SPECIAL CITY COUNCIL PROCEEDINGS
December 30, 2014
The Governing Body of the City of Green River met in special session at 6:30 pm in the City
Hall Council Chambers. Mayor Castillon called the meeting to order. The following Council
Members were present: Gary Killpack, Tom McCullough, and Brett Stokes. The following were
present representing the City: Acting City Administrator Chris Steffen, Director of Finance Jeff
Nieters,
RESOLUTIONS
Agreement with Jackman Construction
R14-70 A resolution of the Governing Body of the City of Green River, Wyoming, to approve an
Increase in the Capital Project Fund for the Southeast Water Project and the Water Pipe River
Crossing Project in the amount of $366,058 and to approve an agreement with Jackman
Construction, Inc. for finalization of the two projects and payment of utility taps owed the City.
Council Member Stokes moved to approve the resolution to increase the Capital Projects Fund
for the Southeast Water Project and the Water Pipe River Crossing Project in the amount of
$366,058 and to approve an agreement with Jackman Construction, Inc. for finalization of the
two projects and payment of utility taps owed the City. Council Member Killpack seconded.
Council Member McCullough asked for an explanation.
Mr. Nieters stated this agreement and resolution are to finalize two projects: the Southwest River
Crossing and the Water Pipe River Crossing and stated these two projects have been finished for
a couple of years. He stated himself, Mike Nelson, Matt and Lynn Jackman got together to go
over the two projects and try to get things finalized. They tried to come to an agreement on what
is fair and decided to pay $366,058 total to Jackman Construction for the Southeast Water
Project and the Water Pipe River Crossing Project. Once they accept this agreement the City will
advertise for final payment and close out these two projects.
Council Member McCullough asked if this project goes back four or five years and if this would
finalize those projects.
Mr. Nieters stated it does and it would finalize the projects.
Mayor Castillon asked if this agreement had gone through the City Attorney.
Mr. Nieters stated the City Attorney has been involved and is onboard with the agreement.
Council Member Killpack asked if the penalties were included in the settlement.
Mr. Nieters stated in going through all the documents and measuring the pipes they realized the
City did owe some money to Jackman Construction. They negotiated what they owed Lynn
Jackman and what they got for liquidated damages. They thought the amount was fair and felt
good about it. Tomorrow the City will write a check for $14,517.64 for the Water Pipe River
Crossing Project because it has already been advertised for final payment. The City will then
advertise for the Southwest Water Project. If no one comes forward in the 41 day window with a
lien against the project then the City will issue a check for any remaining balances. The City will
then receive a check from Jackman Construction for $67,788.97 for Water Taps Fees.

in on this project.
