CITY COUNCIL MEETING August 1 4, 2023 The Greenville City Council convened in the Council Chamber of City Hall on Monday, August 14, 2023, at 5:30 p.m. for a regular council meeting. Mayor Dexter McLendon called the meeting to order. City Clerk – Treasurer Dee Blackmon called the roll and recorded the following members present: Mayor McLendon, Councilmembers Ed Sims, Bryan Reynolds, and Joseph West. Councilmembers Jae’Ques Brown and Boris Thigpen was absent. Mayor McLendon led those attending in the Pledge of Allegiance to the American Flag. Eddie cook delivered the invocation. APPROVAL OF MINUTES: Mayor McLendon advised each councilmember had received for review a copy of the proposed minutes for the Regular Council Meeting held on July 24, 2023. He asked if there were any additions, deletions or amendments to the minutes as presented. Councilmember West moved to dispense with the reading of the minutes and approve the minutes for July 24, 2023, as drafted . Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. PROCLAMATIONS and PRESENTATIONS : NEW BUSINESS: ORDINANCE 2023-05. AN ORDINANCE AMENDING CHAPTER 12, WITH THE ADDITION OF ARTICLE IV, OF THE CODE OF ORDINANCES FOR THE CITY OF GREENVILLE, ALABAMA, TO REGULATE THE OPERATION OF GOLF CARTS ON CERTAIN STREETS WITHIN THE CITY. Councilmember Reynolds moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2023-0 5 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting. Councilmember West seconded the motion. Mayor McLendon called for a roll call vote to suspend the rules: Mayor McLendon Aye Councilmember Reynolds Aye Councilmember Sims Aye Councilmember West Aye Mayor McLendon declared the motion to suspend the rules passed . Mayor McLendon asked Chief Justin Lovvorn to explain Ordinance 2023-05. Chief Lovvorn stated golf cart means a four-wheeled, self-propelled vehicle used to transport persons or property, that is designed to operate at speeds no greater than 25 miles per hour. The term “cart” does not include off-road recreational vehicles such as a “side-by-side, ranger, 4-wheeler, or state tagged vehicle. Each cart shall be inspected to ensure that it is equipped with head lights mounted no higher than 36 inches and no lower than 12 inches, seat belts for driver and each passenger, brake lights, reflector on driver and passenger side, turn signals, a standard horn, a windshield, a rear-view mirror, efficient brakes and reliable steering apparatus. No permit shall be issued for any cart that fails such inspection. Proof of insurance is required and you must have a valid driver’s license (16 years of age or older). Once the cart passes inspection, you must display a permit sticker on driver and passenger side of golf cart (cost $50 per year). Permit will be valid for a three-year period, but a permit fee is due annually. Must be operated on a street with a speed limit of 25 mph or less. Carts may not be operated on any state highway regardless of speed limit. Mayor McLendon asked if anyone has questions or comments. Hearing none, Councilmember West moved to place Ordinance 2023-0 5 into final passage. Councilmember Reynolds seconded the motion. RESOLUTION 2023-27. A RESOLUTION ADOPTING THE ANNUAL TRANSPORTATION PLAN FOR REBUILD ALABAMA. Mayor McLendon called on Clerk Dee Blackmon to explain this resolution. In accordance with Section 23-8-8(d) and 23-8-8(e), Code of Alabama 1975, all municipalities must adopt, by majority vote of the council, an annual transportation plan that has a detailed list of projects for which expenditures are intended to be made in the next fiscal year based on an estimate of the revenues from the Rebuild Alabama Act funds. This is an annual requirement that must be done by August 31, 2023. The Rebuild Alabama Act does not require the city to expend any of the funds. However, it is still required to adopt an annual transportation plan, which indicates that we are saving those funds for future projects. Mayor McLendon asked if anyone has questions or comments. Hearing none, Councilmember Sims moved to adopt Resolution 2023-27 to adopt the annual transportation plan for rebuild Alabama. Councilmember West seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the council. RESOLUTION 2023-28. A RESOLUTION APPROVING CHANGE ORDER #1 TO RAY ENVIRONMENTAL FOR THE BROWNFIELDS GRANT. Mayor McLendon asked Clerk Dee Blackmon to explain. This resolution authorizes approval for Ray Environmental’s Change Order #1, in the amount of $18,726.50, for the Brownfield grant. This cost estimate is for removal of debris from the Boss building site. Mayor McLendon asked if anyone has questions or comments. Hearing none, Councilmember Reynolds moved to adopt Resolution 2023-2 8 to awarding the bid for country club pond cleanout to Southern Land Management. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the council. APPROVE NOMINATIONS FOR THE BUTLER COUNTY BOARD OF EQUALIZATION. The Alabama Department of Revenue has requested nominees for the Board of Equalization. Butler County, Georgiana and McKenzie, as well as the city, have the opportunity to nominate candidates to fill the position. The city would like to nominate Mrs. Glenn Cooper, Mr. Dave Crenshaw and Mr. Rick Bourne. Mayor McLendon asked if anyone has questions or comments. Hearing none, Councilmember Sims moved to nominate Mrs. Glenn Cooper, Mr. Dave Crenshaw, and Mr. Rick Bourne to the Board of Equalization. Councilmember West seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the council. APPROVAL OF EXPENDITURES: Mayor McLendon explained the following expenditures and asked if anyone has questions or comments. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council.
