CITY OF GALT MINUTES REGULAR CITY COUNCIL MEETING Council Chambers, 380 Civic Drive, Galt, California Tuesday, May 19, 2020 This meeting of the Galt City Council was conducted by video/teleconference in compliance with the State and County Shelter at Home Orders, and as allowed by the Governor’s Executive Order N-29- 20, which allowed for a deviation of teleconference rules required by the Brown Act. Council Members and City staff participated via remote video/telephone connections and the meeting was broadcast on Metro Cable and livestreamed on the City’s website. The Mayor called the meeting to order at 6:03 pm. Council Members present: Lozano, Farmer, Campion, Lampson and Sandhu. Staff members present: Interim City Manager Haglund, City Clerk Hubert, Interim City Attorney Steiner, Community Development Director Erias, Finance Director Tyson, Human Resources Director Van Steyn Parks and Recreation Director Solis, Police Chief Sockman and Public Works Director Selling. OPENING CEREMONIES – Silent prayer was observed, the flag salute was recited and the City Clerk read the replay statement. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS: Hubert pulled Item F1 to bring back at next regular council meeting. PRESENTATION: None. PUBLIC COMMENTS: The City Clerk announced that members of the public could address the City Council on non-agenda items via the email submission process identified on the agenda. She stated no discussion or action could be taken on any item that was not listed on the agenda. She said those who submitted written public comments would be read out loud by the City Clerk, subject to the customary five minute time limit, on any item scheduled on the agenda at the time that item was being considered. CITY MANAGER’S OFFICE: 3. SUBJECT: Coronavirus (COVID-19) Update. RECOMMENDED ACTION: Information only. Haglund gave the update. REPORTS BY CITY COUNCIL MEMBERS ON REGIONAL BOARDS, COMMISSIONS AND COMMITTEES: INFORMATION/CONSENT CALENDAR - Consisting of Items 1 through 4, excluding Item 1 which was pulled to bring back at next regular council meeting. 2. SUBJECT: Receive and File Warrants for period ending May 6, 2020. RECOMMENDED ACTION: Receive and file warrants for the period ending May 6, 2020. 3. SUBJECT: Third Amendment with the City of Elk Grove for Disposal of Household Hazardous Waste. RECOMMENDED ACTION: Adopt Resolution No. 2020-23 authorizing the City Manager to execute the Third Amendment to the Agreement between the City of Elk Grove and the City of Galt for Participation at the Special Waste Collection Center (C-16-588) for Galt residents to continue to utilize Elk Grove’s Household Hazardous Waste Collection Facility for disposal of household hazardous waste items. 4. SUBJECT: Microsoft Licensing Agreement with Software House International. RECOMMENDED ACTION: Adopt Resolution No. 2020-24 approving a three year Microsoft Licensing agreement with Software House International. ACTION: Upon a motion by Lozano, seconded by Campion, the consent calendar was approved by a unanimous roll call vote. SCHEDULED MATTERS - PUBLIC HEARING: None. REGULAR CALENDAR: TREASURER’S OFFICE: 1. SUBJECT: City’s Investment Policy for Fiscal Year 2020-2021. AGENDA REPORT: Farrell Farrell gave the report. ACTION: Upon a motion by Campion, seconded by Lampson, accepting the City Investment Policy as submitted was approved by a unanimous roll call vote. 2. ACTION: Upon a motion by Campion, seconded by Farmer, accepting the Treasurer’s Report for period ending March 2020 was approved by a unanimous roll call vote. CITY MANAGER’S OFFICE: 4. SUBJECT: Temporary Suspension of Transient Occupancy Tax. RECOMMENDED ACTION: Adopt and waive further reading of an Urgency Ordinance of the City Council of the City of Galt, California, by four-fifths vote, temporarily suspending Sections 3.36.080 and 3.36.090 of the City of Galt Municipal Code concerning payment of Transient Occupancy Tax (TOT), thereby deferring payments of TOT to the quarter following the end of the local COVID-19 emergency Sandhu recused himself due to a potential conflict of interest and left the virtual meeting consistent with direction from the City Attorney. Mendes gave the presentation. Cherrie Tomkins, Days Inn, spoke in favor of a temporary waiver of transient occupancy tax. Mel Shamblen, Comfort Inn & Suites spoke in favor of a temporary waiver of transient occupancy tax. ACTION: Upon a motion by Farmer, seconded by Lampson, adopting urgency Ordinance No. 2020-02 was approved with a roll call of vote of council members present. Absent: Sandhu. Sandhu re-entered the meeting at 8:30 pm. COMMUNICATION: Hubert stated additional public comments had been received. Jocelyn Gunter, spoke in favor of reopening Galt. Terry Parker, Parker Realty, spoke in favor of making Galt a sanctuary city. Kim Mackey, Hairworks Beauty Salon, spoken in favor of reopening Galt. CITY CLERK’S REPORT: 1. SUBJECT: 2020 General Municipal Election. RECOMMENDED ACTION: Adopt a resolution calling a General Municipal Election and requesting the Board of Supervisors of Sacramento County to consolidate the General Municipal Election with the Presidential General Election held on November 3, 2020, pursuant to Section 10403 of the Elections Code. Hubert gave the agenda report. City Council discussed the alternatives of determining a tie vote. It was agreed to determine the tie by lot instead of conducting a run off election. GALT CITY COUNCIL MINUTES REGULAR MEETING OF MAY 19, 2020 PAGE 6 ACTION: Upon a motion by Campion, seconded by Lampson, adopting Resolution No. 2020-25 revising Section 3 to determine the tie by lot was approved by a unanimous roll call vote. COMMENTS BY STAFF: Haglund said that as a result of the State’s 4 tier approach and the fact that large gatherings would unlikely be allowed, the Independence Day Celebration (IDC) was cancelled. He said the Parks and Recreation Department staff had been working on a substitute community event that would be held in lieu of the IDC for this year. Haglund said the event would be a drive-thru light show on the market grounds honoring local heroes in and around the community and would be free of charge. Haglund also said staff was working on an essential certified farmer’s market which would be held on Fridays, June 5 – September 25, on the Fourth Street Promenade. Haglund also said the proposed budget would be delivered to the City Council members. Selling said it was the 60th annual Public Works week and he appreciated all his staff. Mendes said she appreciated everyone’s support on the TOT tax suspension. COMMENTS BY CITY COUNCIL MEMBERS/FUTURE AGENDA ITEMS: VICE MAYOR LOZANO: gave compliments to the permit department after receiving positive feedback from a local contractor on how smooth and quickly the process went to obtain a permit. He said he appreciated the Parks and Recreation Department for their innovation for programs during this time. City Council agreed to bring back the City Council, Committee and Commission conduct procedures at the next City Council meeting. COUNCIL MEMBER FARMER: said he wanted different options discussed before cancelling the IDC but was happy to see the Parks and Recreation staff pursuing different events. Farmer said he did not want to see the different events planned taking the place of the IDC. Farmer also said he wanted to advocate for the businesses in the strongest manner possible. COUNCIL MEMBER CAMPION: said the staff had done an outstanding job advocating for the community and the businesses. COUNCIL MEMBER LAMPSON: none. MAYOR SANDHU: appreciated the public comments and feedback. He also thanked the staff ‘s work during COVID-19.
