The motion carried by the following vote: Yes: 6- Cleary, Dildine, Grashel, Hilbert, Hutson and Lockett B. 2nd Readings None C. 1st Readings ORD. 19-004 AN ORDINANCE AMENDING THE CODIFIED ORDINANCES OF GROVEPORT - PART THREE - TRAFFIC CODE, TITLE SEVEN, CHAPTER 351, SECTION 351.17, TRUCK PARKING IN RESIDENTIAL AREAS AND THE DECLARATION OF AN EMERGENCY Sponsors: Hutson Attachments: ORD. 19-004 Exhibit A.pdf Law Director Shannon stated that staff had originally requested Council to consider emergency action on this Ordinance but the Mayor would like Council, and potentially the public, to have some input on this matter. The current Ordinance has a 2 ½ ton limit as it relates to vehicles being able to park on residential streets. That will encompass, if the City actually enforced the limit, SUVs, F150s, F250s, F350s and comparable trucks of other manufacturers. The proposed Ordinance would go to a 4 ½ ton limit (9,000 lbs.). City staff hopes that there would not be a need for a 9,000 pound vehicle to be parked on a residential street in a subdivision. Mr. Shannon has been working with Captain City of Groveport Page 2 City Council Meeting Minutes February 11, 2019 Blevins, as well as, Sergeant Joshua Short, on this and the Captain thinks the proposed weight (9,000 lbs.) is appropriate. This is the first time the matter has been brought before Council. There have been some problems with some large vehicles parking on residential streets. There are legitimate concerns for delivery vehicles, fire trucks and emergency squads being able to maneuver through the residential areas. Mayor Westcamp’s concern is that Mr. Shannon and the officers do not have any public input on this matter. The Mayor thinks the public should have an opportunity to voice their thoughts and concerns about having a large truck in their driveway. The issue is there are very large, heavy duty pick-up trucks, some filled with equipment/tools and even large trailers hitched to the pick-up trucks, that are parking on the residential streets which is causing a great deal of parking difficulties. As the current Ordinance is written, if the City started issuing tickets right now, (such as on a vehicle weighing 7,000 lbs.), the City could get into an enforcement issue if a citation recipient pointed out that their neighbor parks a Ford Excursion, or a Denali, that weighs more than the 5,000 lbs. limit. Staff gave careful consideration as to the tonnage that would accommodate the GVW (Gross Vehicle Weight) of new, larger model vehicles. It is not a matter of commercial/business trucks versus non-business trucks; some business trucks could be very light pick-ups. The vehicles Mr. Shannon went out and looked at above the Ford F350 where the GVW was over 9,000 pounds is a huge vehicle. The way the Ordinance is written it does not distinguish large vehicles being parked in the driveway versus on the public street. It states in any residential area. The only exception is someone making a delivery. Council decided to give staff, Council Members and residents some time to look into the matter until the next regular City Council meeting on February 25, 2019. This will give residents an opportunity to address Council with any questions and/or concerns. Clerk of Council Ross read by title Ordinance No. 19-004. VIII. Reports A. Mayor - Lance Westcamp Mayor Lance Westcamp recommended to Council the appointment of Dawn Bellamy to the Cemetery Committee. Administrator - Marsha Hall In June 2017, Council passed by motion the matter of food trucks being on site in the parking lot during the City's Farmers Market. Council made a motion to permit three (3) food trucks to be present at the Administrator's discretion as to the location, on the dates and time of the Farmers Market, until such time that there is a crowding problem. The Administrator has the discretion to stop the practice. Last year, no food trucks came to the farmers market because of the rain and the number of vendors was low. Ms. Hall received a phone call from Andy Schmidt with Schmidt's Sausage Haus regarding a request he had made to Ace Hardware to park a food truck in Ace's parking lot for 2 to 3 hours, during lunch time or after work, throughout the summer season. Mr. Schmidt was advised that the City owned the parking lot. Once City officials have completed the upcoming review of the zoning code changes, there will be some recommended zoning code changes regarding food trucks. Food trucks will be allowed in the upcoming zoning code changes in rural, office, CC (Community Commercial), Industrial and SCPD (Select Commercial Planned District). There is the issue of the zoning code changes taking some time to go through Council’s legislative process. Another issue is the SCPD planned district zoning. When an applicant comes in for a SCPD request, a list is provided of what can be done on that property; food trucks are not included on the list for the property the City owns or for the Ace Hardware building. Ms. Hall’s request is for Council to allow Schmidt’s Sausage Haus food trucks to come in, at the Administrator’s discretion, with or without a farmers market. The City will try the farmers market this year but, it will depend on the number of vendors. Ms. Hall thinks the Schmidt’s Sausage Haus food truck would be a good draw to the downtown area and Schmidt’s is very interested in coming to Groveport. After an open discussion on possible scenarios, such as, having food truck Tuesdays and invite other food trucks to participate; putting picnic tables in the grassy area of the site; skipping the food trucks at the farmers market in favor a specific food truck day, or doing both the farmers market and a specific food truck day. This year the farmers market will be run through the Town Hall. The Chamber of Commerce will not be involved this year if the City decides to have the farmers market again. Schmidt’s Sausage Haus food truck would be a big draw for vendors to participate in the farmers market because people drawn to Schmidt’s food truck could be drawn to the vendors’ booths and to Ace Hardware. Director of Finance - Jeff Green Finance Director, Jeff Green, reported the City received notice last week that it was awarded the Certificate of Achievement for Excellence in Financial Reporting from the GFOA for the City's 2017 CAFR. Mr. Green and Administrator Hall are working on the annual report with department heads' submitting their reports. The plan is to have the finished annual report at the printers by the end of February. The Finance Department is busy with this year's audit. For the first time in five or more years, the City is not using Julian and Grube. The City has to use the State this year, because the State has not done the City's audit in a while. E. Council Members - Jean Ann Hilbert, Ed Dildine, Shawn Cleary, Becky Hutson, Scott Lockett and Chad Grashel Council Member Jean Ann Hilbert reminded everyone of the Narcan training at the Presbyterian Church, tomorrow night at 7:00 p.m. The training is free and open to the public. Council Member Shawn Cleary addressed personal health and safety and physical harm for Valentine’s Day coming up on Thursday. He jokingly commented on the risk of forgetting to do something for Valentine’s Day. Council Member Cleary noted, after conversing with the other Councilmembers, as there is nothing on the agenda for next week’s meeting, the Committee of the Whole meeting scheduled for Tuesday, February 19, 2019 is canceled. Departments are to submit the monthly reports as usual.
