Minutes of the Special Meeting of the Gallup City Council, City of Gallup, New Mexico, held at the El Morro Events Center, 210 South Second Street, at 8:00 am. on Wednesday, April 19, 2017. At such meeting, the following were present, constituting a quorum: Mayor: Jackie McKinney Councilors: Linda Garcia Allan Landavazo Yogash Kumar Fran Palochak Also present: Maryann Ustick, City Manager George Kozeliski, City Attorney Presented to the Mayor and Councilors were the following Discussion/Action Topics: 1. Approval of Settlement Agreement on G-22 Water Application Litigation with Whispering Cedars Mutual Domestic Water Users Association — George Kozeliski, City Attorney Mr. Kozeliski presented the proposed agreement which requires the City to provide replacement water to the Whispering Cedars Mutual Domestic Water Users Association should the City divert more than the allowable amount of groundwater from the Hogback Well Field for more than two consecutive years. Councilor Kumar made the motion to approve the Settlement Agreement on G-22 Water Application Litigation with Whispering Cedars Mutual Domestic Water Users Association. Seconded by Councilor Garcia. Roll call: Councilors Kumar, Garcia, Palochak, Landavazo and Mayor McKinney all voted yes. 2. Approval of Settlement Agreement on G-22 Water Application Litigation with Juniper Trails Water Association George Kozeliski, City Attorney — Mr. Kozeliski presented the proposed agreement with Juniper Trails Water Association, which is similar to the agreement with Whispering Cedars Mutual Domestic Water Users Association. Councilor Palochak made the motion to approve the Settlement Agreement on G-22 Water Application Litigation with Juniper Trails Water Association. Seconded by Councilor Landavazo. Roll call: Councilors Palochak, Landavazo, Kumar, Garcia and Mayor McKinney all voted yes. The Mayor and Councilors conducted a Work Session to review and discuss the following Topic: MINUTES Special City Council Meeting — 4/19/2017 Page 2 1. Proposed Fiscal Year (FY) 2018 Budget Maryann Ustick, City Manager — and Patty Holland, Chief Financial Officer The Mayor and Councilors conducted a review of the proposed budget for FY 2018. Ms. Ustick, Ms. Holland and the department directors answered questions posed by the Mayor and Councilors. There was no official action taken by the Mayor and Councilors during the Work Session.
