CITY OF GALT MINUTES REGULAR CITY COUNCIL MEETING Council Chambers, 380 Civic Drive, Galt, California Tuesday, April 6, 2021 This meeting of the Galt City Council was conducted by video/teleconference in compliance with the State and County Shelter at Home Orders, and as allowed by the Governor’s Executive Order N-29- 20, which allowed for a deviation of teleconference rules required by the Brown Act. Council Members and City staff participated via remote video/telephone connections and the meeting was broadcast on Metro Cable and livestreamed on the City’s website. The Mayor called the meeting to order at 6:02 pm. Council Members present: Sandhu, Papineau, Vandenburg, Lozano and Farmer. Staff members present: City Manager Hines, City Clerk Hubert, Interim City Attorney Steiner, Community Development Director Hoffman, Economic Development Manager Mendes, Finance Director Tyson, Human Resources Director Van Steyn, Interim Police Chief Kalinowski, Parks and Recreation Director Solis, and Public Works Director Selling. OPENING CEREMONIES: Silent prayer was observed, the flag salute was recited, and the City Clerk read the replay statement. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS: None. PRESENTATIONS: None. PUBLIC COMMENTS: The City Clerk announced that members of the public could address the City Council on non-agenda items via the email submission process identified on the agenda. She stated no discussion or action would be taken on any item that was not listed on the agenda. She said those who submitted written public comments would be read out loud by the City Clerk, subject to the customary five minute time limit, on any item scheduled on the agenda at the time that item was being considered. REPORTS BY CITY COUNCIL MEMBERS ON REGIONAL BOARDS, COMMISSIONS AND COMMITTEES: Papineau attended the Sacramento Metropolitan Air Quality Management District Board of Directors Meeting on March 25. Lozano attended the Sacramento Area Council of Governments Policy and Innovation Committee Meeting on April 5. Farmer attended the Sacramento Public Library Authority Board Meeting on March 25. INFORMATION/CONSENT CALENDAR - Consisting of Items 1 through 5. 1. SUBJECT: Minutes of the Regular Meeting of March 16, 2021. RECOMMENDED ACTION: Accept the minutes as submitted. 2. SUBJECT: Receive and File Warrants for period ending March 23, 2021. RECOMMENDED ACTION: Receive and file warrants for the period ending March 23, 2021. 3. SUBJECT: Treasurer’s Report for Period ending January 2021. RECOMMENDED ACTION: Accept the Treasurer’s Report as submitted. GALT CITY COUNCIL MINUTES REGULAR MEETING OF APRIL 6, 2021 PAGE 2 4. SUBJECT: Approving Joint Community Facilities Agreement with Cosumnes Community Services District for Community Facilities District Nos. 2020-1 (Public Services) and 2020-2 (Liberty Ranch). RECOMMENDED ACTION: 1) Adopt Resolution No. 2021-12 approving Joint Community Facilities Agreement (JCFA) with Cosumnes Community Services District in order to finance services provided by a public agency other than the agency forming the Community Facilities District (CFD) and allow for the collection of special taxes by the City from the respective CFD (Community Facilities District Nos. 2020-1 (Public Services) and 2020-2 (Liberty Ranch), collectively the “Districts”) to be remitted to Cosumnes Community Services District (CCSD) for services to be provided by CCSD and 2) Authorize the City Manager to execute the JCFA on behalf of the City. 5. SUBJECT: Contract Amendment with SNF Polydyne Inc. and Approving Appropriation of $14,350. RECOMMENDED ACTION: Adopt Resolution No. 2021-13 1) Authorizing the City Manager to execute a contract amendment with SNF Polydyne, Inc. increasing the annual maximum contract amount by $14,350 for Fiscal Year 2020-2021 and increase the annual maximum contract amount to $57,300 for Fiscal Year 2021-2022; and 2) Approving an appropriation in the amount of $14,350 for Fiscal Year 2020-2021. ACTION: Upon a motion by Sandhu, seconded by Lozano, the consent calendar was approved by a unanimous roll call vote. SCHEDULED MATTERS - PUBLIC HEARING: 1. SUBJECT: Galt Market Community Plan Visioning Session and Discussion. RECOMMENDED ACTION: Conduct a visioning workshop on the proposed Galt Market Community Plan to discuss and provide feedback, comments, and direction to staff. Hines gave the presentation and answered City Council questions. Daniel Denier opposed the plan. Sam Mitchell expressed his thoughts regarding the plan. Joe Bitondo expressed his thoughts regarding the plan. Chris Brossman expressed his concerns regarding the plan. Jerry Sauter expressed his thoughts regarding the plan. RECOMMENDED ACTION: 1) Receive a presentation; 2) Reopen public hearing from March 2, 2021 and receive comments; 3) Upon closing the public hearing, ratify the prior actions taken by the City Council on March 2, 2021: a. Resolution No. 2021-08 approving the Initial Study, Mitigated Negative Declaration, and the Mitigation Monitoring and Reporting Program for the Caterina Estates Project; b. Resolution No. 2021-09 approving the General Plan Amendment of 12.4 acres from LDR to MDR; c. Reintroduce by title only and waive further reading of Ordinance No. 2021-01 amending the District Zoning Map of the City of Galt to Rezone 12.4 Acres of the Caterina Estate Project from R1A to R2; and d. Resolution No. 2021-10 approving the Tentative Subdivision Map subdividing the 12.4 acres site into 61 single family lots for the Caterina Estates project. Hoffman stated the Caterina Estates Project Public Hearing presented at the March 2, 2021 City Council Meeting was not properly noticed and asked City Council to reopen the public hearing and ratify the previous actions taken by City Council. Farmer opened the public hearing. Aiden Barry, True Life Companies, gave a status update. After hearing no further public comments, Farmer closed the public hearing. ACTION: Upon a motion by Lozano, seconded by Sandhu, readopting Resolution No. 2021-08, 2021-09, 2021-10 and reintroducing Ordinance No. 2021-01 was approved by a unanimous roll call vote. 3. SUBJECT: Annexation of Territory to Community Facilities District No. 2020-1 (Public Services) (Annexation No. 1 (Veranda)). RECOMMENDED ACTION: 1) Conduct public hearing; 2) Approve Resolution No. 2021-14 of the City Council of the City of Galt, California, Calling a Special Election and Submitting to the Qualified Electors of Territory Proposed to be Annexed to the City of Galt Community Facilities District No. 2020-1 (Public Services), County of Sacramento, State of California, the Question of Levying Special Taxes within that Territory (Annexation No. 1 (Veranda)); 3) Conduct election; 4) Approve Resolution No. 2021-15 of the City Council of the City of Galt, Acting in its Capacity as the Legislative Body of City of Galt Community Facilities District No. 2020-1 (Public Services), County of Sacramento, State of California, Declaring the Results of a Special Election in such Community Facilities District on the Proposition of the Annual Levy of Special Taxes within the Territory Proposed to be Annexed to said Community Facilities District to Pay the Cost of Certain Services to be Provided by the Community Facilities District, Determining that the Territory Proposed to be Annexed is Added to and Part of said Community Facilities District with Full Legal Effect, and Ordering the Recording of a Map of the Boundaries of said Community Facilities District Including the Territory Annexed Thereto (Annexation No. 1. Farmer opened the public hearing. Farmer asked if the notice of public hearing was mailed and published in accordance with the law. Hubert stated yes. Selling introduced Bill Forrest, Senior Civil Engineer, who gave the report. Farmer opened hearing to protests, comments and questions from interested persons, including persons owing property within Annexation No. 1 (Veranda) of Community Facilities District No. 2020-1 and hearing none, announced that no further public testimony would be accepted Farmer asked if any written protests had been received. Hubert stated no. Farmer asked if there were any persons registered to vote within Annexation No. 1 (Veranda) of Community Facilities District 2020-1 and if so, how many. Hubert stated the County of Sacramento Registrar of Voters had certified there were no registered voters within Annexation No. 1 (Veranda) of Community Facilities District No. 2020-1. Farmer asked if the owner of all of the taxable property in Annexation No. 1 (Veranda) of Community Facilities District 2020-1 had consented to holding the Special Election on April 6, 2021. Hubert stated yes. Farmer asked if Hubert concurred that the Special Election would be held on April 6, 2021. Hubert stated yes. Farmer closed the public hearing. ACTION: Upon a motion by Sandhu, seconded by Lozano, adopting Resolution No. 2021-14 was approved 4-1 by a roll call vote of city council members present. Absent: Papineau Hubert stated the official ballot had been opened and all votes were in favor of the proposition presented on the ballot. ACTION: Upon a motion by Sandhu, seconded by Vandenburg, introducing Ordinance No. 2021- 05 was approved by a unanimous roll call vote. REGULAR CALENDAR: CITY MANAGER’S OFFICE: 1. SUBJECT: Coronavirus (COVID-19) Update. RECOMMENDED ACTION: Information only. Hines gave the update. 2. SUBJECT: Re-Opening of City of Galt Offices/Facilities. RECOMMENDED ACTION: Discussion of issues and logistics relative to the re-opening of City offices and facilities from the extended closure due to the COVID-19 pandemic; provide direction on reopening. Hines gave the report. City Council directed staff to prepare for immediate reopening of the council chambers for in- person meetings on June 15 when the State of California was presumably authorized to reopen by the Governor. City Council also directed staff to report back regarding the reopening of City facilities. FINANCE DEPARTMENT: 3. SUBJECT: City of Galt Long Range Financial Plan Update. RECOMMENDED ACTION: Present updated Long Range Financial Plan. Tyson gave the update and answered City Council questions. COMMUNICATION: None. GALT CITY COUNCIL MINUTES REGULAR MEETING OF APRIL 6, 2021 PAGE 8 CITY CLERK’S REPORT: None. COMMENTS BY STAFF: Tyson thanked City Council’s attention to the Long Range Financial Plan. Solis said T-ball had started and opening day would be on April 24; however, the traditional opening day ceremonies would not be performed due to COVID restrictions. Solis said the County extended their COVID testing at Parks and Recreation though April. He also asked the council and public to be mindful that it was growing season and to please be patient while staff tends to the parks and streetscapes. Van Steyn gave an update on the open positions within the city. Kalinowski spoke about an incident regarding an aggressive vicious dog and stated the officer acted appropriately. He said on Thursday, April 15, 3:00 pm, and in compliance with social distancing and other mandated requirements, there would be a ceremonial swearing in of two police officers and two dispatchers in front of the police station and was inviting city council, members of the public and staff to attend. COMMENTS BY CITY COUNCIL MEMBERS/FUTURE AGENDA ITEMS: VICE MAYOR SANDHU: Thanked staff for the reports and for all the public comments. He appreciated the feedback. He asked about researching the status of the county fair. COUNCIL MEMBER PAPINEAU: Thanked staff for the thorough reports. COUNCIL MEMBER VANDENBURG: Thanked staff for the reports. He requested that the opening of the Market on weekends/evenings be brought forward at the next City Council meeting. After discussion, Farmer and Sandhu expressed support for bringing the item back to City Council in May. COUNCIL MEMBER LOZANO: Said he would be in attendance at the April 20 City Council meeting and that Council Member Papineau would not need to attend the SACOG meeting in his absence. He would be leaving town on April 21. MAYOR FARMER: Thanked staff for their work on the market presentation and said he was confident with Parks and Recreation on their handling of the weeds issue. He thanked the Chief for the radar trailer on south Lincoln Way. He requested that a discussion item with the Chief of Police be brought back regarding speed enforcement. After discussion, Vandenburg and Sandhu expressed support for bringing the item back to City Council.
