ITEMS WILL NOT BE DISCUSSED PRIOR TO POSTED MEETING TIME. ADDENDUM RECESS REGULAR MEETING AND RECONVENE IN EXECUTIVE SESSION Pursuant to: a) A.R.S. Sec. 38-431.03(A)(3),(4) & (7) for discussion and consultation with designated Town representatives and legal advice with the Town Attorney regarding negotiations for the purchase, sale or lease of real property in the Heritage District at the southeast corner of Vaughn and Ash Streets, 310 N. Gilbert Road, and on E. Hearn Way; and b) A.R.S. Sec. 38-431.03(A)(3)&(4) for discussion and consultation and legal advice with the Town Attorney and Special Counsel regarding Verizon Wireless 4G LTE testing in Gilbert. ADJOURN EXECUTIVE SESSION AND RECONVENE REGULAR MEETING ADMINISTRATIVE ITEMS 23A. LEGAL- consider authorizing Town Attorney to proceed with legal proceedings, as necessary, with Verizon Wireless for the protection of the regional public safety communications system. AGENDA ITEM CALL TO ORDER INVOCATION AND PLEDGE OF ALLEGIANCE The invocation may be offered by a person of any religion, faith, belief or non-belief, as well as Councilmembers. A list of volunteers is maintained by the Town Clerk and interested persons should contact the Clerk for further information. Mayor invites all scouts present to the front of the Council Chambers. Pledge of Allegiance and introduction and recognition of scouts. Invocation by Councilmember. ROLL CALL PRESENTATIONS; PROCLAMATIONS 1. Presentation of Certificates of Appreciation to representatives of Gilbert Sister Cities who visited Leshan, China. 2. Proclamation declaring October 18 through 24, 2015 as Arizona Cities and Towns Week. COMMUNICATIONS FROM CITIZENS At this time, members of the public may comment on matters within the jurisdiction of the Town but not on the agenda. The Council’s response is limited to responding to criticism, asking staff to review a matter commented upon, or asking that a matter be put on a future agenda. CONSENT CALENDAR All items listed below are considered consent calendar items and may be approved by a single motion unless removed at the request of Council for further discussion/action. Other items on the agenda may be added to the consent calendar and approved under a single motion. 3. INTERGOVERNMENTAL AGREEMENT – consider: a) approval of Intergovernmental Agreement No. 2016-2106-0107 with the Flood Control District of Maricopa County for Preparation and Cost Sharing of Floodplain Elevation Certificates within the Chandler-Gilbert Floodplain Delineation Study Area and authorize the Mayor to execute the required documents; and b) authorize a General Fund Contingency Request in the amount of $75,000. 4. PUBLIC SAFETY - consider adoption of a Resolution adopting the 2015 Maricopa County Multi-Jurisdictional Multi-Hazard Mitigation Plan. 5. CONTRACT – consider approval of renewal of Contract No. 2014-4106-0368 with ViaSun Corporation in an amount not to exceed $1,795,990.07 for Street Renovation and Microseal Services effective upon award and terminating June 30, 2016 with option to renew and authorize the Mayor to execute the required documents. 6. CONTRACT - consider approval of Cooperative Purchasing Agreement No. 2016-1103- 0759 for heavy duty truck, construction and agricultural, industrial fleet and equipment parts, service and accessories pursuant to Maricopa County Contract #15021-C through July 31, 2016 with four (4) one-year extensions for an estimated amount of $120,000 annually and authorize the Mayor to execute the required documents. 7. CONTRACT – consider approval of Job Order Contract No. 2016-4107-0018 with Joseph Painting Company, Inc. in an amount not to exceed $600,000 for miscellaneous coatings and rehabilitation services of sewer manholes, sewer lift station wet wells, chemical containment areas, water booster stations and water treatment plant structures and authorize the Mayor to execute the required documents. 8. CONTRACT – consider: a) approval of Job Order Contract (JOC) - Task Order No. 48 with Contract No. 2013-7003- 0180 with CS Construction, Inc. in an amount not to exceed $261,319.36 for the Traffic Signal at Lindsay Road and Settlers Point Drive, Project No. TS177, and authorize the Mayor to execute the required documents; and b) authorize a CIP Contingency Transfer in the amount of $20,000 and the use of the Traffic Signal System Development Fees fund as the designated revenue source. 9. CONTRACT – consider: a) approval of Job Order Contract (JOC) - Task Order No. 50 with Contract No. 2013-7003- 0180 with CS Construction, Inc. in an amount not to exceed $258,554.72 for the Ray and Recker Traffic Signal, Project No. TS123, and authorize the Mayor to execute the required documents; and b) authorize a Traffic Signal Fund Contingency Transfer in the amount of $20,000 and the use of the Traffic Signal System Development Fees fund as the designated revenue source. 10. GRANT – consider: a) authorizing application and acceptance of a grant, Contract No. 2016-3001-0090, from the FY2015 Internet Crimes Against Children (ICAC) in the amount not to exceed $50,000; and b) authorize a Grant Contingency Transfer in an amount not to exceed $50,000 for the FY2016 Internet Crimes Against Children (ICAC) grant. 11. BUDGET / PUBLIC WORKS - consider: a) authorizing payment to the City of Mesa in accordance with Intergovernmental Agreement 2004-7010-0078 in an amount of $1,183,321 for Gilbert’s cost share of the Greenfield Water Reclamation Plant Odor Control Project; and b) approval of a FY2016 Wastewater Contingency Fund Transfer in an amount of $1,183,321 for Gilbert’s cost share of the Greenfield Water Reclamation Plant Odor Control Project. 12. BUDGET – consider re-authorizing monies for the Repair Services Contract No. 2015- 7003-0727 with RD Sanders Contracting LLC in an amount not to exceed $92,300 for the Rome and Mercy Asphalt Repair Project. 13. STREETLIGHT IMPROVEMENT DISTRICT 15-10 - consider adoption of a Resolution creating Streetlight Improvement District No. 15-10 Cooley Station Parcel 15 Phase 2 and ordering the improvements. 14. MAP OF DEDICATION S09-02 – consider approval of the Map of Dedication for Adora Trails - Parcel 14 Local Access Road located south and west of the intersection of 164th Street and Riggs Road. 15. FINAL PLAT S09-02 - consider approval of the final plat for Adora Trails - Parcel 10 located south and west of the intersection of 164th Street and Riggs Road. 16. FINAL PLAT SP1134 - consider approval of the final plat for Tierra Office Park Condominium located east of the northeast corner of McQueen and Elliot Roads. 17. FINAL PLAT SP1383 - consider approval of the final plat South Wade Drive Church Subdivision located at the southeast corner of Wade Drive and Vest Avenue. 18. FINAL PLAT SP1464 - consider approval of the Minor Subdivision Plat of Mariposa Point of Gilbert located on the south side of Willis Road between Quartz Street and Val Vista Drive. 19. BOARDS AND COMMISSIONS - consider: a) acceptance of the recommendation of the Gilbert Educational Cable Access Governing Board to disband the Gilbert Educational Cable Access Governing Board as established under the Code of Gilbert, Section 18-32 Educational access channels; and b) direct staff to continue the interconnection of the educational access channel with Chandler as implemented on September 16, 2003. 20. MINUTES – consider approval of the minutes of Regular Meeting of October 1, 2015. PUBLIC HEARING Items will be heard at one Public Hearing; at which time anyone wishing to comment on a Public Hearing Item may do so. Comments will be heard from those in support of or in opposition to an item. Hearings are noticed for 7:00 p.m. In order to comment on a Public Hearing Item, you must fill out a public comment form, indicating the Item Number on which you wish to be heard. Once the hearing is closed, there will be no further public comment unless requested by a member of the Council. After the Public Hearing, the Council may act on all items not requiring additional staff, public, or Councilmember comment with a single vote. 21. PROPERTY ACQUISITION – conduct hearing and consider approval of the acquisition of right-of-way and easement Parcel No. 304-71-093A for the Val Vista Drive – Appleby to Riggs Project, Project No. ST112, in an amount not to exceed $72,389 plus statutory interest. 22. APPEAL AP15-05 (DR15-27) - conduct hearing and consider appeal to the Gilbert Town Council from the Town of Gilbert Design Review Board's approval of the site plan, landscape plan, grading and drainage, elevations, lighting, colors and materials for Deseret Industries Retail Store, located at southeast corner of Val Vista Drive and Williams Field Road. The property is zoned Regional Commercial (RC). The Town Council may uphold, reverse, or modify the decision of the Design Review Board. If modified, the Town Council may impose conditions of development consistent with the standards set for the Regional Commercial zoning district. ADMINISTRATIVE ITEMS Administrative Items are for Council discussion and action. It is to the discretion of the majority of the Council regarding public input requests on any Administrative Item. Persons wishing to speak on an Administrative Item should complete a Request to Speak Form and indicate the Item they wish to address. Council may or may not accept public comment. 23. If your child is seated in the audience your child may be recorded, but you may request that your child be seated in a designated area to avoid recording.
