Minutes of the Regular Meeting of the Gallup City Council, City of Gallup, New Mexico, held in the Council Chambers at Gallup City Hall, 110 West Aztec Avenue, at 6:00 p.m. on Tuesday, April 25, 2017. The meeting was called to order by Mayor Jackie McKinney. Upon roll call, the following were present: Mayor Jackie McKinney Councilors: Linda Garcia Allan Landavazo Fran Palochak Absent: Yogash Kumar, Councilor Also present: Maryann Ustick, City Manager George Kozeliski, City Attorney Mayor McKinney said Councilor Kumar’s absence shall be recorded as an excused absence. Presented to the Mayor and Councilors for their approval were the Minutes of the Regular Meeting of April 11,2017. Councilor Palochak made the motion to approve the aforementioned Minutes. Seconded by Councilor Landavazo. Roll call: Councilors Palochak, Landavazo, Garcia and Mayor McKinney all voted yes. The Mayor and Councilors presented a Proclamation recognizing the week of May 8-13, 2017 as Economic Development Week in the City of Gallup. Michael Sage, Deputy Director, Greater Gallup Economic Development Corporation (GGEDC), accepted the Proclamation on behalf of the GGEDC. Presented to the Mayor and Councilors for their approval were the following Discussion/Action Topics: 1. Approval of New Public Library Conceptual Design Report — Stanley Henderson, Public Works Director Mr. Henderson presented the New Gallup Public Library’s Programming and Conceptual Design Report as the City’s plan for construction of a new public library. Staff has proceeded with a feasibility study for the library at the site proposed in the Gallup Downtown Redevelopment Plan. The plan also updates the Library Planning and Feasibility Study of 2013, which refines the location and conceptual project costs. Mr. Henderson introduced Joe Gallegos and Jose Zalaya of Huitt-Zollars, Inc. who presented MINUTES Regular City Council Meeting — 4/25/2017 Page 2 a power point presentation on the proposed plan. A copy of the power point presentation is attached hereto, marked as Exhibit A and made a part of these official Minutes. Discussion followed concerning the planning for future growth of the library depending on city and county populations, amenities that could be offered at the library such as a coffee bar or juice bar, the 25% contractor’s fee of the projected construction cost subtotal, pursuing the County’s assistance for financing the project and the high quality of the circulation, programs and services currently provided at the Octavia Fellin Public Library. Following discussion, Councilor Garcia made the motion to approve the New Public Library Conceptual Design Report. Seconded by Councilor Palochak. Roll call: Councilors Garcia, Palochak, Landavazo and Mayor McKinney all voted yes. Mary Ellen Pellington, Library Director, introduced the following Library Advisory Board Members in attendance: Janet Tempest, Vicki Dube, Barbara Stanley, Rhona Gishi Chicharello and Tom Hartsock. Ms. Pellington also introduced the following staff members at the Octavia Fellin Public Library: Markos Chavez, Betty Martin, Ann Price and Tammy Moe. 2. Approval of Road Closures on Coal Street Between 2rd Street and 3rd Street for Gallup Police Annual Memorial Phillip Hart, Chief of Police — Chief Hart presented the request for the street closure as well as an overview of the annual memorial run to honor six fallen police officers of the Gallup Police Department. The event will be held on Friday, May 26, 2017 from 11:00 a.m. to 1:00 p.m. Councilor Palochak asked if the affected business owners from 2nd to 3rd Street were consulted regarding the proposed street closure during the lunch hour. Chief Hart responded no; however, he said the business owners could be contacted during the next couple of days regarding the proposed closure. Louie Bonaguidi, owner of the City Electric Shoe Shop, said he personally has no objections to the proposed street closure for the event; however, there may be other merchants in the downtown area that may be opposed to the closure. Following discussion, Councilor Landavazo made the motion to approve the requested road closures on Coal Street between Street and 3td Street for the Gallup Police Annual Memorial. Seconded by Councilor Garcia. Roll call: Councilors Landavazo, Garcia and Mayor McKinney voted yes. Councilor Palochak voted no. Motion carried. Mayor McKinney asked Chief Hart to contact the affected downtown business owners regarding the approved street closure for the event. Chief Hart said if there is a large MINUTES Regular City Council Meeting — 4/25)2017 Page 3 number of business owners opposed to the street closure, he will bring back a recommendation to the Mayor and Councilors for an alternate site or an alternate time for holding the event. 3. Approval of Lodgers’ Tax Funding for Run for the Wall and 4th of July Celebration Jennifer Lazarz, Tourism and Marketing Manager — Ms. Lazarz presented the following requests for lodgers’ tax funding: $12,605 for Run for the Wall to be held on May 18, 2017 and $10,500 for the fireworks display for the City’s Independence Day Celebration. Councilor Landavazo, Ms. Larzarz and Mayor McKinney provided their positive comments for hosting the Run for the Wall event. Councilor Palochak made the motion to approve the lodgers’ tax funding for Run for the Wall and the 4th of July Celebration. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo and Mayor McKinney all voted yes. 4. Approval of Professional Services Agreement with the Chamber of Commerce for the Summer Nightly Indian Dance Program Jennifer Lazarz, Tourism and — Marketing Manager Ms. Lazarz presented the proposed agreement for conducting the program at the Courthouse Square during the upcoming summer months. Bill Lee, Chief Executive Officer, Gallup McKinley County Chamber of Commerce, provided information concerning the growth in attendance at the nightly Indian dances from 2008 through 2016. He also presented information to support the request for an increase of $10,000 for this year’s program for a total of $60,000. Mr. Lee answered questions posed by the Mayor and Councilors regarding the program. Following discussion, Councilor Landavazo made the motion to approve the Professional Services Agreement with the Chamber of Commerce for the Summer Nightly Indian Dance Program. Seconded by Councilor Palochak. Roll call: Councilors Landavazo, Palochak, Garcia and Mayor McKinney all voted yes. 5. Resolution No. R2017-11; 3rd Quarter Fiscal Year 2017 Budget Adjustments and Report of Actuals Patty Holland, Chief Financial Officer — Ms. Holland presented the proposed resolution which encompasses all budget changes processed January 1, 2017 through March 31, 2017. She provided an overview of the MINUTES Regular City Council Meeting — 4/25/2017 Page 4 budget adjustments as well as the Report of Actuals for the quarter. Councilor Palochak made the motion to approve Resolution No. R201 7-1 1. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo and Mayor McKinney all voted yes. 6. Acceptance of Easement from Batt & Children, LLC — George Kozeliski, City Attorney Mr. Kozeliski said the Water Department is designing a continuation of the replacement of the transmission waterline from Park Avenue, across 2rc Street, to the Grandview water tank. The proposed easement will allow the City to construct the waterline across one of the parcels on the south side of Philipina Avenue. The alternative to the easement is to tear up the asphalt on Philipina Avenue, install the new line and then replace the asphalt. Although the cost of the easement is $25,000, DePauli Engineering has determined that the City will save a substanUal amount of money. By obtaining the easement for the construction of the waterline on unimproved real estate, it will eliminate the need to disturb Philipina Avenue. Councilor Garcia made the motion to accept the easement from Batt & Children, LLC. Seconded by Councilor Palochak. Roll call: Garcia, Palochak, Landavazo and Mayor McKinney all voted yes. 7. Approval of Contract for Leak and Air Pocket Detection Services with Pure Technologies Dennis Romero, Water and Sanitation Director — Mr. Romero presented the proposed contract for the leak and air pocket detection services to assess the condition of a 7,000-foot section of the 16-inch transmission line from Highway 491 to the Gibson Pressure Relief Valve Station. He also presented a video on the SmartBall Technology, which will used to assess the condition of the waterline. The cost of the sole source procurement is $62,610. Councilor Palochak made the motion to approve the contract for leak and air pocket detection services with Pure Technologies as presented. Seconded by Councilor Landavazo. Roll call: Councilors Palochak, Landavazo, Garcia and Mayor McKinney all voted yes. Councilor Palochak made the motion to adjourn into closed session for the purpose of discussing the possible settlement with remaining protestants regarding the City’s G-22 water acquisition and the possible acquisition of real property for utility purposes. Seconded by Councilor Landavazo. Roll call: Councilors Palochak, Landavazo, Garcia and Mayor McKinney all voted yes. MINUTES Regular City Council Meeting — 4/25/2017 Page 5 The Mayor and Councilors adjourned into closed session pursuant to §10-15-1-H(7) and §10-15-1-H(8) NMSA 1978 Comp. (as revised). Following the closed session, Councilor Landavazo made the motion to reconvene the regular meeting. Seconded by Councilor Palochak. Roll call: Councilors Landavazo, Palochak, Garcia and Mayor McKinney all voted yes. Mr. Kozeliski certified for the record that the matters discussed during the closed session were limited to the possible settlement with remaining protestants regarding the City’s G 22 water acquisition and the possible acquisition of real property for utility purposes. Comments by Public on Non-Agenda Items Jerry Domagala, Melissa Lee, Larry Foster, Brandon Benally, Michael Butler and Daryl Smith addressed the Mayor and Councilors to express their concerns about the removal of a planter in front of the law office of Barry Klopfer. The City-owned planter had a painted image of activist Larry Casuse and a woman holding an AK-47. Jerry Garcia addressed the Mayor and Councilors to express his opposition to the planter. Mayor McKinney stated that he had not received any phone calls or office visits regarding the planter. He invited anyone who would like to discuss this matter to meet with him by calling City Hall to schedule an appointment. Comments by Mayor and City Councilors Councilor Palochak provided information on the community cleanup activities this month. She thanked those who helped to pick up trash on Earth Day. Councilor Landavazo thanked the individuals who addressed the Mayor and Councilors during the public comment segment of the meeting. Councilor Garcia also thanked those who addressed the Mayor and Councilors during public comment. She also provided information about an upcoming Neighborhood District Meeting to be held on April 27, 2017. Comments by City Manager and City Attorney Mr. Kozeliski clarified the information that was previously announced about the community cleanup activities.
