CITY OF GALT MINUTES SPECIAL CITY COUNCIL MEETING – CLOSED SESSION Council Chambers, 380 Civic Drive, Galt, California Tuesday, July 21, 2020 This meeting of the Galt City Council was conducted by video/teleconference in compliance with the State and County Shelter at Home Orders, and as allowed by the Governor’s Executive Order N-29- 20, which allowed for a deviation of teleconference rules required by the Brown Act. The Mayor called the meeting to order at 2:04 pm. Council Members present: Lozano, Campion, Lampson and Sandhu. Absent: Farmer Staff members present: Interim City Manager Haglund, City Clerk Hubert and Interim City Attorney Hood. PUBLIC COMMENTS: The City Clerk announced there were no public comments regarding the closed session itemS. Farmer entered the meeting at 2:10 pm. ADJOURNED TO SPECIAL CLOSED EXECUTIVE SESSION: 1. CONFERENCE WITH REAL PROPERTY NEGOTIATORS pursuant to and under the authority of Government Code Section 54956.8 Property: APN 148-0010-053-0000 10059 Twin Cities Road Agency negotiators: Thomas Haglund, Interim City Manager; Mike Selling, Public Works Director Negotiating parties: California Waste Recovery, Inc. Under negotiation: Price and terms of payment 2. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION pursuant to and under the authority of Government Code Section 54956.9(d)(4) Initiation of litigation (One potential case) 3. CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION pursuant to and under the authority of Government Code Section 54956.9(d)(2) Significant exposure to litigation (One potential case) RECONVENED TO OPEN SESSION: The City Council reconvened to open session at 4:03 pm at which time the Interim City Attorney announced there was no reportable action on Item No. 1. Item No. 2: Council unanimously authorized city to initiate litigation if necessary; further disclosure will be made upon inquiry if litigation is formally commenced, unless to do so would jeopardize the City’s ability to conclude existing settlement negotiations. Item No. 3: Council unanimously authorized City to negotiate a tolling agreement with the environmental groups threatening litigation regarding the City’s Climate Action Plan and authorized legal counsel to defend the City if litigation is filed. Council Agenda Report Meeting Date: July 21, 2020 FROM: Kimberly Hood, Interim City Attorney SUBJECT: Closed Session Item #3 (Special Meeting) Conference with Legal Counsel – Anticipated Litigation Government Code section 54956.9(d)(2) (1 case) On July 16, 2020, I received a voice message from and spoke by telephone with attorney Don Mooney, who informed me that he represents several environmental groups prepared to file a legal challenge to the City of Galt’s Climate Action Plan (CAP). The Interim City Attorney has determined that this statement qualifies as “existing facts and circumstances” under the Brown Act, specifically Government Code section 54956.9(e)(5) and that there is significant exposure to litigation pursuant to Government Code section 54956.9(d)(2).
