Assistant Town Manager Jim Seymour was on vacation. CALL TO ORDER Mayor Massengill called the meeting to order at 7:01 pm. INVOCATION AND PLEDGE Commissioner Charlie Adcock provided the invocation, and Arts Center Dance student Jay Argenal led the Pledge of Allegiance. VIRTUAL MEETING PROTOCOL Town Manager Mitchell reviewed the meeting protocol, noting that it was in-person and live-streamed on the Town’s YouTube Channel and Facebook Page. APPROVAL OF MINUTES 3A The July 14, 2025, Town Board of Commissioners Regular Scheduled Meeting. MOTION: Mayor Pro-Tem Gardner SECOND: Commissioner Adcock MOTION RESULTS: Passed Unanimously (5-0) PRESENTATIONS 4A Recognition - Jay Argenal Purpose – To recognize Jay Argenal, the winner of the 2025 Minis National Dance Honors. In September of 2023, Jay Argenal joined the cast of the Community Nutcracker production; Jay was new to dancing and new to the Arts Center. Since that time, he has taken multiple classes at the Arts Center with a variety of instructors, he has participated in the Nutcracker, and he has participated as a member of the competitive dance team for two years. Jay was invited to compete at National Dance Honors in Orlando in July of this year. He was one of 60 invited dancers in the Minis category--Minis referring to dancers aged 8 to 10. On July 8th the Arts Center hosted a watch party for members of Jay's family and friends to watch him compete in the first round of the competition. His performance placed him in the top 10 finalists. Further competition included completing 7 auditions (one in each dance genre-ballet, hip hop, jazz, tap, etc.), dancing a competitive solo and attending general workshop classes. Jay's total scores from all the activities were combined for a final score which identified him as winner of the Minis National Dance Honors. He is awarded free tuition to attend a variety of dance conventions through 2027, travel fees, an opportunity to assist teachers in classes for his age group, and additional study and Master classes. The Fuquay-Varina Arts Center is pleased to be Jay's home studio; we celebrate his accomplishments and wish him nothing but the best as his dance journey continues. Jay Argenal expressed his heartfelt gratitude to the Town of Fuquay-Varina for providing him with the opportunity to flourish as a dancer and mature as a young individual. He emphasized the vital role that the dance team plays in the lives of local children, serving as a valuable outlet for self-expression and personal growth. Jay voiced his hope that the Town will continue to support and invest in the dance program, recognizing its positive impact on the community's youth and his own development as a dancer. Mayor Massengill stated it was an absolute pleasure to spend time with Jay this evening. He advised that he had the chance to meet him before at a board meeting, and was impressed by his outstanding performances at the Arts Center, including The Nutcracker. As a small token of appreciation, Mayor Massengill presented Jay with a special Mayor's coin, designed by a talented local artist from the Arts Center. Mayor Massengill stated that he was not alone in his admiration for Jay - everyone at the meeting is incredibly proud of him, and excited to see what the future holds for this talented young man. 4B Proclamation - National Farmers Market Week Purpose – For Mayor Massengill to present a proclamation recognizing National Farmers Market week in Fuquay-Varina. National Farmers Market Week is August 3-9, 2025! Now in its 26th year, this annual celebration highlights farmers' markets' vital role in our nation’s food system. The week helps boost market attendance and visibility and showcases the value markets bring to communities. Mayor Massengill highlighted Fuquay-Varina's rich agricultural heritage, noting that the Town's roots are deeply rooted in farming. He praised the outstanding team behind the weekly Growers Market, which takes place every Saturday at the Chamber of Commerce parking lot. The Mayor enthusiastically encouraged residents and visitors to explore the market, where they can discover a wide range of exceptional local products. To recognize the individuals who make the market a success, he introduced Marge Moreton, the dedicated Market Manager, and Dana Orr, who plays a key role in supporting the Growers Market, inviting everyone to meet them and learn more about the great work they do. He then read the proclamation. PUBLIC COMMENTS 5A Emily Holloway, 312 Angier Road, addressed the meeting to express her concerns about several safety-related issues in the community. Randy Allison, 7212 Kennebec Road, Willow Springs, Robert Stevenson, 7210 Kennebec Road, Willow Springs, Rick Rich, 1709 Quail Grove, St., Willow Springs, and Joyce Norini, 1705 Quail Grove St., Willow Springs all spoke in opposition to the voluntary annexation petition. Discussion – Mayor Massengill took a moment to educate the public on the annexation process, emphasizing that the Town of Fuquay-Varina cannot forcibly annex any properties. He clarified that annexation can only occur through a voluntary process, where property owners themselves must initiate and request to be annexed into the Town. In other words, the decision to become part of the Town's boundaries must come from the property owners themselves and not be imposed by the Town. Mayor Massengill clarified that this hearing was focused on annexation, where a property owner has elected to voluntarily join the Town limits of Fuquay-Varina. The primary consideration for the Town Board's decision tonight is whether Fuquay- Varina can provide necessary services to the property, specifically determining if water and sewer infrastructure are available. Mayor Massengill explained that the property in question was not actually part of the Town of Willow Springs, because Willow Springs is not a formally incorporated town. Rather, it is a postal designation, referring to the local post office that serves the area. As a result, residents and businesses in the surrounding area receive mail addressed to "Willow Springs", regardless of their actual municipal affiliation. The Mayor noted that even if a parcel in this area is annexed into Fuquay-Varina, its mailing address will still be listed as Willow Springs. Mayor Massengill confirmed that the Town's Engineering Department, in conjunction with Planning, reviews and verifies that all development plans are designed by licensed professionals and comply with Fuquay-Varina's ordinances and guidelines. Engineering Director Matt Poling elaborated on the stormwater management requirements for subdivisions that meet a certain density threshold, explaining that the Town mandates the installation of stormwater control devices to mitigate runoff. These devices capture and slowly release water into a pond, allowing it to attenuate quickly before being discharged downstream at a controlled rate, mimicking the natural flow. Mayor Massengill emphasized that state law necessitates the installation of these devices, and the Engineering Department ensures that they are properly designed and implemented to meet regulatory standards. Commissioner Harris inquired about potential future safeguards that would be put in place as the development process moves forward. Mayor Massengill questioned whether a rezoning of the property would be necessary. Planning Director Pam Davison clarified that the property is already zoned for residential medium density, and the proposed subdivision plan, which has already been approved by the Town Board, calls for conventional lots with a minimum size of 10,000 square feet. She indicated that no additional rezoning would be required, as the development aligns with the existing zoning designation. Recommendation – Adopt the annexation ordinance to extend the corporate limits of the Town of Fuquay-Varina to include property owned by Glenn Futrell, Stephens Road Partners, LLC (ANX-2025-11) as presented and recommended. Roadway Fee-In-Lieu - Coley Preserve Subdivision Project Purpose – To consider approval of a Roadway Fee-In-Lieu payment for roadway improvements related to the Coley Preserve Subdivision Project in the amount of $862,638.09. Recommendation – Approve a Fee-In-Lieu for roadway and utility improvements associated with the Coley Preserve Subdivision Project in the amount of $862,638.09, with $54,505.00 allocated to the Town’s Water Fee-In-Lieu account and the remaining $808,133.09 allocated to the Northwest Roadway Fee-In-Lieu District account as presented and recommended. 8B. Roadway Improvements Exemption Request - Christ Church Development - 8316 Lake Wheeler Road Purpose - To approve a roadway exemption request for the Christ Church Development, located at 8316 Lake Wheeler Road, from all Town required roadway improvements required by the Town's 2040 Comprehensive Transportation Plan (CTP) and the Town's Engineering Standards and Specifications, in accordance with the provisions of the Town Land Development Ordinance (LDO) prior to the April 7, 2025, LDO update. Recommendation – Exempt the Christ Church Development located at 8316 Lake Wheeler Road from all Town required roadway improvements identified in the Town’s 2040 Comprehensive Transportation Plan and the Town's Engineering Standards and Specifications in accordance with the ordinances prior to the April 7, 2025, Town’s Land Development Ordinance amendment to Article Q, Section (10). 8C. Budget Amendment - Sewer Line Repairs - BA-26-05 - $400,000 Purpose – To consider approving a budget amendment to fund the expenses of emergency forcemain repairs. Recommendation – Approve Budget Amendment BA-26-05 as presented and recommended. 8D. Budget Amendment - Appropriate Insurance Proceeds - Capital Equipment - Police Department - BA-2026-05 - $24,704 Purpose – To consider a budget amendment recognizing insurance proceeds for an officer-involved collision (Unit 187). Recommendation – Approve Budget Amendment BA-2026-05 as presented and recommended. 8E. Budget Amendment - Recognize Donation - Officer Wellness Programs - BA-2026- 06 - $700 Purpose – To consider recognizing a donation received from the auction of a Carolina Hurricanes jersey to support the police department's Officer Wellness Programs. Recommendation – Approve Budget Amendment BA-2026-06 as presented and recommended. 8F. Budget Amendment - Appropriate General Fund Balance - Police Department - BA- 2026-07 - $60,000 Purpose – To consider the appropriation of General Fund Balance for Police Department Miscellaneous Project-front and rear door replacement. Recommendation – Approve Budget Amendment BA-2026-07 as presented and recommended. 8G. Fee Schedule – Amendment Purpose – To consider a fee schedule amendment to correct annual fitness membership fees. Recommendation – Approve the Fee Schedule Amendment as presented and recommended. MOTION Commissioner Adcock SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (5-0) ITEMS REMOVED FROM CONSENT 9A There were no items removed from the Consent Agenda for separate consideration. ADMINISTRATIVE REPORTS 10A Town of Fuquay-Varina Strategic Plan - 2025-2029 Purpose – To consider approval of the Town of Fuquay-Varina 2025-29 Strategic Plan. Staff Comments — Town Manager Adam Mitchell submitted the agenda abstract and supporting documents to the town's official record. He then presented the staff report, which is attached hereto. Discussion— Mayor Massengill acknowledged the significant effort that has gone into creating this document, which was guided by the Town Board's direction. He emphasized that the core values of Fuquay-Varina remain a top priority, and this document plays a crucial role in ensuring that these values are upheld. Additionally, Mayor Massengill noted that the document serves as a vital tool for all Town departments, providing clear guidance on their objectives and helping to ensure success in securing grants and other funding opportunities. Commissioner Haynes expressed his gratitude to the town's management team and directors, acknowledging that they had carefully considered the Town Board's input and priorities. He noted that the resulting document provides a clear roadmap for the Town's future growth and development, giving citizens a sense of direction and vision for what Fuquay-Varina will look like in the years to come. Recommendation – Adopt the 2025-2029 Town of Fuquay-Varina Strategic Plan as presented and recommended. MOTION: Commissioner Haynes SECOND: Commissioner Adcock MOTION RESULTS: Passed Unanimously (5-0) 10B Lease of County Property - Willow Springs Future Town Park - 7069 Kennebec Road Purpose – To consider a lease agreement of County property, with the Wake County Board of Commissioners, for development of a future town park adjacent to Willow Springs Elementary School. Staff Comments — Assistant Town Manager Mark Mattews submitted the agenda abstract and supporting documents to the town's official record. He then presented the staff report, which is attached hereto. Discussion— Mayor Massengill reflected on the origins of the project, noting that Town staff had first identified the property as an opportunity for expansion over a year ago. He expressed appreciation for the action taken by staff to bring the proposal to the board, which would enable the Town to grow its park resources. The Mayor highlighted the location of the property, situated near existing subdivisions and the potential for future ball fields, which would support the Town's sports programs. He acknowledged the competing demands for land use in the area but was pleased that staff had worked diligently to bring the project to this point. Mayor Massengill stated that he looks forward to seeing the development of the property, including the potential for new fields and amenities, which would be presented to the board by Parks and Recreation Director Jonathan Cox at a future Town Board meeting. Recommendation – Approve a lease agreement for County property, with the Wake County Board of Commissioners pursuant to NCGS 160A-274, for Wake County PIN # 0677907665, subject to Town Attorney review as to form. MOTION: Mayor Pro-Tem Gardner SECOND: Commissioner Wunsch MOTION RESULTS: Passed Unanimously (5-0) 10C Contract Award, Budget Amendment, and Project Ordinance Amendment - Alston Ridge Greenway Purpose – To approve a Budget Amendment and Project Ordinance Amendment in the amount of $700,000 and award a contract to Cardinal Civil Contracting, LLC for $1,557,963.00 to construct the Alston Ridge Greenway (BL-0092) project. Staff Comments — Engineering Director Matt Poling submitted the agenda abstract and supporting documents to the town's official record. He then presented the staff report, which is attached hereto. Discussion— Mayor Massengill sought clarification on the term "NCDOT non- responsive pre-qualified". Engineering Director Matt Poling explained that, in order to bid on North Carolina Department of Transportation (NCDOT) projects, a contractor must first meet certain qualification standards and be pre-approved by NCDOT. This pre-qualification process ensures that only qualified and capable contractors are eligible to participate in the bidding process for NCDOT projects. Commissioner Adcock inquired about potential plans to connect the Sunset Bluffs neighborhood to the proposed greenway. Engineering Director Poling replied that there are currently no plans to make such a connection. Town Manager Mitchell added that Sunset Bluffs already has an existing access path to the Bass Lake Trail, which allows the public to walk through the subdivision and connect to the trail. Commissioner Adcock suggested that this pathway should be included on the Town's GIS system for better visibility and awareness. Town Manager Mitchell clarified that the path is not a publicly maintained greenway, but rather a privately maintained trail by the Sunset Bluffs Homeowners Association (HOA), which is why it may not be reflected on the Town's GIS mapping, but he would take it into consideration.  Mayor Massengill expressed his enthusiasm for the project, noting that it presents a valuable opportunity for the Town, particularly with the securing of federal funding. He highlighted that greenways are the top priority for expansion among park amenities, as identified by citizen feedback, and this initiative aligns with the community's desires. Recommendation – 1) Approve a Budget Amendment (BA-26-04) in the amount of $700,000 and corresponding Project Ordinance Amendment (POA-26-03); and 2) Award a contract for the construction of the Alston Ridge Greenway Project (BL-0092) to Cardinal Civil Contracting, LLC in the amount of $1,557,963.00 and authorize the Town Manager to execute the contract on behalf of the Town, subject to the Town Attorney's review as to form. Ordinance No. N-25-45 MOTION: Commissioner Wunsch SECOND: Commissioner Adcock MOTION RESULTS: Passed Unanimously (5-0) 10D Fuquay Avenue and Raleigh Street - ADA Roadway Improvements Purpose – To authorize management and staff to proceed with advancing the Fuquay Avenue and Raleigh Street - ADA Roadway Improvements Project. Staff Comments — Engineering Director Matt Poling submitted the agenda abstract and supporting documents to the town's official record. He then presented the staff report, which is attached hereto.  Discussion— Town Manager Mitchell sought clarification from the Town Board regarding a project discussed during their retreat, which was not initially included in the approved FY26 budget. Given new details on design and cost, management wanted to confirm whether the Board still wished to move forward with the project and, if so, provide staff with direction to proceed with soliciting bids. Mayor Massengill noted this project is a key component of the Town's downtown master plan and will significantly enhance the intersection. The presence of the Arts Center, which attracts a high volume of visitors, necessitates accessible and convenient entry and exit points, including handicap-accessible ramps and flat sidewalks. Mayor Massengill highlighted that the new crosswalks would have a profound impact on the community, addressing concerns raised by residents regarding sidewalk locations and demonstrating the Town's ongoing commitment to investing in pedestrian infrastructure at multiple sites. Recommendation – Authorize management and staff to proceed with advancing the Fuquay Avenue and Raleigh Street - ADA Roadway Improvements Project as presented and recommended. MOTION: Commissioner Haynes SECOND: Commissioner Harris MOTION RESULTS: Passed Unanimously (5-0) OTHER BUSINESS 11.A Management Report Town Manager Adam Mitchell gave the following additional updates: o He noted that the Ice Cream Social at Fuquay Mineral Springs drew a large crowd and fostered a sense of community, and he expressed his gratitude to all staff members who contributed to its success. o He highlighted the Town's ongoing success in engaging with the community through social media platforms. Specifically, he praised the innovative efforts of Communication Director Susan Weis and Alex Baumann, who have effectively utilized Instagram Reels to reach residents. Notably, their video on the Police Department Medicine Dropbox garnered significant attention, with nearly 60,000 views on Instagram and over 50,000 views on Facebook. Additionally, a collaborative video with the Fire Department on smoke detector safety achieved over 25,000 views. He commended Communications and Marketing Specialist Alex Baumann for her outstanding work in producing engaging content that resonates with the community. o He shared the exciting news that Wake Med has officially received certification for its Health Plex and Emergency Department, and to celebrate, the achievement was showcased on social media over the weekend. The post generated significant interest, with an impressive 80,000 views on Facebook alone. o He proudly announced that Sanitation Supervisor Gabe Briley was recently recognized as Man of the Year by the NC American Public Works Association chapter, a well-deserved honor that was shared on Facebook and garnered an impressive 50,000 views. He noted that this outpouring of support is a testament to the community's affection for Gabe, who has been a beloved and dedicated fixture in the community for many years, and that the community has truly rallied around him to celebrate his achievement. o He highlighted the staff's proactive efforts to enhance the downtown streetscape and public areas, with a focus on maintenance and upkeep. He emphasized his commitment to ensuring that the downtown area continues to flourish and presents a clean and welcoming appearance. In preparation for the upcoming  Celebrate Fuquay-Varina event, he expressed appreciation to staff for taking the initiative to identify areas for improvement and tackle them, demonstrating their dedication to making the Town shine. o He presented the Town Board with the latest fall youth sports data, which showed a significant increase in participation. Notably, the Fuquay-Varina Youth Sports Program has surpassed its peers, with Parks and Recreation Director Jonathan Cox reporting that it is now 71% larger than Apex, the second-largest program in Wake County. In fact, Fuquay-Varina boasts the largest Youth Sports Program in the county, with an impressive 10,603 participants in fiscal year 2025. This exceeds the combined participation of neighboring Towns, including Town of Apex (6,214), Town of Cary (4,424), Town of Holly Springs (5,500), and City of Raleigh (4,600). He attributed the program's success to its professional and fair approach, which prioritizes learning and fun. The Town Board's commitment to allocating resources towards top-notch facilities, including ball fields, soccer fields, basketball courts, volleyball courts, and tennis courts, has also been instrumental in driving this growth. Commissioner Adcock expressed his surprise and admiration for the Youth Sports Program, having learned that it is the largest in Wake County. He believes this is a testament to Fuquay-Varina's reputation as a family-friendly Town, where providing opportunities for children is a top priority. Commissioner Adcock emphasized the importance of investing in the Town's youth and thanked Parks and Recreation Director Jonathan Cox for his exceptional leadership in growing the program from its inception to its current success, praising him for a job well done. Commissioner Wunsch concurred with Commissioner Adcock's sentiments, expressing astonishment at being 71% ahead of the Town of Apex, which exceeded his expectations. He attributed this remarkable achievement to the exceptional management and staff within the Town, as well as the valuable contributions of the Parks Advisory Board. He found it thrilling to see the program yielding such outstanding results, highlighting its resounding success. Commissioner Haynes expressed his gratitude to local organizations for their support and contributions to the summer food program, which provided meals for children throughout the summer. He acknowledged the hard work and dedication of volunteers, staff from Fuquay-Varina High School, who prepared meals daily, and the three site locations that made this initiative a success. He specifically thanked the community of Fuquay-Varina for their role in making this program possible. He also commended the Park and Recreation staff for their efforts in planning the Ice Cream Social, considering the challenges posed by bees at last year's event. Additionally, Commissioner Haynes reported on his recent attendance at the National League of Cities Summer Board Conference, where he serves on the Community Economic Development Federal Advocacy Committee. This committee works with Commissioners and Mayors from across the country to develop policy recommendations that will be presented to Capitol Hill, ensuring that local municipalities have a voice at the federal level. Furthermore, Commissioner Haynes announced his appointment to the Board of Directors of the Minority Elected Municipal Officials Conference, a two-year term affiliated with the NC League of Municipalities. He reflected on the rewarding experience of representing the Town of Fuquay-Varina at both the state and federal levels and looks forward to continuing this work in the future. Mayor Pro-Tem Gardner expressed her enthusiasm for the Youth Sports Program, sharing a personal connection to its success. She mentioned that her granddaughter participated in Fuquay-Varina's volleyball program before relocating to Wilmington and has now achieved a notable milestone by making the varsity volleyball team at Hoggard High School. Additionally, he welcomed a new police officer to the Fuquay-Varina Police Department, whom he had sworn in the previous week. The Mayor also highlighted the Town's thriving business scene, noting his recent attendance at numerous Chamber of Commerce ribbon-cutting ceremonies for new businesses in Fuquay-Varina. Furthermore, he reported on a successful trip to the State of North Carolina with Town Manager Mitchell, Police Chief Tim Smith, and Fire Chief Jim Jones, where they advocated for a certificate of need for WakeMed, resulting in the official announcement of a new emergency room for the Town. Mayor Massengill was also pleased to see high levels of participation in Youth Sports Programs, which have garnered positive feedback from the community.
