CALL TO ORDER - Invocation, Pledge of Allegiance, Roll Call Gahanna City Council met in Regular Session on Monday, December 19, 2016, in Council Chambers of City Hall, 200 South Hamilton Road, Gahanna, Ohio. President of Council, Stephen Renner, called the meeting to order at 7:00 p.m. Vice President of Council, Brian Larick, delivered an Invocation followed by the Pledge of Allegiance. Agenda for this meeting was published on December 16, 2016. Present 7 - Karen J. Angelou, Jamie Leeseberg, Stephen A. Renner, Michael Schnetzer, Brian D. Larick, Brian Metzbower, and Nancy R. McGregor B. ADDITIONS OR CORRECTIONS TO THE AGENDA. None. C. HEARING OF VISITORS - RES-0032-2016 TO HONOR AND COMMEND SHARON MONTGOMERY FOR TWENTY-FIVE YEARS OF SERVICE TO THE CITY OF GAHANNA. President Renner acknowledged Sharon Montgomery for her years of service. 2017-0008 Edouard Petit Letter Edouard Petit, 132 Shull Ave, said he recently found out he will need to get rid of his chickens; he believes he should have the right to keep his chickens; they are his pets; his girls; why are chickens such a threat to the City; why now after 3 years of keeping his chickens is the code being enforced; he's an airline pilot and gone a lot; he can't keep City of Gahanna Page 1 City Council Meeting Minutes December 19, 2016 another animal; his chickens are happy to see him; not keeping them for what a farm is used for; only a few chickens on his property; Creekside has a lot of ducks; can feed the ducks; he believes them being by restaurants are a greater threat; his neighbors don't have an issue with his chickens; he doesn't think it's distracting; any animal can cause the property value to go down; he has more interaction with his neighbors since he's owned chickens; he has his comments for the record; President Renner asked if he gave his comments to the Planning Commission; he said he was not able to make it; he did complete the survey; he was disappointed that the survey wasn't followed since 60% who took it were in favor; President Renner said this was in Planning Commission's hands and one member is in real estate and was against it; Mr. Petit would like to at least get an extension to move his girls; McGregor said her son might be able to house his chickens; he said that could be an option; he has 8 chickens; pointed out again that this wasn't an issue for 3 years and now is being enforced; he said Franklin County gave him the authority to keep his chickens. Sissy Howell, 105 Oklahoma Ave, expressed her point of view on the survey; they are her pets; it's painful to think she has to get rid of her pets; she said they are her family; they respond to their names; she always cares for animals; she made sure Franklin County was ok with it; like any other animal you have to take care of them; her chickens eat very well; all organic; if she could sell eggs they would be worth over $3; it is expensive to raise them; she has never received any complaints; her neighbors have offered to take care of them; she didn't know this was a concern; she requests Council re-consider; she pleaded to keep her chickens; she doesn't trust anyone else to keep them; she took her chicken to vet recently and it cost $400; they are part of her family; would do anything to keep them; would not treat them as farm animals; they are in a secure area; people like to greet them; nothing but positive comments; she has their shots and all their health records; President Renner thanked her for her courage to speak. Jason Howell, 115 Oklahoma Ave., reconsider to make a motion to bring this forward; did research; and was not able to review the code adequately; he wasn't able to read code online; looking for amendment or adjustment; President Renner said there is no formal action to take forward since Planning Commission denied; Angelou asked Ewald to explain that the decision has been made; he stated that PC has the authority under this section of code to allow chickens; because of classification of properties in zoning areas it's only allowed in certain areas; Council could make it legal, but there would be no restrictions. City of Gahanna Page 2 City Council Meeting Minutes December 19, 2016 Jeannie Hoffman, 708 Waybaugh Dr., thanked McGregor for sending Rockwood Cleaners back to committee; she just wanted to know how they arrived at that number; she said that Planning Commission member that voted against already made up their mind; one member sent a derogatory email; one member made derogatory comments under their breath; she said the process was poorly handled; they were told at the beginning of the last Public Hearing to not repeat comments already made; survey was consistent; number of residents took time to respond to the survey; Open Town Hall was 60/40 split for chickens; 750 visits to the page; 247 registered residents responded; next highest topic was how can City be more engaged, there were only 350; the City has gone to great lengths to engage the public; when public isn't listened to; it gives government a bad rap; she is 100% positive that code can be written that is satisfactory to all; there will always be some people you can't please; she was on the news; most people were in favor; only one who said no; she is circulating a petition; this will be on the ballot; write legislation to allow chickens; she believes this will be successful and weigh in at the ballot box; she wants the voters to voice their opinion; maybe they can apply for a variance to keep chickens for now. Karen Bailey, 476 Coronation Ave. is in favor of what everyone said; she'd like to get a variance; she got a notice right before the holiday season; 25th is Sunday; would like to get a variance on the time; she is lucky that her son has a farm; his coop is frozen to the ground; it weighs 960 pounds; she is looking forward to bringing this back; she believes Planning Commission is wrong; she said if they can vote on an eye sore one Planning Commission member needs to be turned in; she sees his ugly house every time she walks by with her dog; Planning Commission job isn't personal and should be what's best for the community; think about who is on Planning Commission; it's wrong to think about themselves and not the City; President Renner said plead with administration to move coop. Donna Perry, 1321 Haybrook Dr., she is in favor of bringing forward a petition; based on survey people need to have a voice; she feels they do not. School Board Update None. D. CORRESPONDENCE AND ACTIONS: Clerk Banning said there will be an organizational meeting on Monday, January 2, at 7:00 p.m., even though the rest of City Hall will be closed. Council None. I. SECOND READING OF ORDINANCES: To Be Amended by Substitution: ORD-0113-2016 TO AUTHORIZE THE MAYOR TO ENTER INTO A PURCHASE AND DEVELOPMENT CONTRACT WITH RINGS BROTHERS, LLC FOR PROPERTY LOCATED AT 181 GRANVILLE STREET TO BE USED BY ROCKWOOD CLEANERS Schnetzer said wanted to highlight that upon bringing this back to committee, it has been further clarified that the land sale has been proposed as economic development which is key for the city; Sale agreement has been amended so that ability to receive incentives has been reduced; is now in favor. Angelou said in the red-lined version, that’s what was negotiated; Michael Blackford, Deputy Director of Development, indicated yes. Larick said challenging environment and he's happy to see this. REPRESENTATIVES: Community Improvement Corporation (CIC) - Renner/Larick Larick said last meeting for 2016 is tomorrow at 7:30 a.m., here at City Hall. Mid-Ohio Regional Planning Commission (MORPC) - Angelou Angelou said met December 8th for last meeting of the year; going to read a letter from Mr. Murdock, the executive director, about the year; together achieved robust list of accomplishments which positioned us well for 2017, is proof that our collaborative and innovative spirit is why central Ohio is Ohio’s fastest growing region and so prosperous; Burt Logan from Ohio History Connection was present to share about City of Gahanna Page 8 City Council Meeting Minutes December 19, 2016 opportunity for Ohio, which is to get more heritage sites in Ohio; approval of 2017 agency budget; update for RFP for long term office space; Governor signed Senate Bill 331 regarding cell phone tower, may try to stop this abuse of public structures; passed 4 year sustainability program; improvements in ozone levels; will have a member retire in 2017; Thea Walsh, was summoned to the White House for a presentation on Smart Cities; will be going to Washington in February with MORPC, will meet with local representatives, looking forward to it. Bd. of Education, Gahanna-Jefferson Public Schools - Larick/Renner School board replaced Joe Gottron with Jennifer Chrysler, since he resigned. Convention & Visitors Bureau (CVB) - Leeseberg Next board meeting will be in January; tonight was a retirement party for Pam Brown, an employee of CVB, she will be missed. M. OFFICIAL REPORTS: Mayor As was mentioned, Senate Bill 331 passed; this bill degrades home rule authority; wants to protect our right of way; will work with other cities and City Attorney; now obtained additional 132 jobs; passed 1,600 mark; first office building broke ground since 2009; a number of business visits scheduled for January; will be evaluating internally within the next few weeks; pleased to present Renner with President of Council embroidered flag; very special; wanted to also thank Council and staff for all the support this year. City Attorney Said will go through each clause of SB 331; omnibus bill which is unconstitutional; will work with legislature to try and fix this; please don’t forget those in need and donate to GRIN. N. COUNCIL COMMENT City of Gahanna Page 9 City Council Meeting Minutes December 19, 2016 Angelou said there’s a two page points of concern on wireless tower, can provide to anyone that wants it; proud of Jennifer Chrysler, she’s wonderful to work with; Merry Christmas and Happy new Year; thanked Chair and Vice Chair of Council for all their hard work; thanked Mayor for all his hard work. Metzbower said thank you for accommodating him this first year on Council; has learned a lot; Merry Christmas and Happy New Year. McGregor said she’s proud to hear about Jennifer Chrysler being appointed to school board; she started out in Gahanna as a young intern and worked hard; Merry Christmas and Happy New Year. Leeseberg said Merry Christmas and Happy New Year, see you all on the 2nd. Larick said Columbus CEO magazine did a write up on Post House Creative, started in 2008, video production enterprise; growing in the city; Merry Christmas and Happy New; Go Bucks. Renner thanked people that came out to speak about chickens; knows it is emotional; did plead with Planning Commission because feels as if the families that pushed for this have had their rights trampled on; wishes them the best of luck getting this on the ballot; wants to thank colleagues for opportunity to serve as President this year; job is to ensure open and transparent dialogue and feels we have met that this year; really feels a sincere sense of awe serving with all of you; Angelou has had perfect attendance and wants to call that out; wants to say that Mayor has done an excellent job and brought us a long way; never heard other mayors talk about job creation and business visits; can’t wait to see what he will do next; Merry Christmas and Happy New year.
