GRANDVIEW CITY COUNCIL REGULAR MEETING MINUTES OCTOBER 8, 2013 1. CALL TO ORDER Mayor Norm Childress called the regular meeting to order at 7:00 p.m. in the Council Chambers at City Hall. Present were: Mayor Childress and Councilmembers Mike Bren, Pam Horner, Bill Moore, Jesse Palacios, Javier Rodriguez and Joan Souders. Excused from the meeting was Councilmember Diana Jennings. Staff present were: City Administrator/Public Works Director Cus Arteaga, City Attorney Quinn Plant, Parks & Recreation Director Mike Carpenter, Fire Chief Pat Mason, Code Enforcement Officer Cory Taylor and City Clerk Anita Palacios. 2. PLEDGE OF ALLEGIANCE Councilmember Rodriguez led the pledge of allegiance. 3. PRESENTATIONS A. Museum Appreciation Plaque – Jeanne Marie Coursey Mayor Childress presented Jeanne Marie Coursey with a Community Service Award for her dignified and exceptional service to the patrons of the Ray E. Powell Museum. B. Partnership with Grandview Nazarene Church - Pastor Brent Hulett During the past year, the Grandview Nazarene Church partnered with the Parks & Recreation Department to assist in community events such as the annual Easter Egg Hunt. Pastor Brent Hulett was present on behalf of the church and reiterated the church’s continued partnership with the City to provide services to the community. C. YVCOG 2014 Budget – J. Page Scott, YVCOG Executive Director J. Page Scott, Executive Director of the Yakima Valley Conference of Governments presented the YVCOG 2014 budget. The budget would be presented for approval to the YVCOG General Membership at their meeting on October 16th. The City of Grandview’s Membership Assessment for 2014 would be $7,020 of which $4,404 was for the general assessment and $2,616 for the MPO/RTPO assessment. She pointed out that the City of Grandview was awarded $1,022,257 in STP regional funding for 2013. 4. PUBLIC COMMENT – None 5. CONSENT AGENDA On motion by Councilmember Horner, second by Councilmember Souders, Council unanimously approved the Consent Agenda consisting of the following: A. Payroll Electronic Fund Transfers (EFT) Nos. 5075-5080 in the amount of $70,453.96 D. Payroll Check Nos. 7039-7062 in the amount of $20,369.42 E. Payroll Direct Deposit 09/16/13–09/30/13 in the amount of $83,550.12 F. Claim Check Nos. 104444-104530 in the amount of $268,987.06 6. ACTIVE AGENDA A. Ordinance No. 2013-16 repealing Chapter 15.24 – Fire Prevention of the Grandview Municipal Code and enacting a new Chapter 15.24 – Fire Prevention In 2011, Council adopted the 2009 Edition of the International Fire Code. In the latter part of 2012 and early 2013, the 2012 Edition of the International Fire Code was reviewed by the State Building Code Council. The State Building Code Council then sent it to the State Legislature with their recommended amendments. The State Legislature adopted it in 2013 which then made it eligible for adoption on the local level as of July 1, 2013. An updated edition of the International Fire Code as published by the International Code Council was typically produced every three years. The passage of Ordinance No. 2013-16 to adopt the 2012 Edition of the International Fire Code would keep the community current on the standard of code enforcement that was occurring throughout the state. In an effort to provide a safe and stable environment for businesses to operate, one of the best tools was the Fire Code. The Fire Code would allow the City to make every effort to avoid any potential loss due to fire or injury for the business owner, the consumer and members of the emergency services. On motion by Councilmember Moore, second by Councilmember Souders, Council unanimously approved Ordinance No. 2013-16 repealing Chapter 15.24 – Fire Prevention of the Grandview Municipal Code and enacting a new Chapter 15.24 – Fire Prevention. B. Ordinance No. 2013-17 amending Grandview Municipal Code Chapter 15.04 to adopt the 2012 Editions of the International Building Code and International Residential Code In 2011, Council adopted the 2009 Edition of the International Building Codes. The 2012 editions of the model codes with Washington State amendments went into effect on July 1, 2013 which included adoption of the 2012 International Energy Conservation Code with Washington State amendments. Updated editions of the adopted codes were produced every three years. Passage of the ordinances would help to keep our community up to date on the standards of construction that were occurring throughout the state. The codes would help to ensure buildings and facilities constructed in the state were safe and healthy for building occupants, accessible to persons with disabilities and the elderly, and energy efficient. On motion by Councilmember Moore, second by Councilmember Souders, Council unanimously approved Ordinance No. 2013-17 amending Grandview Municipal Code Chapter 15.04 to adopt the 2012 Editions of the International Building Code and International Residential Code. Regular Meeting Minutes October 8, 2013 Page 3 C. Ordinance No. 2013-18 amending Grandview Municipal Code Chapter 15.08 to adopt the 2012 Edition of the Uniform Plumbing Code On motion by Councilmember Horner, second by Councilmember Moore, Council unanimously approved Ordinance No. 2013-18 amending Grandview Municipal Code Chapter 15.08 to adopt the 2012 Edition of the Uniform Plumbing Code. D. Ordinance No. 2013-19 amending Grandview Municipal Code Chapter 15.12 to adopt the 2012 Edition of the International Mechanical Code On motion by Councilmember Souders, second by Councilmember Rodriguez, Council unanimously approved Ordinance No. 2013-19 amending Grandview Municipal Code Chapter 15.12 to adopt the 2012 Edition of the International Mechanical Code. E. Ordinance No. 2013-20 amending Grandview Municipal Code Sections 15.52.010 and 15.52.020 to adopt the 2012 Edition of the International Energy Conservation Code On motion by Councilmember Horner, second by Councilmember Souders, Council unanimously approved Ordinance No. 2013-20 amending Grandview Municipal Code Sections 15.52.010 and 15.52.020 to adopt the 2012 Edition of the International Energy Conservation Code. F. Ordinance No. 2013-21 amending Grandview Municipal Code Chapter 15.54 to adopt the 2012 Edition of the International Property Maintenance Code On motion by Councilmember Moore, second by Councilmember Rodriguez, Council unanimously approved Ordinance No. 2013-21 amending Grandview Municipal Code Chapter 15.54 to adopt the 2012 Edition of the International Property Maintenance Code. G. Letter of Intent & Petition for Annexation – Port of Grandview (Forrest Road) The City received a Letter of Intent and Petition for Annexation and Rezone submitted by the Port of Grandview for Parcel No. 230915-24001 requesting their property be annexed to the City. The proposed annexation would include the property located on Forrest Road. The petitioners requested the area be annexed with an M-1 Light Industrial zoning. These parcels were included in the City’s Urban Growth Area. State law required the City Council to determine: (1) if the City would accept, modify or reject the proposed annexation, (2) whether the City would require the simultaneous adoption of a proposed zoning regulation for the subject property, and (3) whether the City would require the assumption of all or any portion of existing City indebtedness by the area to be annexed. Upon acceptance of the Letter of Intent, the Petition would be presented to the Hearing Examiner to conduct a public hearing. On motion by Councilmember Palacios, second by Councilmember Horner, Council unanimously accepted the proposed annexation, required the simultaneous adoption of zoning regulations consistent with the Urban Growth Area Future Land Use Designations – M-1 Light Industrial, required the assumption of all existing City indebtedness by the properties proposed to be annexed the same as all other property within the City in Regular Meeting Minutes October 8, 2013 Page 4 accordance with past practice, and referred the Petition for Annexation to the Hearing Examiner to conduct a public hearing. 7. UNFINISHED AND NEW BUSINESS – None 8. CITY ADMINISTRATOR AND/OR STAFF REPORTS Aerated Lagoon Repairs – City Administrator Arteaga reported that work continued on the removal of sludge from the bottom of the aerated lagoon utilizing temporary service workers. Downtown Street Tree Lights – The downtown street tree lights would be re-strung in preparation of the annual Halloween Haunted House and Carnival scheduled for October 25th & 26th. Irrigation Season – Irrigation water would be shut off on October 15th and the Public Works crew would begin winterization of the irrigation facilities. 9. MAYOR & COUNCILMEMBER MEETING REPORTS Everyday Hero Award – Councilmember Horner reminded Council of the Everyday Hero Award dinner in honor of Cookie Shannon scheduled for October 10th at the Immanuel Lutheran Church. Dog Park Fundraiser – Councilmember Souders reported that the Dog Park Committee scheduled their first Howl-O-Ween Dog Parade fundraiser on October 26th from 1:00 to 4:00 p.m., at the Palacios Parkway. 10. EXECUTIVE SESSION – Union Negotiations & Evaluate Applicant Qualifications for Public Employment Mayor Childress adjourned the meeting to an executive session at 7:30 p.m., for approximately 20 minutes to discuss union negotiations per RCW 42.30.140(4) and 20 minutes to evaluate applicant qualifications for public employment per RCW 42.30.110(1)(g) with the aforementioned Mayor, Councilmembers, City Administrator, City Attorney and City Clerk present. The meeting resumed at 8:10 p.m., with the aforementioned Mayor, Council and staff present. No action was taken. 11.
