AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GROVELAND,
FLORIDA, TO CHANGE THE ZONING FROM CITY OF GROVELAND TOWN EDGE
TO CITY OF GROVELAND TOWN CENTER FOR THE HEREIN DESCRIBED
PROPERTY OWNED BY RAVINDRA AND DEVIN DABTE AND LOCATED AT THE
NORTHWEST CORNER OF THE INTERSECTION OF ANDERSON ROAD AND
STATE ROAD 33 soum; DIRECTING THE CITY MANAGER TO AMEND THE
ZONING MAP AS HEREIN PROVIDED AFTER THE PASSAGE OF THIS
ORDINANCE; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES
TN CONFLICT HEREWITH; PROVIDING FOR SCRIVENER'S ERRORS, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Groveland, with consent of the owners, Ravindra and Devin Dabie,
initiates this rezoning from City of Groveland Town Edge to City of Groveland Town Center
because its prior zoning pennitted retail use and retain use is allowed under Town Center, but not
under Town Edge; and
WHEREAS, the subject property consists of 0.44 +/- acres having an address of 697 Anderson
Road, Groveland, and is more particularly described herein; and
WHEREAS, the property has a future land use designation of Town as shown on the City of
Groveland Comprehensive Plan Future Land Use Map; and
WHEREAS, the proposed zoning is consistent with the future land use designation; and
WHEREAS, the City of Groveland Plamring and Zoning Board recommended approval of a
change in the use ofthe Property; and
WHEREAS, the City has held such public heming and the records of the City provide that the
owners of the land affected have been notified as required by law.
NOW, THEREFORE, BE IT ORDAINED by the City Cmmcil ofthe City of Groveland, Florida,
as follows:
Section 1: Purpose and Intent.
That the zoning classification of the following descnbed property, being situated in the City of
Groveland, Florida, shall be hereafter be designated:
City of Groveland Town Center
See attached legal description attached hereto as Exhibit A.

(the "Property').
The Property is more patticularly depicted in Exhibit B atiachcd hereto and inc01porated
herein.
Section 2: Zoning Classification.
That the Property shall be designated as City of Groveland Town Center in accordance with
Community Development Code of the City of Groveland, Florida.
Section 3: Consistent with Comprehensive Plan.
That the zoning classification is consistent with the Comprehensive Plan ofthe City of Groveland,
Florida.
Section 4: Official Zoning Map.
That the City Manager, or designee, is hereby directed to amend, alter, and implement the offic ia 1
zoning maps of the City of Groveland, Florida, to include said designation consistent with this
Ordinance.
Section 5: Severability.
That if any provision or portion of this Ordinance is declared by any court of competent jurisdiction
to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this
Ordinance shall remain in full force and eflect.
Section 6. Scrivener's En-ors. Scrivener's errors in the legal description may be corrected
without a public hearing or at public meeting, by re-recording the original ordinance or a cettified
copy of the ordinance and attaching the correct legal desctiption.
Section 7: Conflict.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 8: Effective Date.
This Ordinance shall become effective immediately upon its approval and adoption by the City
Council of the City of Groveland.

USE MAP FOR THE HEREIN DESCRIBED PROPERTIES CONSISTING OF 10.09+/
ACRES; AUTHORIZING THE CITY MANAGER TO AMEND SAID

WHEREAS, the request for this large scale plan amendment was initiated by the City of
Groveland with consent of the owner, Ismail A. Ismail, because the FLU designation was intended
to change upon adoption of the 2020 Future Land Use and Future Land Use Map, but was
inadvertently not included; and
WHEREAS, the owner desires to use the property for pm-poses allowed within the Town fi.Jture
land use designation; and
WHEREAS, the Planning and Zoning Board of the City of Groveland held a public hearing on
this ordinance which was advertised in accordance with law; and
WHEREAS, the City Council of the City of Groveland public hearing has been advertised as
required by law for two public hearings with the first public hearing occurring at least 7 days after
the first advertisement was published and the second public hearing for adoption of this ordinance
occurring at least 5 days after the day of the second advertisement; and
WHEREAS, the City Council of the City of Groveland hereby finds and determines that the plan
amendment is internally consistent with the City's Comprehensive Plan; and
WHEREAS, it is in the best interests of the City of Groveland to amend the Comprehensive Plan
for the City of Groveland as set fotth herein; and
WHEREAS, the City of Groveland desires to amend the Comprehensive Plan for the City of
Groveland as set forth below.
Now, therefore, it be ordained by the City Council of the City of Groveland, Florida:
Section 1. Legislative Findings.
The recitals set forth above are hereby adopted as legislative findings of the City Council of the
City ofGroveland.
Section 2. Comprehensive Plan Amendment
The Prope1ty is legally descnbed as: See attached legal desctiption attached hereto as
Exhibit A.

TI1at portion of the Future Land Use Element referenced as the Future Land Use
Map of the City of Groveland Comprehensive Plan is hereby amended by changing
the designation of the Property on the City of Groveland Future Land Use Map
from City of Groveland Office/Commercial and designating the Property as City of
Groveland Town as depicted on the map in Exhibit B.
Section 3. Severability
Upon a determination that by a court of competent jl.llisdiction that a portion of this ordinance or
the comprehensive plan adopted hereby is void, unconstitutional or unenforceable, all remaining
portions shall remain in full force and effect.
Section 4. Scrivener's Errors. Scrivener's enws in the legal description may be conected
without a public hearing or at public meeting, by re-recording the original ordinance or a ce1tified
copy of the ordinance and attaching the correct legal description.
Section 5. Direction to the City Manager.
Upon the Effective Date of this ordinance, the City Manager is hereby authorized to amend the
comprehensive plan and fature land-use map as identified herein after compliance with F.S.
163.3184 and F.S. 163.3184(11).
Section 6. Repeal
All ordinances or pat1s of ordinances in conflict herewith are hereby repealed.
Section 7. Adoption
After adoption, a copy hereof shall be fotwarded to the Department of Economic Opportunity.
Section 8. Effective Date
TI1is ordinance shall become effective upon the 31 st day after adoption unless timely challenged,
and then will become effective upon the date a final order is issued by the Department ofEconomic
Opportunities or Administration Commission finding the amendment in compliance in accordance
with Section 163 .3184, Florida Statutes. No development pennits or land uses dependent on this
amendment may be issued or commence before it has become effective.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GROVELAND,
FLORIDA, GRANTING A SPECIAL EXCEPTION USE IN THE UTILITIES ZONING
DISTRICT IN THE CITY OF GROVELAND TO ALLOW AN INCREASE OF THE TOWN
HEIGHT FROM 199' TO 300' ON THE HEREIN DESCRIBED PROPERTY LOCATED
AT 850 HOWEY ROAD ALSO KNOWN AS STATE ROAD 19 IN THE CITY OF
GROVELAND, FLORIDA, OWNED BY SUMTER ELECTRIC COOPERATIVE, INC.;
PROVIDING FOR CONDITIONS, EXPIRATION AND REVOCATION; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, applicant Sumter Electric Cooperative, Inc., as owner, has petitioned for an
amendment to the existing Special Exception Use granted in Resolution 2009-06-05 for an increase
in allowable tower height from 199 feet to 300 feet; and
WHEREAS, such property is more particularly described as:
The South 424.50 feet of the Northeast quarter (NE ¼) of the Southeast quarter (SE ¼) of
the Southeast quarter (SE ¼) of Section 13, Township 22 South, Range 24 East, Lake County,
Florida, less: right of way of State Road No. 19 along East line. Being more particularly described
as follows: Commencing at the SE comer of the SE ¼ of Section 13, Township 22 South, Range
24 East, Lake County, Florida, thence N.00°17'45"E. along the East boundary of said SE 1/4 , a
distance of 662.85 feet; thence N 89°57'48'W. 46.88 feet to the West right of way line of State
Road 19 (33 feet from centerline) and a 4" octagon concrete monument; thence continue N .89°
57'48'W. 640.99 feet to a 4" octagon concrete monument; THENCE N.00°20'40" E. 424.44 feet to
a 4" octagon concrete monument; thence S.89°58'1 l"E. 636.95 feet to the aforesaid West right of
way line and a 4" octagon concrete monument; thence S.00°12'04"E., along said right of way line,
424.51 feet to the point of beginning. Containing 6.23 acres more or less (the "Property'); and
WHEREAS, all public notice requirements to including, notice by mail, publication and posting
have been meet in accordance with Atticle I. of the Commw1ity Development Regulations;
WHEREAS, the Planning and Zoning Board has considered the petition in accordance with the
standards for granting a Special Exception Use as outlined below and made a recommendation to
the City Council; and
WHEREAS, the City Council has considered the petition in accordance with standards for granting
a Special Exception Use which include: (a) the proposed use is desirable at the particular location,
(b) such use will not be detrimental to the health, safety or general welfare of persons residing or
working in the vicinity, (c) the proposed use will comply with the regulations and conditions
specified in the codes for such use, (d) the granting of the special exception use will not adversely
affect the official adopted comprehensive plan of the city, and (e) in granting such special
exception use, conditions may be imposed as necessary and desirable to protect to the public health,
safety or general welfare.
NOW THEREFORE, BE IT RESOLVED BY THE Cl1Y COUNCIL OF THE Cl1Y OF
GROVELAND, FLORIDA, as follows :
1. The City Cmmcil of Groveland has detemrined that an increase in tower height from 199' to
up to 300' is acceptable at the location of the Property.
2. The City Council of Groveland has detennined that an increase in tower height from 199' to
up to 300' on the Property will not be detrimental to the health, safety or general welfare of
persons residing or working in the vicinity of the Property.
3. The City Council of Groveland has determined that an increase in tower height from 199' to
up to 300' on the Property, will comply with the regulations and conditions specified in the
codes for such use.
4. The City Council of Groveland has further detemrined that the proposed use is consistent
with the Comprehensive Plan for the City of Groveland and will not adversely affect the
public interest.
5. TI1e petition for a Special Exception Use for the Property filed by the owner, Sumter
Electric Cooperative, Inc., located at 850 State Road 19 in the City of Groveland, Florida,
more particularly descnbed below is GRA TED subject to conditions set forth below:
6. Conditions.
a. A single Microwave Tower is allowed on the Property. TI1e Microwave Tower is
allowed up to a maximum height of 300 feet and is to be used only for essential services
communication, the remainder of the site is to be used as a permitted use in the Utilities
zoning district.
b. Co-locators on the tower are not pennitted.
c. This Special Exception Use is granted for a Microwave Tower as described above and
for no other purpose.
d. Tiiis resolution repeals and replaces Resolution 2009-06-05 adopted June 1, 2009.
7. This Special Exception Use shall become effective immediately on its approval and
adoption by the City Council of the City of Groveland, Flo1ida.

SECO Application 2021-13 - Special Exception- Groveland District Office
To demonstrate how this application to increase tower height at this location will assist and
benefit in public safety and to the public:
Electric generation and distribution utilities are some of, if not the most important infrastructure
systems in our country, as we all are heavily reliant on systems that require electricity to operate.
Sumter Electric Cooperative, Inc. (SECO) provides electric utility services to all the businesses,
residents, government facilities, public safety agencies, public safety agency communication
systems, hospitals, and other critical infrastructure in the City of Groveland. The proposed
communications tower will allow SECO to upgrade their existing voice and data communications
systems to modern redundant ones. These state-of-the-art systems will allow SECO to
implement new and emerging technologies with regards to monitoring and maintaining the
electric supply to all the end users.
Furthermore, during the times of natural disaster such as hurricane events in Central Florida,
coordination and communication between many differing agencies is necessary to restore all
things in our day to day lives to "normal". The planned upgraded communications systems will
facilitate potential seamless communication between SECO crews, and all other agencies
involved in disaster recovery efforts.
Finally, SECO's new upgraded communications systems will allow them "to control their destiny"
meaning they will not need to rely on commercial providers of communications which are subject
to fail when needed the most. This ability to manage and maintain their own critical
communications systems gives all the residents of Groveland a little extra piece of mind that the
next time the power is knocked out SECO restoration crews will be able to coordinate these
restoration efforts in a much more efficient and orderly fashion.
In closing, if approved by the City, the tower will allow other users, such as government
agencies or commercial carriers the potential to co-locate on this tower. The tower is designed
to allow up to three third party attachments. This would benefit the City's public safety
divisions and the public if the City is wanting to consider allowing attachments to the tower in
the future.
