INTERGOVERNMENTAL AGREEMENT – consider approval of Amendment No. 2 to Intergovernmental Agreement No. 2013-3001-0088 with City of Mesa for crime scene and specified laboratory services and authorize the Mayor to execute the required documents. 11. INTERGOVERNMENTAL AGREEMENT – consider approval of Intergovernmental Agreement No. 2015-7008-0779 with Chandler Unified School District for the Queen Creek Road and 156th Street Traffic Signal Project, Project No. TS183, and authorize the Mayor to execute the required documents. 12. GRANT – consider application and acceptance of 2015 Justice Assistance Grant (JAG) No. 2015-3001-0784 from the Department of Justice Office Justice Programs for a covert Automated License Plate Reader (ALPR) unit in the amount of $15,830. 13. AGREEMENT – consider approval of Agreement No. 2015-4106-0769 with R.D. Sanders Construction Co., LLC in an amount not to exceed $250,000 for Asphalt Patching and Miscellaneous Repair effective July 1, 2015 and terminating June 30, 2016 with an option to renew and authorize the Mayor to execute the required documents. 16. AGREEMENT– consider approval of Agreement Nos. 2016-4108-0003, 2016-4108- 0007, 2016-4108-0004, and 2016-4108-0006 with Keller Electrical, Weber Water Resources, Phoenix Pumps, and Southwest Waterworks, respectively, for pump services in the amount not to exceed $730,000, effective upon award and terminating June 30, 2016 with option to renew, and authorize the Mayor to execute the required documents. 17. AGREEMENT– consider approval of Agreement Nos. 2016-4108-0009, 2016-4108- 0010, 2016-4108-0011 for new hydrants and parts with Clow Valve Company, HD Supply Waterworks, and Dana Kepner, respectively, in the amount not to exceed $150,000, effective upon award and terminating June 30, 2016 with option to renew, and authorize the Mayor to execute the required documents. 18. CONTRACT – consider approval of Job Order Contract (JOC) Task Order No. 17 for Contract No. 2014-4106-0291 with Talis Corporation in an amount not to exceed $331,472.50 for Bus Stop Passenger Improvements - Phase III, Project No. ST111, and authorize the Mayor to execute the required documents. 20. CONTRACT – consider approval of Job Order Contract (JOC) Task Order No. 37 for Contract No. 2013-7003-0180 with CS Construction in an amount not to exceed $221,536.15 for the Higley and Agritopia Loop Traffic Signal, Project No. TS179, and authorize the Mayor to execute the required documents. 21. CHANGE ORDER – consider: a) approval of Change Order No. 1 to Contract No. 2014-7003-0143 with Arcadis US increasing the contract amount by $60,420 for Germann Road Improvements, Val Vista to Higley, Project No. ST058; and b) authorize a Water Fund Contingency Transfer in the amount of $260,000. 22. CONTRACT– consider approval of the guaranteed maximum price (GMP) Change Order No. 2 to Contract No. 2015-7013-0519 with ET Environmental increasing the contract amount by $2,250,495 for the for the Compressed Natural Gas Fueling Station, Project No. MF228. 24. STREETLIGHT IMPROVEMENT DISTRICT SL15-03 - consider adoption of a Resolution creating Streetlight Improvement District No. 15-03 for White Fence Estates and ordering the improvements. 25. STREETLIGHT IMPROVEMENT DISTRICT SL14-04 - consider adoption of a Resolution creating Streetlight Improvement District No. 15-04 for Greenfield Meadows and ordering the improvements. 26. FEES - consider new and updated fees and adoption of: a) a Resolution establishing a use permit amendment fee and terms;  b) a Resolution establishing adolescent intensive process group fees and counseling fees and terms; c) a Resolution establishing special event permit fees and terms; and d) a Resolution establishing a fee schedule for Gilbert parks, basins and outdoor recreation facilities, Sports fields and lighting, recreation centers and indoor facilities, and municipal swimming pools. 33. BUDGET / CIP - consider approval of a CIP transfer to the Warner and Higley Road Improvement Project, Project No. ST152, in the amount of $700,000 utilizing General Obligation Bonds as the funding source. 34. BUDGET / CIP - consider approval of a Contingency Transfer in the amount of $1,829,500 with General Obligation Bonds as the designated revenue source to reimburse Maricopa County for Gilbert's share of design and construction costs, Williams Field Road - Gilbert Road to Eastern Canal, Project No. ST049, Maricopa County Project TT098, pursuant to IGA C91-11-025-M-00, Contract No. 2011-7003-0056. 35. HUMAN RESOURCES / BUDGET - consider approval of a General Fund Contingency Transfer in the amount of $9,000 to over fill the Deputy Town Clerk due to anticipated Town Clerk retirement on November 5, 2015 and appoint Lisa Maxwell to the Town Clerk position effective November 9, 2015. 36. BOARDS AND COMMISSIONS – consider acceptance of resignation of Greg Hansen from the Parks, Recreation and Library Services Advisory Board. 37. MINUTES – consider approval of the minutes of Special Meeting of June 23, 2015, Special Meeting of June 25, 2015 and Regular Meeting of June 25, 2015. LIQUOR LICENSE – conduct hearing and consider approval of a Series 10 Beer and Wine Store Liquor License for Sandhu Chevron #3 located at 1570 South Gilbert Road. 39. LIQUOR LICENSE – conduct hearing and consider approval of a Series 12 Restaurant Liquor License for 1455 American Grill located at 1455 West Elliot Road, Suite 101. 40. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona, Chapter 58, Privilege and Excise Taxes, declaring the 2015 Amendments to the Tax Code of the Town of Gilbert a public record, adopting the reference the 2015 Amendments to the Tax Code of the Town of Gilbert, and eliminating two privilege tax classifications and lowering the tax rate to 0.0% on two additional tax classifications. 41. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona, by amending Chapter 10 Buildings and Construction Regulations, Article VI Public Works, by amending Sections 10-201 Adoption of Uniform Standard Specifications and Details for Public Works Construction and 10-202 Adoption of 1984 Supplement to Standard Specifications for Public Works Construction related to standards of Public Works construction. 42. GENERAL PLAN GP15-01/ ZONING Z15-02 – conduct hearing and consider: a) adoption of a Resolution approving a Minor General Plan amendment for Copper Landing to change the land use classification of approximately 14.3 acres of real property generally located southeast of the southeast corner of Guadalupe and McQueen Roads from Community Commercial land use classification to Residential >5-8 DU/AC land use classification. The effect of this amendment will be to change the plan of development for the property to allow for residential development; and b) approval of the findings and adoption of an Ordinance for Copper Landing rezoning approximately 14.3 acres of real property generally located southeast of the southeast corner of Guadalupe and McQueen Roads from Town of Gilbert Community Commercial (CC) to Single Family Detached (SF-D) zoning district with a Planned Area Development (PAD) overlay zoning district to modify the maximum lot coverage and required setbacks. The effect of the rezoning will be to allow a residential development with approximately 90 detached auto-cluster homes with increased maximum lot coverage and reduced setbacks. 43. GENERAL PLAN GPZ15-04/ZONING Z15-09 – conduct hearing and consider: a) adoption of a Resolution approving a Minor General Plan amendment for Avilla Town Square to change the land use classification of approximately 16.15 acres of real property generally located east of the northeast corner of Gilbert Road and Warner Road from 0.11 acres of Town of Gilbert Residential > 2-3.5 DU/ acre and 16.04 acres of Town of Gilbert General Commercial (GC) land use classifications to 0.43 acres of Utility/Transportation Corridor (U/TC) and 15.72 acres of Town of Gilbert Residential > 8-14 DU/ acre land use classifications. The effect of this amendment will be to change the plan of development for this property to allow for increased density of residential development; and  b) approval of the findings and adoption of an Ordinance for Avilla Town Square amending Ordinances No. 427 and 617 to remove approximately 0.11 acres of real property generally located at the northwest corner of Civic Center Drive and Warner Road from the Settler's Point Planned Area Development (PAD) and to rezone said real property from Town of Gilbert Single Family 7 (SF-7) zoning district with a Planned Area Development overlay zoning district to Multi-Family Low (MF/L) zoning district, all with a Planned Area Development overlay zoning district as shown on the exhibit (map) which is available for viewing in the Planning and Development Services Office, and also to rezone approximately 16.04 acres of real property generally located east of the northeast corner of Gilbert Road and Warner Road from Town of Gilbert General Commercial (GC) zoning district to 15.72 acres of Multi-Family Low (MF/L) and 0.43 acres of Public Facility/Institutional (PF/I) zoning districts, all with a Planned Area Development Overlay District to modify the standards of development to reduce side and rear setbacks, reduce the required minimum separation between buildings, reduce the minimum separation wall height, reduce the total minimum required open space, and reduce the required landscaping abutting an arterial street. The effect of the rezoning will be to allow the real property to be developed subject to the development standards for the Multi-Family Low (MF/L) zoning district as set forth in the Land Development Code to allow multi-family housing with approximately 152 dwelling units, and to continue to allow public facility uses occurring on certain portions of the property. 44. GENERAL PLAN GP15-04/ZONING Z15-11 – conduct hearing and consider: a) adoption of a Resolution approving a Minor General Plan amendment for Fiesta Tech Logistics Center to change the land use classification of approximately 16.73 acres of real property generally located east of the intersection of Colorado Street and Desert Lane from General Commercial (GC) land use classification to Light Industrial (LI) land use classification. The effect of this amendment will be to change the plan of development for this property to allow for development compatible with industrial uses; and b) approval of the findings and adoption of an Ordinance for Fiesta Tech Logistics Center rezoning approximately 16.73 acres of real property generally located east of the intersection of Colorado Street and Desert Lane from Town of Gilbert General Commercial (GC) zoning district to Light Industrial (LI) zoning district. The effect of the rezoning will be to permit industrial uses. ADMINISTRATIVE ITEMS Administrative Items are for Council discussion and action. GENERAL PLAN GP15-01/ ZONING Z15-02 – conduct hearing and consider: a) adoption of a Resolution approving a Minor General Plan amendment for Copper Landing to change the land use classification of approximately 14.3 acres of real property generally located southeast of the southeast corner of Guadalupe and McQueen Roads from Community Commercial land use classification to Residential >5-8 DU/AC land use classification. The effect of this amendment will be to change the plan of development for the property to allow for residential development; and b) approval of the findings and adoption of an Ordinance for Copper Landing rezoning approximately 14.3 acres of real property generally located southeast of the southeast corner of Guadalupe and McQueen Roads from Town of Gilbert Community Commercial (CC) to Single Family Detached (SF-D) zoning district with a Planned Area Development (PAD) overlay zoning district to modify the maximum lot coverage and required setbacks. The effect of the rezoning will be to allow a residential development with approximately 90 detached auto-cluster homes with increased maximum lot coverage and reduced setbacks. 43. GENERAL PLAN GPZ15-04/ZONING Z15-09 – conduct hearing and consider:  a) adoption of a Resolution approving a Minor General Plan amendment for Avilla Town Square to change the land use classification of approximately 16.15 acres of real property generally located east of the northeast corner of Gilbert Road and Warner Road from 0.11 acres of Town of Gilbert Residential > 2-3.5 DU/ acre and 16.04 acres of Town of Gilbert General Commercial (GC) land use classifications to 0.43 acres of Utility/Transportation Corridor (U/TC) and 15.72 acres of Town of Gilbert Residential > 8-14 DU/ acre land use classifications. The effect of this amendment will be to change the plan of development for this property to allow for increased density of residential development; and b) approval of the findings and adoption of an Ordinance for Avilla Town Square amending Ordinances No. 427 and 617 to remove approximately 0.11 acres of real property generally located at the northwest corner of Civic Center Drive and Warner Road from the Settler's Point Planned Area Development (PAD) and to rezone said real property from Town of Gilbert Single Family 7 (SF-7) zoning district with a Planned Area Development overlay zoning district to Multi-Family Low (MF/L) zoning district, all with a Planned Area Development overlay zoning district as shown on the exhibit (map) which is available for viewing in the Planning and Development Services Office, and also to rezone approximately 16.04 acres of real property generally located east of the northeast corner of Gilbert Road and Warner Road from Town of Gilbert General Commercial (GC) zoning district to 15.72 acres of Multi-Family Low (MF/L) and 0.43 acres of Public Facility/Institutional (PF/I) zoning districts, all with a Planned Area Development Overlay District to modify the standards of development to reduce side and rear setbacks, reduce the required minimum separation between buildings, reduce the minimum separation wall height, reduce the total minimum required open space, and reduce the required landscaping abutting an arterial street. The effect of the rezoning will be to allow the real property to be developed subject to the development standards for the Multi-Family Low (MF/L) zoning district as set forth in the Land Development Code to allow multi-family housing with approximately 152 dwelling units, and to continue to allow public facility uses occurring on certain portions of the property. 44.
