Ordinance #O2410-63 – Second Reading Councilman Alexander presented this ordinance of the City of Gallatin, Sumner County, Tennessee, zoning 106.91 (+/-) acres “not zoned” to the R-8 PRD- Medium Density Residential Planned Residential District and rezone 26.65 (+/-) acres from the R-40 Low Density Residential District to R-8 PRD-Medium Density Residential Planned Residential Development District with a Preliminary Master Development Plan for Kirkpatrick Gallatin, located south of Nichols Lane and west of Woods Ferry Road; authorizing the revision to be indicated on the official zoning atlas; repealing conflicting ordinances; providing for severability, and providing for an effective date (Zone-2024-0105). Resolution authorizing the donation of surplus gear washers to the Southeast, Gallatin, and Oak Grove Volunteer Fire Departments. SUMMARY: Following a successful Federal FY2021 Assistance to Firefighters Grant application which allowed the Fire Department to procure and install a gear washer at each fire station, the existing gear washers have become surplus property. The Southeast, Gallatin, and Oak Grove Volunteer Fire Departments have each requested the donation of one (1) surplus gear washer. The value of each gear washer is estimated at $500.00. The donation of this equipment will help to ensure these volunteer organizations can provide clean firefighting protective equipment to their personnel, thus reducing exposure to carcinogenic and biological materials. T.C.A. 12-2-420 requires the governing body to pass a resolution to authorize these donations. R25Ø3-9 RESOLUTION REVISING THE ADOPTED UTILITY EASEMENT ACQUISITION PROCEDURE WHEREAS, it has become increasingly difficult to obtain water, sanitary sewer, and natural gas utility easements; and WHEREAS, a consistent procedure needs to be established to direct the Department of Public Utilities in obtaining new easements for projects; WHEREAS, a Utility Easement Acquisition procedure was established through Resolution #R9912-032 and revised through Resolution #R1511-59; NOW, THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN, TENNESSEE, to adopt the following Utility Easement Acquisition Procedure: 1. Engineer prepares sketch and legal description using standard City easement form. 2. Give to City Attorney to verify property ownership. 3. Contact property owners and provide easement form, sketch, and cover letter. 4. Pre-condemnation evaluation to consider possible alternatives: (a) Offer set amount for easement - $8.00 per linear foot for properties greater than 1 acres, and up to $12.00 per linear for properties less than 1 acre (b) Consider alternate route for utility line. R25Ø3-10 RESOLUTION AMENDING THE CITY OF GALLATIN PERSONNEL RULES AND REGULATIONS RULE 17, SECTION 17-22 WHEREAS, Section 13-104 of the Gallatin Municipal Code provides for amendment of the Personnel Rules; WHEREAS, Gallatin Personnel Rule 17, General Policies and Procedures, Section 17-22, Activities Involving Illegal Drugs, was previously amended under Resolution R1808-48 which moved the material contents of the section to Personnel Rule 7, Drug and Alcohol Testing Policy; and WHEREAS, Gallatin Personnel Rule 17, General Policies and Procedures, Section 17-22, Activities Involving Illegal Drugs, requires amendment to include a general safety and personal protective equipment policy in the Personnel Rules. NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN, TENNESSEE, that Rule 17, General Policies and Procedures, Section 17-22, Activities Involving Illegal Drugs, of the Gallatin Personnel Rules and Regulations is hereby amended by deleting that section in its entirety and replacing it with the following: Section 17-22 Employee Safety and Personal Protective Equipment The City of Gallatin is committed to the safety of its employees. It is the responsibility of each employee to conduct all work in a safe and efficient manner complying with all local, state and federal safety and health regulations, programmatic standards, and special safety concerns identified by the City. Although most safety regulations are consistent throughout each department, it is the responsibility of employees to identify and familiarize themselves with the safety rules specific to their department and position. Certain City employees are required to wear Personal Protective Equipment (PPE) while performing their jobs or working in certain environments. Each Department Head will specify which PPE is required based on the job or task. Employees are required to wear their designated PPE during work hours and are responsible for reasonable care and maintenance of their PPE. PPE includes, but is not limited to, the following: Eye Protection: o Safety glasses with side shields are required to be worn when a potential eye injury exists. ▪ Potential for eye injury may include flying particles or objects, molten metal, chemical splashes, acids or caustics, gases, vapors, or potentially injurious radiation. ▪ Prescription Safety Eyeglasses must be approved before use as safety glasses and must have affixed side shields. Page 23 of 37 Head Protection o Where there is danger of head injury due to falling objects, head protection is required. o Hard hats may be necessary in utility work and are required when working in bucket trucks and near heavy equipment while in operation. Hearing Protection o Approved hearing protection must be worn in designated areas or when required for a specific task. Foot Protection o As determined by the Department Head, protective footwear is required where there is a danger of foot and ankle injuries, slips and falls due to falling or rolling objects, objects piercing the sole, or exposure to electrical hazards. Employees who are provided personal protective equipment by the Municipal Government shall agree to reimburse the Municipal Government as outlined in Section 15-3 (c). Failure to comply with departmental safety rules, including the appropriate use of personal protective equipment, may result in progressive discipline, up to and including termination, as outlined in Section 12-8. ESSENTIAL DUTIES AND RESPONSIBILITIES: The following duties are normal for this position. These are not to be construed as exclusive or all-inclusive. Other duties may be required and assigned. 1. Leads and participates with general streets, ground maintenance, utility and related work. 2. Leads and participates in mowing, edging, spraying, trimming, and mulching. 3. Leads and participates in the following (including but not limited to): • Picking up litter on the side of City roads and other City owned property. • Painting walls, handrails, pulling weeds, cutting down tree limbs, trimming shrubs, planting seeds, flowers or flower bulbs, shrubs and trees. 4. Performs various street maintenance duties such as cleaning ditches, raking and spreading asphalt, and patching holes. 5. Assists with forming/ pouring concrete, laying asphalt, installing pipe, and general work. 6. Removes, installs, and changes street signs, paint crosswalks and related street markings. 7. Serves as traffic flagger on street and utility projects. 8. Maintains chemicals and lawn/ snow equipment. 9. Perform other related tasks as required and cross-train to cover other department positions when necessary. 10. Regular and predictable attendance. 11. Ability to work in a cooperative manner with others. 12. Other duties as assigned. MINIMUM QUALIFICATIONS: • High School Diploma/GED. • Must have a valid driver’s license. • Must have one (1) year of recent experience in construction, mowing, or landscaping. Preferred crew leading experience. KNOWLEDGE, SKILLS AND ABILITIES: • Knowledge of the occupational hazards involved and the safety precautions necessary to the proper operation of varied construction and maintenance equipment. • Knowledge of simple mechanical systems. • Knowledge of the safe use of equipment, hand tools, and power tools required in the work. • Knowledge of maintaining construction and maintenance equipment. • Ability to provide direction. • Ability to ensure work crews always observe safe work practices. • Ability to handle emergencies. • Knowledge of blood borne pathogen regulations. PHYSICAL REQUIREMENTS: This is medium work requiring the exertion of up to 50 pounds of force occasionally, up to 20 pounds of force frequently, and a negligible amount of force constantly to move objects and some heavy work requiring the exertion of 100 pounds of force occasionally. Physical activities include climbing, balancing, stooping, standing, walking, pushing, pulling, lifting, reaching, fingering, grasping, and repetitive motions. Also includes the necessity to communicate by talking, hearing/listening. Specific vision abilities required by this job include close, distance and peripheral vision; depth perception; and the ability to adjust focus, for operation of machines and equipment, determination accuracy and thoroughness of work, and observation of general surroundings.
