONS 4A Recognition - Scholarship Recipients - Black History Stakeholders Committee - Connor Everett and Ja'Navia Royal Purpose – To recognize the recipients of scholarships provided by the Black History Stakeholders Committee, as a result of the Gospel Showcase performance. On February 1, 2025, the Black History Stakeholders Committee presented The Gospel Showcase, an evening of gospel music featuring local church groups and community singers. Ticket sales, sponsorships, and donations to the event resulted in revenue of $2,000, which the Committee chose to turn into two scholarships for local high school seniors. Katyna Bunn took a leading role, working with other Committee members, in drafting an application and developing criteria used to judge applications. Ja'Navia Royal graduated from Fuquay-Varina High School this spring and will be attending North Carolina Agricultural and Technical State University, majoring in Information Technology. Connor Everett is in attendance at North  Carolina Central, having graduated from Fuquay Varina High School. In addition to playing football, Connor intends to major in Criminal Justice. Mayor Massengill expressed his enthusiasm for the future, noting that lifelong learning is a constant journey. He congratulated the two young adults as they prepare to embark on their college careers, marking an exciting new chapter in their lives. The Mayor also took a moment to express his appreciation for the Black History Stakeholders group, which has been instrumental in sharing the rich history of Fuquay-Varina with its residents. This year's gospel showcase was a resounding success, and the group was able to award two scholarships to deserving students. Mayor Massengill extended his gratitude to Orlean Newton for her tireless efforts and dedication to the committee and wished the scholarship recipients all the best as they begin their collegiate journey. 4B Employee Recognition - Police Department Purpose – To recognize police department employees for professional development achievements. Corporal Kevin Bissette, Master Officer Salvatore Fundaro, Master Officer Bryan Williscroft, and Police Officer I Shane Perrault will be recognized for reaching milestone achievements in professional development. Mayor Massengill expressed his enthusiasm for the Police Department, stating that he takes great pride in their achievements, along with the rest of the Town Board. He highlighted Fuquay-Varina's reputation as one of the safest communities, citing outstanding results from the Town's Customer Survey, which demonstrates high citizen satisfaction with the police force. The Mayor commended the department for  their dedication to ongoing education and professional development, thanking them for their hard work in serving the community. He reaffirmed his and the Town Board's strong support for the Police Department, acknowledging the valuable contributions they make to Fuquay-Varina. PUBLIC HEARINGS 7A Voluntary Annexation Petition - Mark Medlin, Three Blooms Farms, LLC, 8514 Purfoy Road - PIN 0666613612 - ANX-2025-08 Purpose – To consider approving an annexation ordinance extending the corporate limits of the Town of Fuquay-Varina following receipt of a petition for voluntary annexation of property located at 8514 Purfoy Road owned by Mark Medlin, Three Blooms Farms, LLC, PIN 0666613612, containing approximately 24.5204 acres. Staff Comments – Planning Director Pam Davison submitted the agenda abstract and supporting documents to the town's official record. She then presented the staff report, which is attached hereto. Public Hearing – The public hearing was opened. No one spoke in favor or opposition to the voluntary annexation petition.  Discussion – There was no discussion from members of the Town Board regarding this matter. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Mark Medlin, Three Blooms Farms, LLC (ANX-2025-08) as presented and recommended. Joint Resolution - Condemn Property - Sanford WFF Conveyance Waterline - Town of Fuquay-Varina and Town of Holly Springs (Item was removed for the recusal of Commissioner Adcock) Purpose – To consider adoption of a joint resolution instructing the Town Attorneys for the Town of Fuquay-Varina and Town of Holly Springs to begin condemnation proceedings to acquire permanent and temporary construction public utility easements for the Sanford Waterline Conveyance Project. The Town of Fuquay- Varina and the Town of Holly Springs will jointly own these easements. Recommendation – Adopt the joint resolution authorizing the Town of Fuquay-Varina Town Attorney and the Town of Holly Springs Town Attorney to proceed with condemnation proceedings to acquire permanent (PUE) and temporary construction public utility easements for properties as required for the Sanford Conveyance Waterline Project as presented and recommended. Resolution No. 25-1927 8B. Resolution - Condemn Property - Town of Fuquay-Varina Portion - Sanford Project Waterline Purpose – To adoption of a resolution instructing the Town of Fuquay-Varina Town Attorney to begin condemnation proceedings to acquire permanent and temporary construction public utility easements on behalf of the Town of Fuquay-Varina for the Sanford Waterline Conveyance Project. Recommendation – Adopt the resolution authorizing the Town of Fuquay-Varina Town Attorney to proceed with condemnation proceedings to acquire permanent and temporary construction public utility easements for properties as required for the Sanford Conveyance Waterline Project, as presented and recommended. Resolution No. 25-1928 8C. Utility Allocation Request - Southland Preserve Subdivision (48-Lots) Purpose – To consider a Utility Allocation Request for Southland Preserves Subdivision. Recommendation – Approve the recommended utility allocation request for Southland Preserves Subdivision (48 Lots) as presented and recommended. 8D. Utility Allocation Request - Harvest District (56 Lots) Purpose – To consider a Utility Allocation Request for the Harvest District mixed-use development.  Recommendation – Approve the recommended utility allocation request for Harvest District (56 Lots) as presented and recommended. 8E. Municipal Agreement, Project Ordinance, and Budget Amendment (BA-26-01) - NCDOT Project HL-0008G - $30,000 Purpose – To consider approval of the Utility Construction Agreement for reimbursement for a portion of the cost of relocating water utilities relating to the NCDOT HL-0008G Project. Recommendation – 1. Approve the proposed Utility Construction Agreement between the Town of Fuquay-Varina and the North Carolina Department of Transportation (NCDOT) as presented and recommended and authorize the Town Manager to execute the Agreements. The agreements have been reviewed by the Town Attorney as to form and are in the best interest of the public. 2. Approve the Project Ordinance for the Utility Construction Agreement as presented and recommended. 3. Approve Budget Amendment BA-26-01 to fund the Utility Construction Agreement as presented and recommended. Ordinance No. N-25-32 8F. Minor Subdivision Plat - Flag Lot - Mauldin Watkins Surveying - 8009 Kensington Drive - SUB-MN-2025-06 Purpose – To consider a proposed flag lot submitted by Mauldin Watkins Surveying, located at 8009 Kensington Drive.  Recommendation – Approve the proposed flag lot located at 8009 Kensington Drive as presented and recommended. 8G. Recreation Fee-In-Lieu – Southland Preserves Subdivision - SUB-PR-2024-11 Purpose – To consider acceptance of a fee-in-lieu for Recreation Unit Fees for the Southland Preserves Subdivision for $176,070.24. Recommendation – Approve the fee-in-lieu request for the Southland Preserves Subdivision for $176,070.24 for Recreation Unit Fees as presented and recommended. 8H. Pay and Classification Adjustments - BA 26-02 Purpose – To amend the FY 2026 General and Utility Operating Funds' budgets to allocate pay and classification adjustments recommended by the consultant. Recommendation – Approve Budget Amendment (BA 26-02) as presented and recommended. 8N. FY 26 Pay Grade and Position Classification Schedule Amendment Purpose – To consider an amendment to the previously adopted pay grade and position classification schedule for FY 2026. Recommendation – Approve the presented amendment to the FY 2026 pay grade and position classification schedule as presented and recommended. 8O. Project Ordinances and Project Ordinances Amendments - Capital Projects Purpose – To consider adoption of the FY 2026 General and Water & Sewer capital project ordinances and project ordinance amendments (POAs) to implement the FY 2026 Adopted Capital Improvement Plan. Recommendation – Approve the FY 2026 General and Water & Sewer capital project ordinances and project ordinance amendments, POA 26-01 and POA 26-02 as presented and recommended. Special Event and Amplified Sound Permit - Mason Jar Lager Co. - Live Band Event - July 26, 2025 Purpose – To consider approval of a Special Event Application and Amplified Sound Permit for the Mason Jar Larger Co. to host a live band event scheduled for Saturday, July 26, 2025. Recommendation – Approve the Special Event Application and Amplified Sound Permit for Mason Jar Lager Co. Live Band event on July 26, 2025, as presented and recommended. 8Q. Fire Station #4 Utilization Agreement - Wake County Purpose – To consider approval of a Utilization Agreement between the Town of Fuquay-Varina and Wake County for the County’s use of a portion of Fuquay-Varina Fire Station #4 for Wake County Emergency Medical Services operations with a term of 40 years. Recommendation – Approve the Utilization Agreement with Wake County for the County’s use of a portion of Fuquay-Varina Fire Station #4 to provide Wake County Emergency Medical Services operations for a term of 40 years with shared maintenance and operational facility costs, subject to Town Attorney review as to form. 8R. Agreement for Purchase and Sale of Real Property and Budget Amendment BA-26-03 - 0 Ellis Street (PIN 0656971982) Purpose – To consider the approval of an Agreement for Purchase and Sale of Real Property for 0 Ellis Street (PIN 0656971982) and approve budget amendment BA-26- 03. Budget amendment BA-26-03 appropriates $1,200,000 to cover the purchase of the property and any expenses related to due diligence. Recommendation – Approve the Agreement for Purchase and Sale of Real Property for 0 Ellis Street as recommended and presented subject to Town Attorney review to form, authorize the Town Manager to execute the agreement on the Town's behalf, and approve budget amendment BA-26-03. MOTION: Commissioner Wunsch SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (5-0) OTHER BUSINESS 11.A Management Report Town Manager Adam Mitchell gave the following additional updates: He reported that the departments have been wrapping up the procedural work for the end of the fiscal year and getting the procedural process started for the next fiscal year 2026 on July 1st. o Public Works – The annual Powell Bill certification was submitted by the Town on July 1, 2025. Powell Bill is where the Town gets funding for maintenance and repair of Town streets and public sidewalks. The Town added 7.3 miles of Town streets last fiscal year, bringing the total maintained street mileage to 183.75 miles of Town streets. This number does not include NCDOT streets. o Arts Center – The Art Center dance team recently traveled to Walt Disney World. The younger dancers marched in a parade at Disney Springs and the older dancers represented North Carolina in the Dance the World Parade on June 29, 2025. Dance team member Jay Argenal earned a slot at the National Dance Honors Convention, where he won first place this past weekend. o Police Department – The Junior Police Academy kicked off today, launching a week-long program with 20 young participants. The Fuquay-Varina Police was  well represented at the annual Crisis Intervention Team luncheon on June 17, 2025. Officer Zachary Stombaugh and Officer Ethan Henderson were awarded the Crisis Invention Team Officer of the Year Award and Lieutenant David Hinton was awarded the Crisis Invention Team Coordinator of the Year Award. Police Chief Smith was also recognized as Wake County Crisis Intervention Team Executive of the Year. He thanked them for the great work, and this external recognition validates the Fuquay-Varina Police Department’s commitment to training and being prepared to respond and support individuals experiencing a mental health crisis. He reported that Police Chief Smith was a guest on a podcast called Words of the Wise by Firstevity. The podcast was hosted by Paige Arnwin. They spoke regarding officers’ wellness on the podcast. The episode will go live on October 3, 2025. o Fire Department – The Fire Department has received over 100 applications for the non-certified firefighter positions. Three offers have been made and accepted and the candidates will attend the Central Carolina Community College Fire Academy in Sanford and are scheduled to graduate in February 2026. They also received 85 applications for the certified firefighter vacancy and the agility test and written exams will be administered over the next month for a start date of September 8, 2025, for the new recruits. He informed the Town Board that the Police and Fire Citizens Academies were highlighted and featured in the latest edition of Suburban Living. o Planning Department – Code Compliance Officer Jim Goral has successfully passed his North Carolina Plumbing Inspector Level I exam. o Engineering Department – The Department has received funding from the Federal Highway Administration to proceed with construction of the Alston Ridge to the Bass Lake Park in Holly Springs. Construction is currently scheduled to begin in October and is expected to take 12 to 18 months to complete. o Inspections Department – Justin Daniel passed his Level II Mechanical State exam and Chris Thompson passed his Level III Building State exam. Tom Keating retired from the Town on July 8, 2025. o Public Utilities – Dwight Parrish passed his Maintenance Technologist Level III exam. o Management has been working to follow the work of the North Carolina Legislature before they recess and evaluate positive and negatives that could affect the Town of Fuquay-Varina and will bring it to the Town Board if need be. o He noted that he and staff met with Representative Paré, representative of the NC DMV and representative of the Wake County Public School System to discuss the improvement process and possible expansion/relocation of the DMV office. One concept that has been discussed is moving the DMV to the Media Center building at the former Fuquay-Varina Middle School. These conversations are very early and would require some partnership and agreement between both DMV and the school system. o He mentioned that there has been a NC Main Street site visit since the last Town Board meeting. Representatives from the North Carolina Main Street program visited Fuquay-Varina to meet with the Mayor, management, and staff to discuss the great work that the FVDA and the Town are doing to continue boosting and generating excitement around our downtown. o He remarked that there have been some meetings for obtaining the Interbasin Transfer Certificate which is necessary for water purchase for future years. It takes between 8-10 years to get the certificate. o He noted that he and the Mayor had a great meeting with the Indian Association of Fuquay-Varina. They are looking to become more engaged and interactive in the community and do more in Fuquay-Varina. o He explained that they are making progress for the issuance of the balance of the $20 million GO Transportation Bonds.  o He added that the Independence Day Celebration was a huge success, and the Governor of North Carolina attended the celebration. o He informed the Town Board that the Communication Department has put together a new resident guide and wanted to thank Communication Director Susan Weis and Alex Baumann for their hard work on the guide. 11.B Police Department - Bowling Tournament – Saturday, July 19, 2025 - 1:00 - 4:00 pm - Buffaloe Lanes South - 6701 Fayetteville Road 11.C Ice Cream Social – Sunday, July 20, 2025 - 4:00 - 6:00 pm - Fuquay Mineral Spring Park 11.D No Town Board Meeting – Tuesday, July 22, 2025 11.E National Night Out Against Crime - Fuquay-Varina Police Department – Tuesday, August 5, 2025 - 5:00 - 8:00 pm 11.F Zoning Map Amendment - Nicole Johnson, Hazen & Sawyer - 6305 Duncan Cook Road - PIN 0636998066 - REZ-2025-06 - (Davison) - (FIRST READING) BOARD MEMBER COMMENTS Commissioner Harris offered his apologies for being unable to attend the June 2, 2025, Town Board meeting, citing a family memorial service as the reason for his absence. In his remarks, he noted that concerns had been raised regarding inconsistent speed limits on Hilltop Needmore Road, with a request made for uniform speed limits along the route. Town Manager Mitchell provided an explanation, highlighting that the road falls under the jurisdiction of the North Carolina Department of Transportation (NCDOT). Commissioner Harris requested to be kept informed about any developments or outcomes related to this matter. On a separate note, he expressed his enthusiasm and appreciation for the success of the recent 4th of July event, describing it as "amazing". Commissioner Adcock had no comments. Commissioner Wunsch reflected on the recent 4th of July celebration. He shared some exciting news about local talent. A NC State graduate from Fuquay-Varina has achieved a major milestone by being drafted into the major leagues. Notably, this individual is part of a growing trend, since 2022, a total of 7 people from Fuquay-Varina have been drafted, highlighting the community's impressive athletic achievements. Commissioner Haynes expressed his gratitude to all individuals involved in the recent events, acknowledging the important role each person played in their success. He specifically thanked the volunteers who helped with feeding the children at the Pine Acres Community Center, highlighting the significant need for such programs during the summer months when school is out and many kids may go without meals. Commissioner Haynes also reflected on the 4th of July celebration, noting how wonderful it was to see the community come together and enjoy themselves. Additionally, he commended Firefighter Maddox for her outstanding singing of the National Anthem. Mayor Pro-Tem Gardner echoed the 4th of July event, stating it was a great event. Mayor Massengill praised the recent 4th of July celebration, particularly highlighting Firefighter Maddox's impressive performance singing the National Anthem. He extended his appreciation to all town staff who contributed to the event's success. The Mayor also reported on his attendance at the Pints with a Pack Alumni Event at Mason Jar, which drew a record-breaking crowd of over 500 people. Additionally, he congratulated Arts Center Director Daly and her team on the successful Manifest Juneteenth celebration, thanking them for their tireless efforts. Furthermore, Mayor Massengill mentioned that he and the Town Manager had met with representatives from the Indian Association of Fuquay-Varina to explore potential partnership opportunities. The discussion focused on ways to promote cultural awareness and inclusion within the community, as well as collaboration on future events.
