CITY OF GALT MINUTES REGULAR CITY COUNCIL MEETING Council Chambers, 380 Civic Drive, Galt, California Tuesday, April 19, 2022 This meeting of the Galt City Council was conducted by video/teleconference in compliance with the State and County Shelter at Home Orders, and as allowed by the Governor’s Assembly Bill (AB) 361, which allowed for a deviation of teleconference rules required by the Brown Act. Council Members and City staff attended in-person in the Council Chambers and the meeting was broadcast on Metro Cable and livestreamed on the City’s website. The Mayor called the meeting to order at 6:03 pm. Council Members present: Papineau, Vandenburg, Lozano, Farmer. Absent: Sandhu. Staff Members present: City Manager Hines, City Clerk Hubert, Interim City Attorney Splendorio, Community Development Director Hoffman, Economic Development Manager Mendes, Finance Director Boring, Human Resources Director Van Steyn, Parks and Recreation Director Solis, Police Chief Kalinowski and Public Works Director Selling. OPENING CEREMONIES – Silent prayer was observed, the flag salute was recited and the City Clerk read the replay statement. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS: None. PRESENTATIONS: 1. Sacramento-Yolo Mosquito & Vector Control District Annual Report – Gary Goodman, General Manager. Gary Goodman, General Manager, gave the presentation. 2. Galt Police Department 2021 Annual Report – Police Department. Chief Kalinowski, gave the presentation. PUBLIC COMMENTS: David Herburger spoke in favor of the Galt Sunshine Food Pantry. Pastor Mary Maaga spoke about senior and Veteran housing. Bob Balliet spoke in favor of Pastor Mary Maaga’s projects with the Galt United Methodist Church. REPORTS BY CITY COUNCIL MEMBERS ON REGIONAL BOARDS, COMMISSIONS AND COMMITTEES: Farmer attended the CalWaste AdHoc Committee meeting with Lozano on April 18. Farmer also joined local Cub Scout Den 4, Pack 238 group. GALT CITY COUNCIL MINUTES REGULAR MEETING OF APRIL 19, 2022 PAGE 2 CONSENT CALENDAR APPROVAL, ADDITIONS AND/OR DELETIONS: Farmer pulled Item F4. 1. SUBJECT: Minutes of the Regular Meeting of April 5, 2022. RECOMMENDED ACTION: Accept the minutes as submitted. 2. SUBJECT: Receive and File Warrants for period ending April 7, 2022. RECOMMENDED ACTION: Receive and file warrants for the period ending April 7, 2022. 3. SUBJECT: AB 481 – Military Equipment Use Ordinance and Policy for the Police Department Second Reading. RECOMMENDED ACTION: Adopt Ordinance 2022-02 adopting the Military Equipment Use Policy Pursuant to AB 481 for the Galt Police Department. On April 5, 2022, City Council introduced the Ordinance and waived further reading. 5. SUBJECT: AB 361 Resolution Making Findings Necessary to Conduct Brown Act Meetings by Teleconference. RECOMMENDED ACTION: Adopt Resolution No. 2022-24 authorizing remote teleconference meetings of the legislative bodies of the City of Galt. ACTION: Upon a motion by Vandenburg, seconded by Lozano, the consent calendar was approved by a 4-0 roll call vote with Sandhu absent. CONSENT CALENDAR: 4. SUBJECT: Unmanned Aerial System (UAS) Appropriation. RECOMMENDED ACTION: Adopt Resolution No. 2022-25 approving the appropriation of $46,000 in Measure R revenue and expenditures for the purchase of equipment and training for the implementation of an Unmanned Aerial System (UAS) program. Item pulled for clarification on appropriation amount. ACTION: Upon a motion by Lozano, seconded by Papineau, adopting Resolution No. 2022-25 was approved by a 4-0 roll call vote with Sandhu absent. SCHEDULED MATTERS/NOTICE OF PUBLIC HEARING: None. REGULAR CALENDAR: CITY MANAGER’S OFFICE: 1. SUBJECT: Fiscal Years 2022-2024 Narrative Budget Report. RECOMMENDED ACTION: Receive a presentation about the FY 2022-2024 budget and consider and discuss budget strategies recommended by the City Manager. Hines gave the report and answered City Council questions. PARKS AND RECREATION DEPARTMENT: 2. SUBJECT: Introduce by Title Only and Waive Reading of Ordinance to Amend Section 12.12.020 of the Galt Municipal Code Regarding Definitions. RECOMMENDED ACTION: Introduce, by title only, and waive first reading of Ordinance 2022-03 amending Section 12.12.020 of the Galt Municipal Code entitled “Definitions” modifying the “Park” definition to ensure it includes all Park-related property. GALT CITY COUNCIL MINUTES REGULAR MEETING OF APRIL 19, 2022 PAGE 3 Solis gave the report. ACTION: Upon a motion by Lozano, seconded by Farmer, introducing Ordinance No. 2022-03 was approved by a 4-0 roll call vote with Sandhu absent. 3. SUBJECT: City Of Galt Special Event Sponsorship Program Preview Fiscal Year 2022-2023. RECOMMENDED ACTION: Preview the Special Event Sponsorship requests for fiscal year 2022- 2023 and provide direction regarding sponsorship of funds and in-kind services. Solis gave the report. Gale Webber, spoke on behalf of L’Chayim of Galt. Bonnie Rodriquez, spoke on behalf of the Galt Chamber of Commerce. Erin Saldivar, spoke on behalf of the Galt High Alumni Association. PUBLIC WORKS DEPARTMENT: 4. SUBJECT: Award of Construction Contract for the 2022 Gora Aquatic Center Pool Heater Replacement Project, CIP 53I. RECOMMENDED ACTION: Adopt a resolution: 1) Authorizing the City Manager to execute a construction contract with Tricon Construction, Inc. In the amount of $293,600 for the 2022 Gora Aquatic Center Pool Heater Replacement Project, Capital Improvement Program (CIP) No. 53I; 2) Authorizing a 10% project contingency in the amount of $29,360; 3) Authorizing the Public Works Director to execute contract change orders within the approved contingencies; and 4) Authorizing the Public Works Director to accept the improvements and issue a Notice of Completion upon satisfactory completion of the work Selling gave the report and answered City Council questions. Ron Ybarra voiced his opinion regarding the qualified bidding process. Harry Wensel expressed his thoughts regarding the project. Farmer made a motion, seconded by Vandenburg, to reject staff’s recommendation and to rebid only the pool heater project, allowing C53 contractors to also bid on the project. Papineau made a substitute motion, seconded by Lozano, to reject staff’s recommendation and to rebid the pool heater project either separately or together with the pool replastering project, depending on which was more beneficial to the City after Public Works’ research, and allowing all capable contractors, including C53 contractors, to be able to bid on the project. ACTION: Upon a motion by Papineau, seconded by Lozano, rejecting staff’s recommendation, rebidding the pool heater project either separately or together with the pool replastering project, depending on which was more beneficial to the City after Public Works’ research, and allowing all capable contractors, including C53 contractors, to be able to bid on the project, failed due to a lack of majority vote with Farmer and Vandenburg dissenting. ACTION: Upon a motion by Farmer, seconded by Vandenburg, rejecting staff’s recommendation, rebidding only the pool heater project, and allowing C53 contractors to also bid on the project, failed due to a lack of majority vote with Papineau and Lozano dissenting. CITY CLERK’S REPORT: None. COMMENTS BY STAFF: Hines said the City was submitting a proposal with Supervisor Don Nottoli to access the County ‘s ARPA funds for help with purchasing new playground equipment. Hoffman said the housing element would be presented at the May 3 council meeting. Selling said the Fourth Street ADA enhancements project was completed. He also said there was an additional battery recycling box located at Galt Community Park near the fire station. Kalinowski said the Sacramento Police and Sheriff’s Memorial would be April 28, followed by the State memorial on May 2 and the Federal memorial being held May 11-16. He also gave an update on promotions within the department. Solis gave an update on the mowing of the landscapes due to the different weather conditions. COMMENTS BY CITY COUNCIL MEMBERS/FUTURE AGENDA ITEMS: VICE MAYOR SANDHU: Absent. COUNCIL MEMBER PAPINEAU: Thanked staff for their hard work and thanked the public for their public comments. COUNCIL MEMBER VANDENBURG: Thanked staff and said he appreciated the public comments. He asked about the lighting of the water tower and staff said they would like to meet with the resident and Vandenburg said he would be in contact. He asked about the homeless, vegetation and habitat problems near Dry Creek. City Council asked the item be brought back to City Council when all agencies involved could participate in the meeting. COUNCIL MEMBER LOZANO: Thanked everyone who spoke at the meeting. He thanked Craig Hoffman for his timely response regarding an issue a citizen brought to his attention. He said the Galt Area Historical Society’s Eggstravaganza and Kite Day was a great event and thanked all involved. MAYOR FARMER: Echoed his thanks to Craig Hoffman for his prompt response. He thanked staff for the reports and appreciated their professional opinions. He also said the Eggstravaganza was a great event. He asked Chief Kalinowski to send the memorial dates. He asked if staff would provide regular updates on the senior housing issue. There being no further business to come before City Council, the Mayor adjourned the meeting at 10:19 pm.
