Call to Order by Mayor Westcamp at 6:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence The Mayor asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call A motion was made by Council Member Rarey, seconded by Council Member Hilbert, to excuse Council Member Drury from the meeting. Ordinances and Resolutions A. 3rd Readings ORD. 14-042 AN ORDINANCE GRANTING A VARIANCE TO MOOSE LODGE 1245 AS TO THE PERMITTED USES IN THE ESTABLISHED ZONING DISTRICT FOR THE PROPERTY LOCATED AT 220 MAIN STREET, CURRENTLY ZONED PLANNED SHOPPING CENTER (PSC) AND FURTHER GRANTING ANY NECESSARY AREA VARIANCES IN CONJUNCTION THEREWITH Sponsors: Drury Attachments: #2014-10.pdf Law Director Shannon requested Council to consider making a motion to amend Ordinance 14-042 to read at the end of Section 1. the period would be replaced with a comma and the following language would be inserted " provided that the required landscaping barriers are installed at the site in question, and that all outdoor activities cease at 10:00 p.m., with the exception of limited outdoor activities in the to be constructed patio area for smoking". That would be the statement of the amendment as to Section 1. A new Section 2. would state " That the aforementioned landscaping barriers with respect to the west side of the premises shall be installed no later than June 1, 2015, and that all remaining buffers are to be installed no later than November 1, 2015". Section 3. would now deal with the area variances, so the former Section 2. will now be Section 3. to read "That applicant is further granted the following area variances: That the " E Buffer Yard" along the west side of the premises immediately adjacent to the asphalt area be reduced to 5 feet with the same plantings and fencing required for the "E 15 foot Buffer Yard" option. That the required fencing for the "E Buffer Yard" option, in front of the structure be permitted to exceed 36 inches in heighth". Section 3. would become Section 4. with no changes and Section 4. would become Section 5. That is the statement of the amendment. Mr. Fridly stated there is an existing 6' privacy fence on the property to the west, they would like to extend the same style fence, a 6' dog eared privacy fence. Mr. Shannon advised since the City does not have any shored up agreement between the Moose Lodge and the homeowner, property owner, this will indicate you will have to install a fence. If an agreement can be worked out that is acceptable to Administration later as to the common use of a fence, so long as that fence complies with the City's zoning code as it relates to the buffer and the fencing, the City shouldn't have any issues. Mayor - Lance Westcamp Mayor Westcamp reminded everyone Trick or Treat is Thursday, October 30th at the Town Hall. Chief Portier affirmed there will be 1000 hot dogs wrapped for the event and all is ready. B. Administrator - Marsha Hall Administrator Hall thanked the Mayor and Council for their attendance at the Budget Workshop. Ms. Hall reported there will be a number of new legislative items presented to Council starting in November. The legislation will be for the new capital projects for 2015. Assuming the Ordinance for the 2015 Appropriations passes in November, Administration can start the process with ordinances authorizing her to bid out the projects, engineering, etc. Getting the Ordinances to Council in November, would allow them to come into effect by early January 2015. Thus, allowing the bids to go out early in the year to obtain good prices; even though the work would not commence until summer. With so many capital projects to be completed next year this will get the City on the fast track to that end. He noted there was no need to make any cuts which is great for the City of Groveport and its residents. G. Clerk of Council - Ruthanne Sargus Ross Clerk of Council Ruthanne Ross informed Council she will be on vacation starting Wednesday, October 29th through Wednesday, November 12th. H.
