Upon roll call, the following were present: Cherry Menapace Patty Holland Billy Moore Upon roll call, the following were absent: Dr. Oscar A. Palomo, MD Dorie Rowberry Prior to the approval of the meeting minutes, Board Member Palomo arrived. Presented to the Chairwoman and Authority Board Members for their approval were the minutes of the April 10th, 2018 meeting. Board Member Moore motioned for approval of minutes as presented. Seconded by Board Member Holland. Motion Carried. Upon roll call, the following votes were: Billy Moore (Yes) Patty Holland (Yes) Dr. Oscar A. Palomo, MD (Yes) ITEM ONE: Quarterly Financial Report Patty Holland, City of Gallup’s Chief Financial Officer informed the Board Members that the Animal Control Quarterly Report included data from the third quarter of fiscal year 2018. Overall the department was right on track with spending the amount of funds that they were awarded at the beginning of the fiscal year. Thus far they have spent about seventy-five percent (75%) of their budget. Board Member Holland stated that their budget didn’t appear to have any issues because they budgeted appropriately and were able to stay fully staffed for most of the year. Board Member Moore asked Board Member Holland about the Overtime account (101- 2012-421-41-50) on Page 1-1 where it showed that there was a negative amount of -$214. Board Member Holland explained that Animal Control had went a little over budget on overtime and before the fiscal year was closed out they would move dollars from the Gallup McKinley County Animal Control Authority Meeting July 10th, 2018 Minutes Page 1 of 4 Group Insurance account (101-2012-421-42-50) to cover that cost. She noted how there was one (1) more quarter left in the fiscal year whereas in the last quarter adjustments would be made. Motion was made by Board Member Moore to accept the quarterly financial report. Seconded by Board Member Palomo. Motion Carried. Palomo, MD (Yes) Patty Holland (Yes) ITEM TWO: FY 2019 Final Approved Budget Patty Holland, City of Gallup’s Chief Financial Officer informed the Board Members that the final approved report for fiscal year 2019 was the same report previously presented to them. However, there was a minor modification, per the City Manager’s direction to do a two percent (2%) cost-of-living adjustment (COLA) for all Animal Control employees. They also increased the cost share on the health insurance where the City’s contributions were changed from seventy percent (70%) to eighty percent (80%). Those updated changes were reflected in the budget presented to the City Council and the County Commissioners who both approved the final budget. Board Member Holland explained how she also wanted to present the final numbers to the Board. Motion was made by Board Member Moore to accept the FY 2019 final approved budget. Seconded by Board Member Palomo. Motion Carried. Upon roll call, the following votes were: Billy Moore (Yes) Dr. Oscar A. Palomo, MD (Yes) Patty Holland (Yes) ITEM THREE: Update concerning the outcome of recent meetings regarding the influx of Navajo Nation animals Cosy Balok, Animal Control Coordinator spoke about the meeting she had with the Navajo Nation Animal Control where the City Manager was also present. She summarized the meeting by stating that the Navajo Nation Animal Control wasn’t willing to help with anything because of their lack of resources. Cosy spoke about how the issue has been brought to their attention numerous times, however they fail to work together to come up with a solution. Board Member Moore asked if there were any future meetings planned. Cosy stated no. Board Member Moore suggested continuing to look for other alternatives to help with Gallup McKinley County Animal Control Authority Meeting July 10th, 2018 Minutes Page 2 of 4 the influx of Navajo Nation animals. Cosy spoke about how Edmund Yazzie was trying to coordinate and bring the two organizations together, but there was nothing they could do. There was a discussion between Board Members and staff about possible grants to help the Navajo Nation with their influx of animals. However that would be difficult for Gallup Animal Control to coordinate because Navajo Nation was out of their jurisdiction. Clyde (C.B.) Strain, Planning & Development Director spoke about how Navajo Nation Animal Control Director, Glenda Davis mentioned how they had low resources, no manpower or the facilities to take in their own animals. According to Ms. Davis, they wanted to start a spaying and neutering program, but are far from implementing it. C.B. continued by stating that unfortunately there were no direct answers or actual input from their meetings to help resolve the issue. Gallup Animal Control has to continue to provide services and if animals come into the City limits they have to take them in. C.B. also spoke about how they were in the beginning phase of doing a study for a new Animal Control shelter. Cosy spoke about a complaint she received about dead dogs floating in a water system and how they couldn’t doing anything because it was on the Navajo Nation. She directed the complainant to call the Navajo Nation Animal Control whereas they were told that they wouldn’t check into it until October. Board Member Holland also suggested referring them to the Environmental Protection Agency. There was a brief discussion between Board Members about how they’ve also received complaints regarding animals south of Gallup. Open Floor: No discussion. Curtis Hayes, City Attorney has provided a copy of the Ordinance with the proposed changes for your review, see the attachments. Section 5-3-44 Keeping Domesticated Livestock and Fowl has the following revisions: 1. Change the permitted zoning districts from Rural Residential (RR) and RS1 to Rural Residential (RR) and Single-Family Residential (SFR), which will correspond with the new Gallup Land Development Standards. The newly adopted LDS has consolidated many of the old zoning districts into new zoning districts whereas the City of Gallup Animal Control Ordinance doesn’t correspond. This revision will fix that inconsistency. 2. Remove the term “hens” throughout the section whereas using the term “backyard chickens” will suffice. 3. Change the permit requirements and remove the fees. Section 5-3-34 Animals Transported in Vehicles has the following revisions: 1. Remove “ambient temperature” and replace with “interior temperature of the vehicle” for clarity purposes. 2. Create a new subsection for “Driving Recklessly or While Intoxicated”. It is unlawful to keep, harbor or maintain within the City limits any horses, mules, burros, cows, pigs, goats, sheep, swine and all other domesticated animals used in the production of food, or other products except as provided in Rural Residential (RR) Zoning Districts. B. It is unlawful to keep fowl except as provided in subsection C of this section. C. Backyard chickens hens (chickens kept on a residential lot), are allowed under the following conditions, however, all other poultry or fowl prohibited. No person may own or keep any other fowl, including ducks, quail, geese, turkeys, pigeons or peacocks. 1. No more than four (4) backyard chickens hens are permitted per lot. Roosters are prohibited. 2. Backyard chickens hens are restricted to the rear or backyard of any lot in a residential the Rural Residential (RR) and Single-Family Residential, Detached (SFR) Zoning Districts. Backyard chickens hens may not free range and are restricted to the coop and run. 3. All backyard chicken hen coops shall meet the following requirements: a. Be predatorproof with a solid top. b. Provide water at all times. c. Are limited to a maximum of one hundred twenty (120) square feet (includes coop space and chicken run). d. Provide at least four (4) square feet of space per backyard chicken for the coop and run. e. Be no taller than seven feet (7') at the highest point of the roof. f. Be at least ten feet (10') from any other structure and at least five feet (5') from any side or rear property line. g. All coops shall be regularly cleaned to control dust, odor, and waste and not constitute a nuisance, safety hazard, or health problem to surrounding properties. (Ord. 2012-10, 11-13- 2012) 4. Backyard chickens hens are only allowed in RS-1 SFR and RR Zoning Districts and in such districts shall not be deemed as "agricultural operations" as may be stated in other section of this Code. Any person that owns or maintains backyard chickens is required to obtain a permit from the Animal Control Division. There shall be no charge to obtain the permit. The permit will remain effective for so long as the applicant owns or maintains chickens at the location listed on the permit. The permit shall list the requirements contained in this section to own or maintain chickens. A City permit is required for all chicken hen coops, and no more than one permit per household shall be issued by Animal Control Division. The fee for a chicken hen coop is twenty dollars ($20.00) per year, and subject to inspection by the City at least once a year. A permit may be revoked upon the conviction of the permit holder of a violation. (Ord. 2013-3, 4-9- 2013) 5. Nothing herein shall permit keeping an animal, as the laws and regulations of the State of New Mexico or the United States otherwise prohibit or restrict. 6. Keeping of backyard chickens hens are subject to this Code's nuisance provisions, which shall supersede and take precedence over this provision of this chapter. (Ord. 2012-10, 11-13-2012)  ORDINANCE NO. __________ AN ORDINANCE AMENDING SECTION 5-3-44 OF THE GALLUP CITY CODE RELATING TO BACKYARD CHICKENS CONFORMING THE REFERENCE TO RESIDENTIAL ZONING TO THE NEW LAND DEVELOPMENT STANDARDS, ELIMINATING THE REQUIREMENT FOR A PERMIT TO HAVE A CHICKEN COOP, AND ESTABLISING AN EFFECTIVE DATE. WHEREAS, the Land Development Standards Code has revised the designation of the single family residential zone that is referenced in this section of the Gallup-Metro Animal Ordinance; and WHEREAS, the current requirement that a permit be obtained for a chicken coop is not generally complied with and which is not necessary for the enforcement of the restrictions relating to the keeping of chickens: and NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GALLUP THAT SECTION 5-3-44 OF THE GALLUP CITY CODE BE AMENDED AS FOLLOWS: 5-3-44: KEEPING DOMESTICATED LIVESTOCK AND FOWL: A. Unattended Animals: No person shall intentionally, knowingly or recklessly leave an animal unattended in a closed vehicle for any length of time without providing adequate ventilation to prevent the temperature in the vehicle from rising high enough such that any reasonable person would know that the animal would suffer from heat exposure. An animal left in a closed vehicle without the interior of the vehicle being air conditioned when the ambient temperature interior temperature of the vehicle is over eighty degrees (80°), shall be prima facie evidence of a violation of this chapter. If an animal protection officer determines that an animal in a vehicle is in immediate danger, the animal protection officer or police officer may enter the vehicle by whatever means necessary, without being liable to the owner of the vehicle for any damage, and seize the animal. The animal's owner shall be responsible for all expenses related to the removal of the animal, emergency veterinary treatment and impoundment. If the animal protection officer or police officer cannot determine who confined the animal, the registered owner of the vehicle will be cited. (Ord. 2017-10, 12-12-2017) E. Driving recklessly or while intoxicated: No person shall transport an animal in a motor vehicle or a towed vehicle while operating the motor vehicle in a reckless manner or while under the influence of an intoxication liquor or drugs.  ORDINANCE NO. __________ AN ORDINANCE AMENDING SECTION 5-3-34 OF THE GALLUP CITY CODE RELATING TO TRANSPORTING ANIMALS TO AMEND THE SECTION REGARDING UNATTENDED ANIMALS, CREATING A NEW SECTION PROHIBITNG TRANSPORTING AN ANIMAL WHILE DRIVING RECKLESSLY OR WHILE UNDER THE INFLUENCE OF LIQUOR OR DRUGS, AND ESTABLISING AN EFFECTIVE DATE. WHEREAS, the Animal Control Division has acquired equipment that can determine the interior temperature of a vehicle; and WHEREAS, Animal Protections Officers are being called to impound animals where the driver has been arrested for driving while intoxicated: and WHEREAS, transporting an animal while driving recklessly or while intoxicated places the animal in danger of injury or death; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GALLUP THAT SECTION 5-3-34(D) OF THE GALLUP CITY CODE BE AMENDED AS FOLLOWS AND THAT A NEW SUBSECTION (E) BE ADDED AS FOLLOWS: 5-3-34 ANIMALS TRANSPORTED IN VEHICLES D. This will cause a burden on the Gallup Shelter because we will be the only local shelter accepting animals. I have previously brought the influx of Navajo Nation animals to the Board’s attention, but I wanted to notify the Board that the number of incoming animals will continue to increase, but at a more rapid rate than expected. Please see the attached statistics for our shelter from January to September 2018. The day of the event two (2) Animal Control Officers and I inspected the animal cages and monitored the performance. We also verified that the circus had all their health certifications and USDA permits. We did not find any violations and the event was a success with no safety concerns.
